Description/Agenda
Planning and Zoning October 5, 2022 The Planning commission met on Wednesday, October 5, 2022 at the public safety building located at 130 W. Main in Cleveland, Utah at 7:00 pm. Those present were commission members: Tracy Randall, Tyler Rowley, and Nancy Livingston. Excused were Kit and Annie Andersen. Town Council member Kristen Vose was in attendance. Public attendance: Scott Page, Mayor Trevor Rowley, and Kallon Cowley. The meeting was opened with the pledge of allegiance. Minutes: A motion was made by Nancy Livingston to approve the minutes for the August meeting. A second was given by Tyler Rowley. All were in favor. Motion passed. Public Comments: Mayor asked for some time to ask question after the action items were taken care of. Item #1: Scott Page wants to apply for a commercial kennel license due to excess number of dogs owned that he breeds and sells. Scott Page introduced himself and then asked the commission to rezone his property from residential to agricultural. Tracy Randall suggested that we look at the zoning map to see where his property is located. Property was located on map in residential zone. He showed what part of his property he would like to have rezoned to agricultural. It was found that the county border goes through his property. The back part of his property is located in the county. Tracy Randall suggested that if he wanted to put the kennel at the back of his property on the county side he could go through the county. Tracy Randall stated that she did not know if the county zoning map would show that part to be agricultural or not. He could look into what the designation is for that part. He would need business license eventually and would have to show how he will deal with the issue of noise. Also, to rezone his property, the neighbors would have to be asked about it as well before it could come before the council for a decision. Public Question: Mayor Trevor Rowley stated that he appreciates those serving on the commission. He would like some information or input on the situation located at 190 N 50 W belonging to Mr. Jensen. Tracy Randall stated that Mr. Jensen only applied for a building permit for his house and not the sheds. The sheds are not in compliance with the setback ordinance of 5 feet from sidewalk. Also, that Mr. Jensen is not in compliance with the animal ordinance. The Mayor asked about the ordinance for fines if the commission had anything to do with setting fines or knew about fines for violations. Tracy Randall stated that the Planning and Zoning Commission do not do enforcement or set fines for ordinances, that is for the Town Council. Item #2: Adjourn Meeting Tracy Randall adjourned the meeting. Nancy Livingston, Clerk
