ITEMS OF BUSINESS:
Mike Hansen- Mike introduced himself and handed out the latest version of the Laketown Master Plan explaining that this document is a live document and therefore will have changes from the version Alice provided to the council and mayor in the last few days. Mike noted that the google document online will always be the most current version.
Mike began the discussion by referencing the land use map. He noted that this should be the corner stone of our plan. He would like us to ensure this is exactly what we want it to be.
Brandon wants to be sure the map colors are clear that represents where the light industrial zone is- where future storage sheds might be. Discussion continued with where the county line is represented on the map. Mike questioned if Laketown would like to enlarge this zone.
Duane asked about the trail map. Specifically, a trail that goes up to the water tank. Mike shared that google maps currently shows we have more public trails than we actually have.
Mike projected the trail map onto the TV so attendees could see better. Nellie pointed out a trail in last chance. She suggested that it should be taken out because it's on private property. Mike said the reason we want to get rid of it is because google will show as a public trail. We should keep it if we would like to apply for trail grants. The council decided to remove the trail that is currently shown that goes to the water tank. Mike noted that the county trail plan will still include this trail.
Elon checked to see if the 'old plan' includes this trail (trail that leads to the water tank). He reported that is does not.
The council noted that we want a bike trail included on the north side of the road. Mike drew it on map. Brandon asked about a trail along big creek. He noted that it should be part of the plan and shown in red. Mike asked about a board walk- the council confirmed that it is the same trail that runs along big creek.
The mayor asked about a trail that connects to the bike trail from the county. Mike asked about future trails in the foothills. Brandon asked if there is a trail on the east side of the arena. This road is for access to the water tanks only. Delora noted that it's usually locked but Dan Stringham may unlock it when he is working on the water tanks. From the tanks north is all on private property per Eldon. Mike suggested that we include this trail on our map in a broad sense so we can show it as a future trail at some point.
Storm Water: Mike noted that his team cannot obtain accurate information on our storm drain system. The council confirmed that Laketown does not have curb and gutter. Laketown's storm drain system currently is burrow pits per the mayor. No underground drainage pipes exist in Laketown.
Laketown has propane, no natural gas. Sewer system will remain as septic system for the foreseeable future. Brandon asked if this language may hamper Laketown in the future if we were required to install a sewer system. Mike said no.
Mike noted that our comments on goals and policy were great.
Delora referenced a statement regarding density and infrastructure. This statement is within the 'Implementation of Land Use Section.' Mike said that was written with larger towns in mind. This is not what Laketown wants. It should be pulled out.
Brandon suggested with regards to the 'commercial and business section on Main Street' -we don't have commercial on main street- it's the highway.
Mike referenced the 'accessory buildings-mother-in law buildings' section. Currently, Laketown does not allow mother-in-law apartments. Delora noted that she has marked several sections for her comments. Mike asked for her to send her comments with him. Delora further requested that language regarding 'recruitment' within the economic development section should be removed.
Mike asked if Laketown wants jobs within Laketown. The mayor responded that we do, however, our economic development will be driven by demand instead of recruiting for it. Eldon noted that finding housing is a problem for workers in Laketown. Mike noted that it will only get worse.
Steve Meyers (an attendee) asked about page 14 regarding town parcels. Where are the town streets/parcels on the map including the right of ways etc.? Mike said he can do some research on where city streets are and include them on the map. Parcel data may not line up. Eldon asked about a parcel going up mill canyon. The parcel was reviewed by the attendees and Duane noted that it is not currently a city street but may be in the future.
Eldon read aloud the vision statement in the old master plan (original plan, page 15), he likes this statement and would like it added into the current plan's vision statement.
Brandon thanked the planning and zoning committee for all their hard work on the new master plan.
Mike Hansen noted that the county adopted their plan today. Woodruff and Randolph are complete. Mike's contract with the county is up but Mike will continue to work with Laketown until we are complete. Brandon suggested a timeline as follows: P&Z finish by the end of Sept and council should adopt in Oct. meeting. Duane noted that he thinks they could be finished by the end of the month.
A public hearing is proposed on September 28, 2002 at 7:00pm. P&Z will post the notice. The public notice should be posted (per Utah Code) 10 working days prior to the meeting. Mike recommends the public hearing notice should be posted 2 weeks prior to the meeting. He further recommends if there are many comments at the public hearing then we should hold two public hearings.
Per Mike, the public hearing is to make recommendations to council. Mike Hansen will attend public hearing and walk the attendees through the plan and answer any questions. When the plan goes online, it will be easy to review. The plan will be posted on our website and community residence can enter comments right into the document.
Mike did a high-level demonstration of our code on CiviclinQ. *Action Item-Alice will provide the mayor, council and P&Z links to this site. The public will not have access to our old master plan but approved users (mayor, council, P&Z & Alice) will.
In summary, the public hearing will be held on 28 September and the regular P&Z meeting will follow.
A 5-minute break was held. The mayor noted that DotBar is working on providing Laketown with better internet access. They were not prepared for our needs at the rodeo. Alice noted that she performed a speed test for our upload capabilities within the city office and it's very slow.
Christopher Chestnut-UDOT via phone
Brandon Willis introduced Christopher Chestnut and thanked him for this time. Christopher's title is Regional Planner with UDOT. A few items Laketown wishes to discuss are: where our future roads connect with the highway and speed limits. These are two areas where Laketown and UDOT need to come together. In previous conversations per Brandon, Christopher suggested Laketown enter into a corridor agreement. The purpose of this phone conference is for Christopher to explain what that is and to help the council understand the next steps.
Christopher: UDOT has corridor agreements with communities all over the region. These agreements are a planning tool to layout expectations between cities and UDOT to plan for the future. UDOT's hope is that this agreement will last through all administrations-both at Laketown and UDOT. This agreement will enhance our transportation system to ensure it functions efficiently and safely. It will layout future intersections, pedestrian and/or bicycle facilities. It helps both parties plan for the future so we are not constantly changing.
Mayor asked Christopher if he has met him and Rob White before at a meeting about 6 months ago at a commissioner meeting. Mayor provided Rob with a recent plan that includes highway 30. He also gave a copy of our future road plan to Rob White. Does Christopher have a copy of this? Christopher noted he did have a copy of this document and it was helpful. Christopher commented however, that our Intersection spacing needs to be refined.
Christopher asked if we had a digital version. *Action Item-Brandon will take care of giving him this copy. This will be included in the agreement. Sunrise Engineering contact is Scott Archibald he should have a digital copy of this map. Christopher can reach out to him directly to obtain this map.
Brandon asked how we work together on key issues such as timelines. The town may have different expectations than UDOT how do we work together on these differences? Christopher has a template that we use that we can look at to review. He asked who our city attorney is. They should review the agreement.
Eldon asked if this is where we address our speed limit. Christopher said yes. He will send us a template. Angles will be on the plan. This should be a collaborative plan.
Christopher will email Alice the template.
The mayor asked for any other comments. Eldon commented that this process will help UDOT know where our access points are.
Dan Stringham arrived at 7:48pm
Heidi Hodges-Activity Committee: Heidi was not in attendance. Kris Hodges represented Heidi tonight.
Oct 22. A fall trunk and treat. Dinner @ 6:00pm first at the park.
Heidi would like to know the activity committee's revenue from the rodeo. Alice noted that all this information is contained in last month's meeting minutes and Heidi should review those minutes.
The activity committee would like to purchase Christmas lights. They are looking at several options. They would like to put a light show together with radio music. Harvey Brown in Woodruff did this last year. He would do this for Laketown with an initial fee (estimate $4,000). For future years, he would change the music for a nominal fee. Kris noted that if the activity committee can continue running the concession stand each year, they will not have a problem with this expenditure. Discussion took place regarding the success of this year's concession stand and that future years should be better once internet service is set up permanently at the rodeo arena.
Eldon requested Heidi to have keys for the concession stand and park. Kris asked if she herself should have a key to the park. Eldon suggested that Dallas may not have turned in his key to the park. Eldon and Kris again asked for Heidi to have keys to the park and the concession stand. Alice replied that she has already provided Heidi with keys to the concession stand. Alice gave them to Heidi last Sunday (September 4th). These are the only keys the city has to the concession stand. Therefore, Heidi needs to return those keys to Alice. Alice will then ensure Heidi has keys to the park and concession stand.
Mayor spoke with Wendy Lamborn and she said that the music idea could not be done this year because Jeremy had too many projects and would not have the time. Lights on the poles should be considered. Delora noted that she gave Heidi the information on what poles could be used. Heidi should contact Wendy. Mayor will check with Lance Bourne regarding the wiring. Kris wondered if solar is an option.
Delora noted that the flags placed on 200 East for Labor Day should be placed further off the road next year.
COUNCIL BUSINESS:
Planning & Zoning Commission Update: Update on the August 31, 2022 meeting and recommendations to the town council.
Brent Early applied for a building permit. He has met all the setback requirements. Alice noted that she did receive the money from Brent for his building permit fee. She sent him a receipt and did provide him with a copy of the form in the meeting post the town council signature.
ACTION: Mayor asked for a motion to approve the planning and zoning recommendation for Brent Early's home plans. Delora made the motion and Kris seconded. Motion passed unanimously.
*Action Item-Alice to send signed form to Lugene Argyle with Rich County Assessor (treasurer). Tyler Seaman is the new building inspector.
* Action Item-Alice to provide copies of this form to Duane and put the form on our website. Duane asked for several hard copies.
Division of Land: Land owners can divide once every 7 years. Duane does not know where this is stated. Brandon searched for this in our code on the CiviclinQ site. Duane asked that this be an agenda item in the future. Brandon reported that it did not come up on a search of our code.
Hodges were given a permit to install a flagpole. Placement of a flag pole will be on the P&Z agenda next month.
Cody Reed resigned from P&Z. Duane asked if anyone on the council would be interested. Commission will discuss next month.
Water Updates: Council Member Delora Wight
Gomez meter was checked however, the meter is always dirty and difficult to read. Wes and Kelly's meter is covered with asphalt. Delora asked if Shaketown has a leak because in last month's meeting their meter showed over 30 days of continuous use. Dan reported that they just turned off their ice cr me machine yesterday. That was the big user of water.
Water samples came back favorable. Dan asked if the individual that repaired the chlorinator sent an invoice. Alice reported she has not seen an invoice from him. He should be returning for another service appointment. Dan reported that we are using all the water in the spring.
Dan said there are two potential homes going in north of the school so when we need to dig water lines for them it may present a problem. Water hook-up across from the school will be hard because we don't want to ruin the pavement.
Nellie left at 8:19.
Roads & Streets Updates Brandon Willis:
Nothing to add. Eldon asked about Mike Mattson's puddle. Brandon reported that it is the city's right of way.
Park & Recreation Updates Kris Hodges
Kris spoke to Brian, and he asked about horses on the fence. Eldon said he looked at the fence and horses are still pushing against the fence. Kris asked for suggestions. *Action Item: Eldon told Kris to contact the owner of the property and tell him what the situation is. Chain link fence and animals don't work.
Mayor suggested that we address it in the spring and fall then if damaged talk to the landowner. Eldon encouraged Kris to contact the landowner, so he knows. Stephen Neff is the property owner.
ACTION: Eldon asked for a motion to contact the land owner. Delora seconded. Motion carried unanimously. Eldon suggested that a letter sent. *Action Item-Alice to send a letter to the owner. Look up on the water bill to see where it should go. Letter should come from Mayor. Kris will send verbiage to Alice.
Kris asked if the city could put permanent lights around the bowery. The cost is about $20.00 per foot. Herb Weston has been contacted. Eldon asked if lights could be donated. *Action Item: Kris will ask. Dennis noted that these lights will need internet. *Action Item: Kris to contact DotBar. Duane reported that in Salt Lake City there is a lot of vandalism regarding these lights. Mayor asked Kris to report back regarding DotBar providing the internet for these lights and to the town. Mayor said that these costs will be deducted from the activity committee.
Eldon asked for Courtney to be paid for his work on the ball field/league. Tyson Larsen has been paid in the past. Alice can look this amount up under his name.
Eldon reported that we have a new tractor and old tractor was sold.
Council Member Eldon Robinson Rodeo and Arena Update:
Eldon reported that the rodeo should be winterized as soon as possible. Action Item: Eldon to take care of this before October. Eldon will also do the fountain.

UPDATES FROM CLERK'S OFFICE
CiviclinQ-Alice did a high-level demonstration via the TV. Links will be provided to council and P&Z. Alice asked for the council's guidance on providing the table of contents to the public. The permissions can be changed anytime as we move forward.
Zions Bank-Alice discussed the poor customer service at the Garden City branch and the $10.00 fee they charge for cashing checks. Kris noted that they also charge for obtaining change. Also, we only earn .35% interest at Zion's Bank, and we earn 1.1% interest at Cache Valley Bank. After further discussion with the mayor and council it was determined that we should close the rodeo account at Zions Bank and open a third account (rodeo) with Cache Valley Bank. ACTION: Eldon made a motion that we close the rodeo account at Zions Bank, motion seconded by Delora. Motion carried unanimously. * Action Item-Alice to close Zions Bank and open rodeo account with Cache Valley Bank.
Bear Lake Logo-Alice provided choices of logos Laketown could use. There had been a contest several years ago-those choices were also provided. The mayor and council discussed the different options. Eldon asked why we need a logo and commented that we are spending way too much time on identifying a logo. He further commented that our website has a great picture of Laketown, but Alice noted it is not a logo. Alice pointed out that CiviclinQ requires one for our platform and most towns, cities, and municipalities have logos. A logo was finally chosen and is attached to these minutes. Alice will make the necessary changes to the logo. Brent Early offered to help with finalizing the Laketown logo. The year Laketown was established was discussed and determined to be 1868.
Audit-Audit was performed on Tuesday, August 30th by the Teuscher's. Audit results will be provided to the mayor and council at our December 7th council meeting. Alice noted that Pelorus will be involved in providing the audit report.
Banner Fees-Alice reported that the 3 businesses that were late in paying their banner fees have paid. Bear Lake Golf, Mike's Market/Ace and Threshold Homes.
Park Meter Repair-Alice has been in contact with Cameron Argyle and he will arrange to have a licensed and bonded electrician repair the meter on Friday September 19th, 2022. Eldon asked what meter it was in the park. Alice noted that the letter did not state which meter, however, once the electrician is retained, he will work with Rocky Mountain Power to repair the correct meter. Rocky Mountain Power must be involved because per the letter, they will turn off the power prior to the meter being repaired and then will inspect the meter after. Once Rocky Mountain Power inspects the repaired meter, the power will be reestablished. All council members were provided a copy of the Rocky Mountain Power letter dated August 15, 2022 via email. Address per the letter of the meter in violation is 50 S. Main.
Fee Schedule-Alice reported that going forward, she will present issues to the council for their consideration regarding questions that Laketown residences have brought to her attention. Most recently, a question arose regarding the sale of property and the name transfer to the new buyer. Alice asked the council who should pay the name change. The party selling the property or the party purchasing the property? Alice asked if the applicable ordinance should be on a future agenda because this issue is not currently covered in an ordinance.
Alice reported to the council that not all fees are on our fee schedule. Some fees are scattered within other ordinances. Delora suggested that all the fees should be in one place. Alice also asked if the council was familiar with the road cut fee. It's $500.00. Further discussion was held regarding consolidating all Laketown fees into one ordinance. The council agrees. *Action Item-Alice to work with Kendall on this. It will be a scope change to our current agreement with Rural communities. Water impact fee of $16,333.00 is not included in current fee schedule.
Days away from Office-Alice obtained permission from the mayor regarding up coming time away from the city office. These dates were shared with the council.
BUDGET REVIEW
Financial Reports were distributed, and the council members reviewed their specific areas of responsibilities. Aging report was also distributed to the council. Alice asked for the owner of the Laketown Lodge. They are consistently late. The mayor provided the necessary contact information to Alice. *Action Item-Alice to contact owner of Laketown Lodge.
Delora reported the bank statements had been reconciled/completed as well as the PTIF reports.
Brandon asked about a contract for snow removal, so we are ready for the upcoming winter. Mayor noted that we need to get a contract to Chuck Webb for snow removal for the upcoming year. Mayor asked Brandon to speak to Chuck Webb so we can prepare. Brandon asked if his fee includes fuel. It does not, so maybe he will be asking for more money this year.
Brent Early asked about his residence, if they are paying his bill on time. He is renting and does not receive the water bills.
Regarding the financial reports-The mayor questioned the amount paid for our insurance with Utah TRUST, it has greatly exceeded the budgeted amount. Alice checked on this in July when the invoice came. She spoke to our account manager and she explained that TRUST needed to synchronize all of their accounts so they were all on the same billing cycles. The amount billed in July was $7,364.97 which was much more than previous years. The amount noted above now covers us through July 2023.
Mayor asked if there were any other questions on the financial/aging reports. No other questions/concerns were voiced.
Internet service via DotBar was briefly discussed. Mayor suggested that Eldon might give them a call. *Action Item for Eldon-Call DotBar regarding city's internet service.
One resume has been received for the second water operator. Jeff Brimhall. Mayor asked if we want to leave the posting open for a longer period of time. Delora noted that we have left it open long enough. Kris suggested that if we were going to get a response, we would have by now. An hourly rate of $25.00/hour was discussed. Mayor will contact and interview him. Mayor asked if there were members of the council that wished to volunteer to interview Mr. Brimhall. Eldon suggested that we just move forward. He asked how Dan might feel about this candidate. Eldon noted that this person will not be an employee of the city and the mayor agreed that he will be an independent contractor, a 1099 individual. ACTION: Eldon made a motion to proceed with Jeff Brimhall. This motion was not seconded nor passed however; the mayor will be contacting Mr. Brimhall regarding the job opening. Alice will generate an independent contractor agreement for the mayor to review. Dan should sign one as well.
Delora asked if the city can condemn the restaurant across from Dees Service. Mayor to speak to our attorneys. Kris noted that they will not sell the property.
