The Administrative Hearing for the Salt Lake City Planning Division was held remotely on Thursday, May 25, 2023, at approximately 5:00 p.m. John Anderson, Planning Manager, was present as the Administrative Hearing Officer and called the meeting to order.
John Anderson, Administrative Hearing Officer reviewed the hearing procedures including the boundaries of his duties. He then introduced the conditional use request that was to be reviewed.
1. Trolley North Temporary Cell Tower at approximately 675 E 500 S - Valerie Cardenas of Smartlink (representing AT&T) and Keleigh Glass Adams of J5 Infrastructure Partners (representing Verizon) are seeking Conditional Use approval for a wireless telecommunications facility at the above-stated address. All wireless telecommunication facilities located within a TSA Districts require Conditional Use approval when they exceed the maximum permitted height, which in this case is 75 feet. The proposed facility would be approximately 121 feet tall at its highest point. The intent of this proposal is to maintain uninterrupted cellular service between the demolition of the existing building on the property (where the antennas are currently located) and the completion of the Trolley North development project (currently under review by the Salt Lake City Historic Landmark Commission), after which the antennas would be moved to stealth facilities that are part of the proposed development. The subject property is located within the TSA-UN-C (Transit Station Area Urban Neighborhood Core) zoning district and is located in Council District 4, represented by Ana Valdemoros. Aaron Barlow reviewed the petition as outlined in the Staff Report (located in the case file).
John asked if this conditional use was denied, what kind of impact would it have on the local service. Craig Z stated that it would disrupt the service for downtown during the development. Valerie Cardenas stated that it would really impact the services during the transition period. Craig Z stated that they have invested a lot of effort to make sure services are not interrupted.
John Anderson, Administrative Hearing officer opened the public hearing.
John Newman stated their approval for the project and additional details on the project.
Craig Z stated that the project would be bonded.
Seeing no one else wished to speak, John Anderson closed the public hearing.
John Anderson asked if Aaron had looked into the requirement for a COA for the project. Aaron stated that a COA will be required for the project and a petition will be presented on the upcoming Historic Landmark Commission meeting. John Anderson stated that he believes it is important to place a time requirement for the project.
Motion
John Anderson, Administrative Hearing officer stated, 'Based on the information in the staff report, the information presented, I approve petition PLNPCM2023-00215 with the condition the proposed facility and all associated structures must be removed from the subject site if the associated development project (PLNHLC2022-00675) is not completed within three years of approval of this Conditional Use. The applicants may request a one-year extension not less than 30 days before the end of the 3-year period with no limit on the number of extensions that can be requested.'
There being no further business, the Administrative Hearing was adjourned at approximately 5:24 PM.
