Description/Agenda
MARRIOTT-SLATERVILLE CITY PLANNING COMMISSION 1570 West 400 North Tuesday, September 20, 2022 - 7:00 P.M. Commissioners Present: Les Syme, Chair Maurice Pitcher Kent Schofield Dale Neal Excused: Kent Meyerhoffer, Vice-chair Justin Tobias Mike Hunsaker Staff Present: Bill Morris, City Administrator Trent Meyerhoffer, Director Zack Loveland, Director Marilyn Draper, Secretary Visitors: James and Buzzy Ito, Jesse Shupe, Rustin Shupe, Natalie Shufelt, Gerald and Orma Bischoff, Carl and Trudy Slater, Eric and Vicki Clark, Gary Ellis, Andrew Berga, Kirt and Kelly Lufou, Janet Shufelt, Susan and Tori Frandsen, Danny Brown, Ray Ellis, Dan and Hammer, Jasmine Hadley, Udell Funk, Dixon Ellis. 1. Call to Order/Pledge of Allegiance. Chair Syme called the meeting to order at 7:00 PM, and the Pledge of Allegiance was recited. 2. Discussion/action on minutes. Motion by Mr. Pitcher, seconded by Mr. Schofield, to approve the minutes from August 16, 2022. All voted in favor, none opposed. 3. Pubic Hearing: Expansion of nonconforming use by Ray's Auto Body located at 684 South 1900 West. Chair Syme opened the Public Hearing by common consent. Staff reported that this property is zoned RE-20. Ray's Auto Body commenced operation prior to the establishment of zoning in Weber Count in the 1960s. As such it is a pre-existing non-conforming use. This type of use is treated differently. The use has not been abandoned and the auto body has been in continual operation since it was established. UDOT informed the City and applicant is aware that UDOT intends to widen 1900 West. Engineering of the project will be in 2023 and the widening will significantly impact the non-conforming business, taking much of the front yard and parking. It may possibly take the front of the building but we do not yet know the extent. The Planning Commission previously approved the combining of parcels at this location prior to expansion of the non-conforming use. The owner is now requesting a Site Plan approval for the expansion of the non-conforming use. Chair Syme instructed the audience that there will be a two (2) minute comment period for public comments for or against this issue. Public Comments: Gary Ellis, owner of the auto body shop explained his understanding of how UDOT will impact his property. Gerald Bischoff, resident, said the lateral irrigation ditch near his home was physically changed without anyone on that ditch being notified. He hopes he still has access to the headgate to access the water when it's his turn. Jim Ito, resident, asked how many square feet Ray is losing and gaining because of these changes. Janet Shufelt, resident, noted that the front of Ray's shop has five (5) parking spaces so she feels they are not losing a lot of parking. She said they have several cars parked in the front and back of the property which are right across the street from her house. She felt they already knew their parking limitations and wants to know why they have kept expanding the business which has resulted in more cars, more traffic and lights from the business that shine in their windows. She feels she has a right to her residential home and thinks the City should exert more control over what is built near it. She doesn't see the need for the expansion because it will affect her property. Danny Brown, resident, asked what the property is currently zoned where the proposed commercial building will be. It is currently zoned RE-20, not commercial. It concerns him that the City is allowing a commercial building to be built in a residential zone. He asked how big the space is between the addition and the house and Mr. Ellis said it is about 30 feet. Danny asked why all the parking can't be in the rear of the building so the neighbors do not have to see it. If this is approved he strongly feels that the City should make sure it is fenced to block the rear view because he can see all the wrecked vehicles parked there now. He feels that fencing may solve many of the issues. Natalie Shufelt, resident, who also lives right across from Ray's Auto Body said they have asked them to turn spotlights off at night, and they have had a problem with big trucks parking on their lawn. She feels the building is something they shouldn't have to look at every single day. Ruston Shupe, resident, said since he bought his house there has been a lot of development in the City. He thinks the road does need to be expanded but he also feels there is nothing residents can do about the expansion. Ray's business has been established for many years and if more vehicle storage benefits Ray he is okay with that. There was no further public comment. Chair Syme closed the Public Hearing by common consent and reopened the Public Meeting. 4. Discussion/action on Public Hearing. Staff responses to public comments: Response to Gerald Bischoff regarding the changes to the lateral irrigation ditch: the City does not know who 'they' are that changed the ditch. Gerald did not know either. Gary admitted he modified the ditch after contacting the company and being informed they are not responsible for this later ditch. Gary was informed that he will need to provide an easement for the ditch to accommodate the users. Chair Syme commented that he has the same situation and the shareholders on the ditch have to be guaranteed that they have access to the water in the ditch. Staff said the engineer will have to update the plans to accommodate the ditch. Response to Jim Ito: At this time neither the City or UDOT know how much the roads will be widened. Curb, gutter and sidewalk will have to be installed so there is no way of knowing how much of the property is being taken in comparison to the square footage being expanded. The project will be engineered by UDOT next year and we will know more after that is complete. Also, the City will widen 700 South and take additional area of the parking lot when that happens. Response to Janet Shufelt: The Planning Commission will require the dark sky lighting on the plans. Commissioners ask about the space between the addition and the house. This is currently 31 feet. The Fire Marshal requires a minimum of 20 feet. Mr. Morris suggested that the Planning Commission have the Fire Marshal review the Site Plan for compliance. Also, other measures to minimize the impact of expanding this non-conforming use should be reviewed by the Planning Commission. Residents are free to submit additional comment in writing as well. Mr. Meyerhoffer addressed the problem of people parking on Mrs. Shufelt's lawn. This area should have curb, gutter, and sidewalk installed now that the subdivision across the street is complete. If there are existing deferral agreements for property on the south side of 700 South the property owner would have to pay for it. The Planning Commission may want to consider adding curb, gutter, and sidewalk to complete 700 South. The Planning Commission requested staff to obtain a CDBG grant for curb, gutter, and sidewalk. Chair Syme told the audience that the Commission members try to address issues the best they can because they have to live here too and abide by the same standards. He thanked everyone for their input. Mr. Ellis addressed the audience noting his desires to comply. Motion by Chair Syme to table the Ray's Auto Body expansion until we resolve the following outstanding issues, seconded by Mr. Pitcher: 1. Compliance with staff and affected entity requirements. 2. Compliance with requirements of the City Engineer. 3. Development to conform to Municipal Code requirements and Public Works standards. 4. Update to Dark Sky Lighting requirements for lights and signs. 5. Update storm water regulations. 6. Update landscaping, screening, and dumpster. 7. Turn over secondary water shares and annexation in to the Pioneer Special District and connect to secondary water. 8. Pipe irrigation facilities and provide irrigation access agreement/easement from the irrigation company. 9. Comply with code for the expanded use and site. 10. Provide a parking plan. 11. Comply with Fire Marshal access requirements between the new building and existing home. 12. Eight (8) foot fencing required around the perimeter using a durable, wind resistant, aesthetic material. Vote called and passed unanimously to table this item. 5. Discussion/action on commercial Site Plan for Scooter's Coffee at 1085 West 12th Street. This property is zoned C-2P and the developer is proposing a Coffee Shop which is a permitted use in the C-2P Zone. Olivia Ursi, Pre-Development Manager for Scooter's Coffee, answered questions from Commission members including whether there would be indoor seating. It will be drive-through only. Motion by Mr. Pitcher to approve this Site Plan subject to the following conditions: 1. Compliance with affected entity, staff and agency requirements. 2. Compliance with requirements of the City Engineer. 3. Development conform to Municipal Code requirements and Public Works standards. 4. Comply with Dark Sky Lighting Ordinance and storm water regulations. Motion seconded by Mr. Neal. All in favor, none opposed. 6. Commission and staff follow-up. Chair Syme thanked the audience for their ideas and participation. Chair Syme has some issues with the construction site for the 12th Street Exchange. They are not complying with the SWPPP requirements and he asked Mr. Loveland to follow-up. Widening and reconstruction of 17th Street is scheduled to begin in 2024 at the Ogden City border all the way to 12th Street. The project will be completed with grant funds obtained by the City. Chair Syme invited residents to volunteer at the upcoming Trunk-or-Treat and other events. There are plans to install parking at the Slaterville Park and some of the old trees will have to be removed. Chair Syme reminded the public that the Planning Commission members do not engage in ex parte communication about development. However, City Council members are always available to discuss any concerns residents have. 7. Adjourn. Being no further business, Chair Syme adjourned the meeting at 8:38 PM.
