ORDINANCE NO. 2023-04 AN ORDINANCE UPDATING THE TEMPORARY LAND USE REGULATION MORATORIUM ON NEW DEVELOPMENT ACTIVITY AND NEW SUBDIVISION APPROVALS AND ZONING CHANGES ON LANDS DESCRIBED HERIN WITHIN THE CITY OF SUNSET WHEREAS, the City Council of Sunset is desirous of updating the temporary land use regulation moratorium on new development activities, new subdivision/development approval or zoning changes pursuant to Utah Code 10-9a-504; and, WHEREAS, the City Council has already enacted a land use moratorium for the past six months; and WHEREAS, the City Council has identified a critical need to establish and/or update the applicable zoning laws of the City. During research and reporting for State law the City identified the current ordinances are not sufficient for new developments into the City nor are they sufficient to support the Moderate Income Housing Plan in accordance with Utah Code 10-9a-408. The City Council would like to establish standards and practices that protect the health, safety and welfare of the residents of the City of Sunset and to address additional measures to support moderate income housing in accordance with Senate Bill 34; and WHEREAS, the City Council has determined and found there is a compelling countervailing public interest to update the temporary land use ordinance restriction in the form of a moratorium on any new development or zoning changes within the City of Sunset until such plans and ordinances can be adopted; and, WHEREAS, the City Council hereby update the six-month moratorium on any new subdivision and new development applications to allow time for adequate planning and a comprehensive review and revision of the applicable ordinances pursuant to Utah Code 10-9a-504. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF SUNSET CITY, as follows: 1. Any new subdivision and development of any real property located within the limits of Sunset City are hereby temporarily prohibited, and a moratorium on the filing and approving of any application filed before or after the date of adoption of this Ordinance. 2. The moratorium established by this Ordinance shall apply to all applications for subdivisions, zoning changes, or any land use application filed before or after the date of adoption of this Ordinance. 3. During the moratorium period, the following permitted activities are not prohibited or subject to the moratorium: HVAC, AC/Furnace, Roofing, sheds, remodeling, additions, solar, plumbing, signs and other permits of this nature. 4. The moratorium shall be in effect for the period of six-months from the date this Ordinance was adopted by the City Council.
