Minutes of Torrey Town Council Meeting
Meeting commenced at 6:24 PM
Welcome Mayor Mickey Wright
Discuss and consider an ordinance to establish a water connection moratorium:
First Mayor Wright is suggesting adding language to 815E which is the water meter application process. It mentions both connections and applications. The additional language reads '8-1-5 E
E) This update to Title 8 Public Utilities is to create a moratorium on new residential and commercial water connections and applications for a period not to exceed six (6) months. This ordinance will take effect immediately upon passage by the Torrey Town Council at the July 21, 2022, Special Town Council Meeting. The reason for the ordinance is to allow Torrey Town to update its water ordinances to address water supply and demand issues.'
Pat made the motion to accept the ordinance for the water moratorium, Pearl seconded the motion, and it was passed unanimously.
Review and discuss updates to town water ordinances:
A Water Ordinance draft was created by Mayor Wright and emailed to the Town Council. The draft included the following changes:
1. 8-1-4 needs to be changed to reflect that accessory buildings are not required to have a separate water meter. Accessory buildings no longer need an additional meter.
Zoning Ordinance definition of an Accessory Dwelling, is, a secondary habitable living unit containing a minimum of kitchen, bathroom, living and sleeping areas located within added onto or detached from the primary single-family dwelling, on the same lot. Restrictions on size and height continue.
Discussion and questions continue about the definition of accessory dwelling and short-term rental buildings. Mayor Wright noted that he will look at adding language to clarify short-term rental usage of accessory or primary dwelling.
Discussion of water access inside city limits or outside city limits. Torrey ordinance states that everyone in the water district should be treated the same. Rates may be higher outside the city limits based on maintenance and service needs.
Discussion of items not included in the current ordinance:
1. Pat discussed an older version of the ordinance. The 2010 ordinance and 2008 ordinance #23, states Torrey has preliminary approval of water application, final approval, and reasonable time to comply during the building process.
Preliminary approval for the water permit requires all valid building permits must be submitted in 60 days. The applicant must commence building within 90 days. All these requirements date back to the 2010 ordinance. Is this still enforced?
A discussion regarding easements and requirements for water hookups took place.
2. 8-1-15C will be changed to say, 'The town will require a certification from a certified Engineer.'
3. 8-1-16, correct language to comply with 8-1-4. Discussing accessory building hookups and multifamily buildings. Sections 'A' and 'D' need to change to be consistent with 8-1-4.
4. 8-1-16H, Ordinances must be reviewed to insure it will comply with State law. Discussed the approval of wells.
8-1-13, Discussion began in regard to issuing a moratorium for the purpose of updating ordinances. The City Attorney felt it was a valid reason.
Discuss annexation laws and procedures.
The publication Powers and Duties outlines the state requirements for towns who wish to annex property without petition. Requirements include the city/town must be:
#4 A city of the first class.
#3 A city of the second class.
#1 A city must supply the majority of services.
#2 The city must supply one or more services and the population being annexed is fewer than 800 residents.
Discussion commenced regarding the existing Torrey Town annexation policy plan. The discussion included the number of utility lines which extend outside city limits. A future discussion should include County Commissioners.
Public Comment
A public comment requested clarification regarding water connections for short term rentals and a discussion took place.
Motion to adjourn
Pat made a motion to adjourn the meeting until the next meeting. Doug seconded the motion.
Meeting was adjourned at 8:06 PM
