4. STATEMENT OF CONFLICT -
5. APPROVAL OF DECEMBER MINUTES - Levi motion, Jennie second, Vince, Jennie all aye
6. MAYOR, COUNCIL AND DEPARTMENT REPORTS -
- Mayor: Moving forward with the project we have already had going on. Sewer study, road project. We need to fill an open TC seat. The seat will be posted this week. Judah has resigned due to moving out of town. We still need to fill the building inspector position. We have a couple of applicants.
- Fire Chief: Not present.
- Marshal: Not present
- Treasurer: Need a public hearing FD building/fire trucks for payments to BW. Move money from Building Authority to FD.
- Planning & Zoning Administrator: Not present
7. CITIZEN COMMENTS (2 minutes per Citizen Comment) -
Anne Welsh- Would like to see more information. Anything that can help keeping the public informed. I know Ashley newsletter. I would like to comment on the deaths in the town that were alone and not discovered for several weeks. I was wondering if we could see something the community can do to help check up on people. Mayor David Schmuker - We do have the Post Office report when mail hasn't been picked up in a few days. Anne- Maybe we could offer people to sign up for a buddy system. Council Member Jennie Lassen- The city of Page had a program where elderly that were living alone that they would call in and get checked off a list. Mayor David Schmuker- That would work with people who like to talk/call, but it will not work with a resident that is more reclusive.
Marlin Gill- Under new business he would like to understand agenda items. I would like to say that my dog was killed by two big great Danes, I believe they were from an Airbnb. I am concerned about the people coming into this town that really don't care. Todd Burton- There is an Airbnb across the street from us and we have seen those people interacting with our horse. I think there could be something in their agreement with the homeowner about not interacting with animals. Jim Lyberger- will it be posted what the requirements are for the open seat. Hyrum- Without a work session it isn't as easy to understand what the agenda items are all about. Peggy Short- I have talked to the Marshal about dogs, there is one always out down my road. One chases cars one chases people; I have talked to the Marshal. I have thrown rocks. Mayor- We should put something in the newsletter.
I. OLD BUSINESS -
a. Discussion and Possible Action on changes to the Updated General Plan
Mayor David Schmuker Motions to adopt General Plan, Jennie Lassen seconds, Levi Banfill aye, David aye. Motion Passed
II. NEW BUSINESS -
a) Discussion and Possible Action on Resignation of Councilman Judah Schmuker
The position will be posted but will only through to the next election. Will fill position in February.
b) Discussion and Possible Action to Adopt Resolution 2023-1 to Open Fire Fighters URS account & begin certification process.

c) Discussion on and Possible Action on Transient Room Tax
Katie gives info on transient tax collected.
d) Discussion and Possible Action on Town Newsletter - Ashley Rankin would like to begin doing this for the town.
Motion to move forward with BW Town Newsletter made by Vince Olson, second Levi Banfill with the stipulation that content and final approval go through Town Hall Clerks before publishing to the public.
e) Discussion and Possible Action on Jeremy Dyke leave time accruals
Motion to back date accrued time made by Levi Banfill, Jennie Lassen seconds, David Schmuker aye, Vince Olson aye, Levi Banfill aye. Motion Passed
f) Discussion and Possible Action on Cooperation Agreement Between the Town of Big Water and Kane County; Emergency service
Motion to adopt Levi Banfill, Jennie Lassen seconds, Vince Olson aye, David Schmuker aye, Levi Banfill aye. Motion Passed
g) Discussion and Possible Action on ordering Radios for the Fire Department as directed by the Utah Communications Authority to be compliant by end of year.
Tabled - Old business. if there is a deadline, we can schedule a special meeting.
h) Discussion and Possible Action on hiring Liz Coates on a temporary basis to assist with closing out the calendar year.
Peggy - Liz is already an employee of the town and being paid out of administration. She can continue to do work for Town Hall as needed without posting an official position or moving funds around in the budget.
i) Discussion and Possible Action on Wadleigh Weise Easement Abandonment
Mayor- This has been done since 1985. It's a road that doesn't go anywhere. Levi- I believe there is private land that could be sold. Vince, who previously owned that easement. What do these two parties have to do to in order to get it wiped off as an easement.
Tabled.
