Description/Agenda
Torrey Utah PO Box 750027 Torrey, UT 84775 torreyutah.gov Minutes August 25, 2022 Special Work Meeting APPROVED Welcome Mayor Mickey Wright Review and discuss updates to town water ordinances Present: Mayor Wright, Pearl Thorndal-Stewart, Pat Kearney, Doug Robinson, Jordan Pace, Karen Mayne 8-1-4: CONNECTION REQUIRED: A water connection shall be required for each individual unit including separate residence and accessory dwelling or accessory building. MW1: This needs to be changed to state accessory building does not require a separate water meter. This conflicts with 8-1-16(A) and 8-1-16(D) that allow single connection with special permission. Discussion: Discussion regarding Torrey Town having limited support for agriculture and animals. Do we put meters out for stock watering. The current water ordinance doesn't address stock watering. Must be limited to small animal numbers within the water district. Limit of two animals per half acre. The general plan states that Torrey Town supports Agriculture. Keep the issue in 8-4-1 that address the issue. If you have two head per acre you meet those criteria. Torrey Town should codify the language supporting water meter access for animal use. 8-1-5 APPLICATIONS FOR CONNECTIONS SERVICE. A. Connection application: Any person, other that a developer (seeking multiple applications .. MW2: Only a single application and accounting of the number of ERUs is required. Discussion: State code does not directly address ERU's however state code uses the language 'water rights' and suggesting the town must use it or lose it. Pat asked the question about keeping a water reserve for the future. It appears you can't limit the water access if you have it. Discussion continued regarding the requirement to have a ten-year plan conflicting with State requirement of unlimited water access for the present. Torrey is unique. Torrey Water District supplies water outside of city limits. The water district is larger than the town of Torrey. The Council would like to keep the water moratorium in place until the Council has a better understanding of state water requirements. Mayor will have a conversation with Phil Lyman and Mr. Owens to get the legislature to understand the town point of view. Mayor Wright will volunteer to attend with League of cities to be involved in the legislative process. D. Nonresident Application: An application for a connection outside the city limits MW3: Delete this section, an application is required to get a connection. 8-1-6 RATES AND FEES: DELINQUENCY; DISCONTINUANCE OF SERVICE: A. Rates set by Town Council .. Rates for services furnished shall be uniform with respect to each class or classes of service established or that may hereafter be established. Rates may be established at different levels for premises outside the corporate boundaries of the town MW4: Need to research state code to see if different rates are allowed for inside and outside of town limits. Discussion: Discussed resident vs nonresident rates. It is required to justify the additional rates in place to charge more for nonresidents. C. Delinquency: Discontinuance of Service: Speaks to mailed or delivered statements MW5: Need to implement electronic statement. Discussion: Council members in agreement with implementation of electronic statements. Pat found contradictory statements in the section. Pat made notes that she will share with Mayor Wright. 8-1-8 LOCATION OF PRIVATE LINES: Unless prior approval is obtained from the town, all lines from the mail line to the property serviced shall be contained on the property serviced MW6: Need to require landlocked applicants to provide easements to their land. Torrey will install only after easements are in place. (MW7 ; 8-1-8 says this) Discussion: In the event of the property being split, a determination of water meter placement needs to be made. A property cannot be landlocked without a written easement for water lines. Question: Can Torrey Town require this? Questions about the access of water through landlocked property. Should the issue rest with the property owner or should the Town prevent the situation. Question in the event of the property being landlocked can Torrey prevent the property from being sold. Can Torrey require the written easement? Question how to address the issue so it isn't a problem in the future. Ex; Torrey allowed the property to be sold and now won't let them access water. Torrey needs a legal opinion on the issue 8-1-15 EXTENSION OF SYSTEM BY DEVELOPERS: C. Compliance with standards .may require certificates from a qualified engineer .. MW8: This should be required not optional. . Engineers are the ones who determine the number of ERUs needed for the anticipated occupancy. 8-1-16 PROHIBITED ACTS AND ACTIVITIES: A. Water to secondary buildings, locations: require written approval . MW9: This needs to be consistent with 8-1-4 D. Separate Connections Required connection to multi family dwellings, duplexes, triplexes, fourplexes . Discussion regarding water meter connections for Multi Dwelling. Question: What if the individual units are sold. Who is responsible for water bill. To address multi-unit buildings the Council needs to know if these buildings considered commercial or residential properties. Consensus is properties are considered multi-use and can be in any zone. Engineers are the ones who determine the number of ERUs needed for the occupancy. ERUs are currently being used as a measure by the State. We must base everything on ERUs. Although the State is redefining the ERUs . MW10: This needs to be consistent with 8-1-4 and needs to account for multi-family dwellings. I. Well Drilling: It shall be unlawful for any person to drill a well within the town limits. MW11: This should be the entire water district and researched to ensure that it is allowed under state law. Discussion: Current Torrey Town ordinance states you can't drill a well in the city limits. Should we change the wording to state; inside the water district? Currently we have a resident within the water district which has been granted a well permit by the State. Discussion: Should well water production, within the water district, be contributed to Torrey water system. It has been observed in other cities that the water table falls when individual wells are being built. Do we want to encourage new residents to bring water to the table. Should Torrey begin looking for new wells for the water district for future water needs? Public Comment None Motion to adjourn Pearl made a motion to adjourn the meeting. The motion was seconded by Pat and was passed unanimously. Meeting adjourned at 6:59 PM
