MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION CENTRAL VALLEY TOWN, SEVIER COUNTY, UTAH A regular meeting of the Planning and Zoning Commission of Central Valley Town was held on June 8, 2022 at 7:30 pm at the Central Valley Town Hall, Central Valley Utah after due and timely notice had been provided pursuant to Section 52-4-6 UCA 1953, as amended to date. COMMISSION MEMBERS PRESENT: Brandon Barney, Cassie Bateman and Leanne Pope. ABSENT: Bryan Brown SECRETARY: Karen Busk TOWN COUNCIL REPRESENTATIVE: Susan Outzen, Town Council PUBLIC PRESENT: Lisa Cleveland, Gary Zeluff by telephone, Bill Anderson, Brad Duffin and Robin Ames. WELCOME: Brandon Barney PLEDGE OF ALLEGIANCE: Led by Brandon Barney PUBLIC HEARING: Gary Zeluff - Single Lot Split; final checklist, fees Lisa Cleveland explained that Gary Zeluff could appear by phone if needed. Lisa stated that they want to want to proceed with the single lot split. Susan Outzen reminded her that it lies within the protection zone. The town council will not permit the house on water protection zone. The west portion would be eligible for building on but seller must disclosure to the buyer that the property falls into zone 3 & 4 according to the Meacham Buyers Act. Brandon Barney explained that the $3,000.00 water conveyance fee needs to be paid. Lisa Cleveland called Gary Zeluff to verify what has been paid. He said that he had sent in a check. Susan Outzen told him that the check for $320.00 that he sent in was unsigned and that it was destroyed. Brandon Barney asked if there is a certificate of title. Lisa Cleveland said it is in the folder but that she does not have the perc test and plat. Brandon Barney opened it up for public comment. There were no comments. PUBLIC HEARING CLOSED AGENDA: 1. Gary Zeluff - Single Lot Split: final checklist, fees Brandon Barney began going thru the checklist for Gary Zeluff. He explained to Dr, Zeluff that the next twelve items on the list pertain to the plot map. So Brandon Barney tabled the matter. Gary Zeluff is to get the final draft and we will move on with this on July 13th. Susan Outzen is checking on the check that Mr Zeluff sent in. Brandon Barney asked Lisa Cleveland to make sure as seller, to make sure buyer knows to disclose approach requirements. And that they can get the specks from Bob Watts at Sevier County Road Department. 2. Minutes: Motion to approve May 11, 2022 meeting minutes was motioned for approval by Brandon Barney; LeAnne Pope seconded the motion. Motion carried. Minutes approved as written. 3. Bill Anderson - Thompson Springs Subdivision: Presentation of Plat, Preliminary checklist, Fees Bill Anderson and Brad Duffin approached the council with Mr. Anderson's plot. Susan Outzen explained that the town council had gotten involved and explained the water protection and Bill Anderson will deed that part of the property to the town. In 2007 the current owner wanted to hook up to town water. There are two taps authorized by the town for the property. Looking at the preliminary plat, Mr. Anderson will be adding at least two more fire hydrants. Susan Outzen stated that he would be liable for them and that they would need to be 500 feet apart. Brandon Barney said he would need a perc test before the public meeting on July 13th. Bill Anderson said that he has talked to the county about approaches and one 45 foot culvert will work for two approaches and they must be asphalted for the county. Susan Outzen told Mr. Anderson that he would need a certificate of title instead of an abstract title. Brandon Barney stated that we will be setting the matter for public hearing on July 13th. And went over the fees to be paid. Application fee: $12,680.00. Filing fee: $680.00 Conveyance fee: $1,200.00. Bill Anderson payed. 4. Temporary Vacation Rental Ordinance Project LeAnne Pope had contacted Jenaka from Elisnore. Jenaka said she is very concerned for Joseph has nothing in place. She said she would be more than willing to share her planning and zoning book. LeAnne Pope provided Jenaka's email to Karen Busk whom will contact her and Susan Outzen said we can share what we have from Richfield with her. Cassie Bateman had contacted Monroe and they require a business license under conditional use. Including noise, trash and parking. The commission members reviewed Richfield Cities proposed amendment. Karen Busk will type up a temporary vacation rental ordinance from Richfield's to be reviewed at our next meeting, July 13. All members to keep in mind defining: Extended Stay; Short Term; Motel, Hotel; and AirB&B. 5. Accessory Dwelling Unit Discussion/Project The commission decided that culinary water use be written into the ordinance. If you want to build a home with an out building behind. The town will not allow you any water till your house is built to a certain point. Also, no building on any protected spring a must. PLANNING AND ZONING AGENDA CONTINUES: OTHER BUSINESS n/a Next meeting will be July 13, 2022. ADJOURNMENT 1. A motion was made to adjourn by Brandon Barney; LeAnne Pope seconded the motion.
