Motion to approve with a correction in the discussion on fences, 'the fence would only have to be four feet for the minimum distance', by Jason Munk.

2. Business License Application from Ryle McKendrick at 6140 N 2400 W for a pressure washing business. This would be a mobile business. No business conducted at the home. He will have a sign for advertising. Sign shall not exceed 18' X 24', (3.24.10.1f)

Discussion with Lance Gates about the Houghton-Petersen Conditional Use situation. The town has been contacted by a different attorney representing Alex Houghton. There is some concern that some type of litigation may be forthcoming. Lance was assured by Mayor Wood that any legal action would be against the town, and not against the Planning and Zoning Committee.
Discussion with committee member Judy Downs about an amendment that she is working on that would affect front yard fencing. Current code allows for side yard fences to be six (6) feet in height. Six foot high fences near the road could be a safety issue by blocking the view of individuals backing or driving out of driveways. Judy has been working on this for several months trying to get the wording right. Part of the problem stems from the fact that in several areas of town some individuals front property line extends to the middle of the public road. In using 'front property line' to delineate where a fence can be constructed, this could present a problem. Judy came up with a couple of documents to clarify the placement of fences. The one the board felt most effectively addressed the problem reads as follows:
'No fencing shall be constructed within 38 feet of the center of the road. Fencing more than 38 feet from the center of the road on front yards shall not exceed 4 feet in height and shall not be constructed of material that would obscure the view onto the roadway.'
This amendment would need to be reviewed by the Town Attorney, and a Public Hearing held before sending it on to the Town Board for approval.
Motion was made by Jason Munk to send the above proposal to Seth Tait, the Town Attorney for review and comment.
