APPROVED MINUTES
Notice is hereby given that the Mayor and Members of Town Council will hold a special Town Council Meeting on Thursday the 3rd day of November at 7:00 pm at the Torrey Town Pavilion located at 75 E 100 No. Note the agenda may be accelerated or line items may be discussed in any order. The agenda shall be as follows:
Welcome Mayor Mickey Wright
Roll Call: 7:00 pm
Present: Mayor Wright, Doug Robinson, Pat Kearney, Pearl Thorndahl-Stewart, Jordan Pace, Karen Mayne
Review and discussion of current water resolutions
Mayor Wright found that there are additional resolutions that need to be added to the Council members Town Ordinance notebooks.
The 1995 resolution defines the geographic area of the water district. During a ride along with Dustin Mayor Wright noticed that there a couple homes receiving Torrey water and yet they are not in the Torrey Water District. A discussion began questioning what to do about those homes not in the water district. The water district lines will be reviewed by the Town Council. A determining factor for the water district will be if the entity already has water.
The 2008 Resolution is a result of the moratorium. The following resolutions in 2014 and 2015 were adjustments to the 2008.
The 2014 Resolution amends section 18 and 21 of the Resolution 2008 - 1. The 2014 resolution concerns when to file applications and reserves the right of the Town to water connection governance.
The 2015 Resolution concerns rules on subdivisions and references the 2008 -1 resolution.
Discussion began about the status of the 2010 ordinance and the resolutions amending the 2010 Ordinance.
Review and discussion of current water ordinance draft update, Revision 2
Page 1- No objections to anything on page 1.
Page 2 - This change is modeled after the Duchene water ordinance. It reinforces that the Water Manager (Dustin Oyler) approves individual cases and connections. Any disputes between neighbors will go to the Town Council. A discussion began about accessory dwellings connection questions in (8-1-16). In Section 8-1-16 it now reads that adding an accessory dwelling or building will require the written approval of the water superintendent and comply with Chapter 2 backflow and cross connection.
Questions were raised about 4-plex and condos and their water meters. Discussion continued about water connection and leach fields in septic systems when property is split. The Utah Department of Health regulations will come into play.
The Town Council members agrees with the changes made on page 2 of the water ordinance.
Page 3.
8-1-11 States that that you need a meter if you go through a fire hydrant. Discussion about the need for a third water hydrant meter for large road projects and to serve as a spare.
Discussion of delinquent water bills. Penalties. Reconnection fees and the potential of the use of a 'Deposit' to reconnect service. Pat had questions about the summer-only residents who cutoff their water during the winter. Mayor Wright will clarify how that situation is handled with water billing. The language about deposits will be clarified as well.
8-1-16. Mayor Wright rewrote this section to simplify; stating Dustin Oyler, water superintendent, oversees adding additional connections to the system. Adding additional locations to the water meter such as an accessory dwelling or accessory building shall require the written approval by the water superintendent and shall conform to Chapter 2 backflow and cross connection.
8-1-16, Paragraph I. The well drilling question discussion was held. Do we want to prohibit well drilling within the water district? A unique situation occurs when an entity is located within the water district but does not have a connection to town water.
Discussion about monitoring/metering of all water usage except fire department. Mayor Wright will strike paragraph, J.
Review and discussion of handling of water Equivalent Residential Units (ERU)
2008-1 Resolution declared the original additional 89 ERUs. In February 2022 the Town Council had a Resolution to amend 2008-1#6 to say Torrey has 60 new ERUs plus the 4 ERUs that were still unused. Since this information is fluid, a resolution is better. We need to draft a resolution to state how the city will manage ERUs. This resolution will affect only commercial ERUs since residential is by definition 1 ERU per home. Discussion of amount of ERUs for commercial properties.
Discussion began regarding the designation of 'commercial' regarding rental properties, hotels, 4-plex etc. Need to draft a resolution to cover the management of ERUs. Should Torrey require commercial properties to acquire an engineer evaluation stating the projected number of ERUs needed.
Pat recommended that we create a classification of commercial properties so that there are levels of usage for commercial properties. Mayor Wright will call Kelly and see if there is a way to require a letter from an engineer to clarify the amount of water (ERUs) needed.
Discussion began about auditing the amounts of water usage of hotels compared to other commercial properties. to clarify the usage of ERUS and audit the current usage
Torrey Town Council will write a resolution requiring a commercial property to provide the number of ERUS as determined by a water engineer.
Motion to Adjourn.
Pat Kearney made a motion to adjourn, Pearl Thorndal-Stewart seconded the motion. The motion passes unanimously. The meeting was adjourned at 8:31PM.
