D. Present Plans to Build a Green House on his Property Located at 200 East 100 North to See if a Variance Would
be Needed/Tyson Hathaway. Mike Hathaway attended as Tyson was out of Town. Tyson wants to put a green house on his property and would need a variance on the West Side. The Mayor stated that a green house is an allow use on a property located in a Rural Residential Zone. Tyson is not planning on it being commercial at this time but might want to change that in the future. Dave pointed out that it would be considered an accessory structure as listed on page 76 in the Town Code. He went over some of the Town Code at this time. Mike said the building would be 15 feet high at the highest peak. He presented a drawing. The Commission thought it would be good to get a more detailed drawing. The Mayor explained that if the Planning and Zoning felt the green house would not be allowed according to Town Code, then the Board of Adjustments would still look at it.
Peggy pointed out that it might not be intended to be commercial now but if it did become commercial, it could
become an issue with people driving in and out of the property and not having enough setback. The Mayor explained that the variance could be allowed along with a conditional use permit banning commercial use. Mike explained that between the road and the ditch, there would be room to park an entire row of cars.
Cameron pointed out that on page 81 of the Town Code it states 12 ft. minimum side yards are required with no exceptions to allow emergency vehicle access.
The Commission felt like they would like to look at the property site and have Tyson make up a more detailed drawing and then place this on the agenda for January Planning and Zoning Meeting. Cameron wondered where the frontage would be as he understood that the frontage was where the address is accessed. This might make a difference. Will look into this.
E. Define Habitable Accessory Structures to add to 155.116 (B) Definitions (page 77, Title XV Land Usage). Dylan had been given the assignment to look into this and come up with a definition. Dylan had put together a definition and passed out copies to the Commission Members. He went through it at this time. The Commission liked his definition. Dave suggested gearing it a little more to Oak City Town and then present it to the Town Council at the January Town Board Meeting.
F. Discuss a Better Definition of Mobile Home in 155.116 (B) Definitions (77, Title XV Land Usage). Dylan had prepared a recommendation on this and presented it to the Commission Members it also included a recommendation on Mobile Homes. The Commission liked these definitions also. Dave thanked Dylan for the work he put into putting these definitions together.
G. Provide a Definition for Manufactured Homes. This was discussed along with item F.
H. Adjourn.
