- Mayor-Clarify in kind donations with attorney. Not done yet
- Mayor-Report lot square footage to Helen Wahlstrom. Reported to Helen. There is a100 feet. Helen and her family are willing to give this to the town. This may require an exception or we may have to move the bench. They have two lots per the mayor. They didn't want to change anything in the park. Helen's children may want to build a home in years to come. Duane asked if there is a 200 feet frontage. There is supposed to be 100 foot frontage. Delora asked if there is 100 feet on the other side. Mayor did not measure there. Duane said if there are 2 lots then they should be a subdivision. Eldon
said that this is premature to make this decision. Do we need the bench on the side? Mayor said there won't be room for anything else.
Eldon commented that if we improve the ball park then we may need more room to make dugouts. Helen wants this be settled before she passes. Eldon thinks that we need to look at it harder. Mayor asked members of the council to look at the property individually before we decide. Each member should look at it before the next meeting. Then a discussion should take place at the next meeting.
Mayor noted that because we are putting so much money (TRT) into the rodeo grounds we may need to hold other events there. *Action Item Alice to put this on the next agenda.
- December meeting will be a regular meeting. We will need to schedule Christmas dinner.
Dennis arrived at 7:12pm. Dan arrived at 7:25pm.
- Mayor-Speak to attorney RE: Division of property (eg Esterholdts). We do have a draft lot split ordinance to discuss this evening. Esterholts wanted to put their property in kid's name.

- Alice-Generate Independent Contractor Agreements and Job Descriptions for Dan, Jeff, Heidi and Cody. This has been completed. The Independent Contractor Agreement was generated by Andrew. Alice added each contractor's name at the bottom of each
agreement to provide specificity for each contractor. Otherwise, each agreement is therefore the same. Each council member and the mayor were sent these agreements and job descriptions via email ahead of the meeting to review. Each agreement has a job description attached that details the specificity of each job. Alice sent Dan the job description for his job and Jeff's for his review and comment since she was not clear of exactly what his job entailed. Dan has not provided comments.
Council members reviewed. They are all approved.
Eldon moved the discussion to Cody's snow removal proposal. Eldon wants to tighten the agreement terms. He wants the contract set up to negotiate both ways. Cody talked to Chuck before submitting his proposal. Eldon wanted to know who decides what is an average snow fall. Brandon stated that everyone probably won't have a problem with what Cody has proposed. Delora asked is this is an annual contract-mayor noted that it's a 3-year contract. His agreement can be terminated with 30days notice. Kris said we should probably do this annually instead of 3 years.
Dennis commented that we are retaining him to do the job.
ACTION: Brandon made a motion to approve Cody's contract with addition of 'significantly' large snow year. Seconded by Kris. Motion passed unanimously.
- Alice-Contact Heidi RE: weekly cleaning. Completed
- Alice-Ask Brian to keep an eye on status of fence repair. Alice met with Brian. Kelly Weston has repaired the fence. Judy Neff called and was appreciative that Kelly repaired the fence and reported that the ball players jump the fence which causes damage to the fence.
- Alice-Make duplicate keys for park, office and concession stand. Completed
- Alice-Review DotBar contract. Completed. Alice asked the council when DotBar should start paying the city per the contract. The contract states $100.00/month payments should start 'during the term of the initial lease'. Mayor is satisfied with the contract as is.
- Alice-Send Brandon's tracked ordinance 9-1-3 to attorney. Completed
- Alice-Provide copies to Duane of all 'new build' forms that have been completed since she has been the clerk. Completed.
Duane asked if Hal has done anything on the permit? Dennis Hodges responded yes, he has the scales. Going forward Alice to send 'building forms' to LouJean Argyle. Per Eldon, everything is online now. We should still meet with the county to understand the process. Duane suggests that a member of planning and zoning should meet with LouJean at the county and then the new building inspector should come to our next meeting. *Action Item: Duane, meet with LouJean so we understand the county process.
- Alice-place ordinance 8-1-2 and 8-1-5 on December agenda (application for water connection, fee for name change needs updating.)
- Alice-Contact Cody RE: interest in snow removal contract. Completed.
- Eldon-check with Stan RE: history of Mike Mattson's pot hole. Brandon did a drive-by. There is a pot hole. Eldon did talk to stan about the history. Stan does not remember that snow removal did the damage. Mayor commented that he would like to attend commission meeting to ensure our road improvements get taken care of.
- Kris-Speak to Cody RE: spraying for weeds at the park before winter. Completed. Cody said that he forgot to do this so he will do this early in the spring. Mayor would like to use street money to spray right aways with weed killer and to have this done earlier in the spring. Mayor would like the right aways sprayed with weed spray to keep weeds under control.
COUNCIL BUSINESS:
Heidi Hodges-Activity Committee Update:
Heidi thanked the council for receiving keys to the rodeo and park. She and her committee put flags on veteran's lawns. Weston's, Hatches and Astle's. Flags are at the station if anyone wants an opportunity to install them. Brandon will put one up tomorrow. Heidi will finish. Kris will help Heidi.
Christmas lights: Mayor talked to Steve, they will meet together on Monday and review where the lights can be placed. Steve reported to the mayor that he wants to do this locally without going to upper management. Steve won't allow us to sting wires between poles. Steve will look at how many poles might be able to be used.
Tree lightening ceremony: Heidi would like a date from the mayor when committee might we be able to do this. Delora talked to Lance regarding the annual application? Delora reported that there is a form we need to complete. Dates Heidi suggested are Nov 30 or December 5th. Heidi wants to get the flyer out 2 weeks prior. Mayor thinks the 30th is a push and that they 5th would be better. Mayor should know by Monday. Kris asked if all money will be spent on the trees or could there be some for lightening in the park. Could we use some of the money to wrap the trees in the park? Park should be the focus this year. Lights on two big pine trees. Heidi asked if during the tree lightening would there be fire restrictions for fire works? Mayor said that we follow the county fire restriction. Can we do fireworks in the park with a local person? Mayor wants to look at where folks have hay stacks. Mayor will drive around before we decide to do fireworks.
Heidi asked about extension cords so we are not tripping on them. Can someone plow or shovel before? We can work on this when it gets closer to see what the snow removal needs may be. Fire in fire pit is OK. Chili cook off, cookie exchange, Santa will be there! Last year Heidi wanted to use direct door- its mailing process. She reported that it costs about $130.00. Heidi wants to use this process and Heidi noted that this amount would come out of her budget.
Mayor approved this.
Eldon requested that the information on the flyers specify that this is a city activity sponsored by the activity committee.
ACTION: Mayor entertained a motion to open the budget to enter the income the activity committee made at the rodeo. Brandon made the motion, Eldon seconded it. Motion passed unanimously.
Activity Committee revenue and expenditure financials were provided to the council for their review. The mayor explained the report to the council along with the process for accounting for the expenditures within the budget.
ACTION: Brandon made motion to add funds into the activity committee budget. Eldon seconded. The motion passed unanimously.
Eldon asked if the revenue carried over from year to year. The $3,000 will not carry over but the monies they made from rodeo will carry over.
Mayor reminded Heidi that taxes will need to be paid from activity budget for the revenue they made from the concession stand and T-shirt sales.
Heidi left at 8:28pm.
Fee Schedule (added to the agenda): Revised Consolidated Ordinance (not yet assigned a number): Mayor and council members were sent the revised consolidated ordinance with attached newly generated fee schedule for their review via email prior to this meeting. The discussion focused on the fee schedule. Name change fee needs to be added-$150.00. *Action Item-Alice to notify Kendall to add this to fee schedule.
Mayor noted that the building impact fee on page one should be deleted. This fee is a road maintenance fee and is included on page two.
Mayor noted that our fee for water usage is currently fair. Delora asked if we should increase our water overage fee. Dan says that 10,000 gallons per household should be enough for each water user.
Brandon asked what the peak season race fee is for. The mayor noted that BL regional commission has a bike race.
Delora asked if the dog at large fee should be taken off. Mayor said it needs to stay so police have a way to enforce if a dog bites, barks or harasses livestock.
Brandon asked Alice for a clarification regarding the redlined version of the consolidated fee schedule ordinance. He wanted to confirm that there was no intent or effort to change the original verbiage, only to consolidate. Alice confirmed that is correct. Mayor asked Duane that the planning and zoning committee review the changes and to let Alice know if they have any comments/edits to the document.
Alice asked the council what the fee should be when the water ownership of a piece of property changes. In the past, the city has charged $150.00 but this fee is currently not included. That fee should remain the same and added to the document.
Duane Robinson-Planning & Zoning Commission Update:
Duane and planning and zoning committee want to ensure that when we revise the appropriate ordinance that it states the following information: set back requirements on side and rear for commercial property is 10 feet. Brandon confirmed that this verbiage is included in the revised ordinance.
Change time of meeting is now 7:00pm

Jeff Brimhall joined Dan to install this meter. Dan reports that he has a lot of knowledge regarding water. Dan suggested that we move forward with Jeff's training and testing via Rural Water of Utah so he can become Grade 1 water certified. *Action Item-Alice to work with Jeff to get him certified. Dan needs to do Courtney Robinson's meter.
Dan pulled his own meter transmitter. Dan needs to return black part of the meter (on top) to Alice and we can send back to Meterworks and get it replaced.
Dan performed his annual tree removal process to remove trees from growing around the area. He still needs to remove stumps. He did look in the spring box and reports that everything looks good. The spring is running good. Eldon noted the same.
Delora asked Dan how the chlorinator is working, has the repairman wrapped things up yet. Dan said its working good, but the repairman has not responded. We are still waiting for parts. He checked it today after our recent power outage and things look good.
Mayor talked to Ben- he looked at what they did with our lid. Mayor told Ben the repair is not acceptable and that when the snow is plowed this year, it will be damaged. Mayor has not signed off on the work.
Roads & Streets Updates-Councilmember Brandon Willis
We have contract with Anderson Asphalt (copies provided to the council) for crack seal repairs. Brandon reports that this may not be completed until spring due to moisture. Eldon will help Brandon.
