Case No. 2022-ZCA-036 BACKGROUND and RECOMMENDATION: The Desert Color development was approved in 2018 and Phase five of the Desert Color Resort being approved in April of 2021. Construction of phase 5 is well underway with many of the buildings under construction. In reviewing their product type, the applicant who is currently building in this phase would like to introduce a new product into phase five but only with one building. At their meeting held on August 9, 2022, the Planning Commission held a public hearing and recommended approval. 4. Case No. 2022-ZCA-030 BACKGROUND and RECOMMENDATION: The proposal is for a new 8,184 square foot commercial multi-use building consisting of retail, restaurant, and professional office. The underlying general plan is Commercial (COM) & Flood Plain (FP). At their meeting held on July 26, 2022, the Planning Commission recommended approval of the application. 5. Consider approval of an ordinance to amend the use of a portion of Planning Area 3.1 of the Atkinville Interchange Area Planned Development Commercial (PD-C) Zone from Mixed Use to Community Commercial on 7.43 acres located on Pioneer Road, south of the extension of Havasu Drive and east of Arrowhead Canyon Drive for a project to be known at The View at Sun River. Case No. 2022-ZCA-031 BACKGROUND and RECOMMENDATION: This request is for a zone change amendment to the Atkinville Interchange Area Master Plan to change the use on 7.43 acres from Mixed Use to Community Commercial located on Pioneer Road, south of the extension of Havasu Drive and east of Arrowhead Canyon Drive. This location falls in Area 3-1 of the Atkinville Interchange Area Master Plan. However, this has not always been a part of the Atkinville Plan; 9.78 acres were once a part of the Sun River Master Plan but was ultimately transferred to the Atkinville Interchange Area Master Plan on September 22, 2016. At their meeting held on July 12, 2022, the Planning Commission held a public hearing and recommended approval. 6. Consider approval of an ordinance changing the zone from Central Business District (C-4) to Planned Development Mixed Use (PD-MU) on approximately 1.3 acres to allow for a new mixed-use building for a project to be known as 300 West Mixed Use. Case No. 2022-ZC-027 BACKGROUND and RECOMMENDATION: The southwest corner of St. George Boulevard and 300 West currently has a used car lot, the Sun City Glass building, and an older mechanic shop that is being used as a part-time hobby shop. Behind the mechanic shop there is an unfinished dirt area that houses a few vehicles. The applicant is proposing to remove the car lot and mechanic shop buildings that wrap around the Sun City Glass building for the purpose of adding in a new mixed-use building that will house commercial on the main floor. At their meeting held on June 28, 2022, the Planning Commission held a public hearing and recommended approval. Since the August 4th City Council meeting, the applicant has updated their plans. The height has been reduced to 55'. In addition, the building has gone from five (5) stories to four (4) stories. The unit count has gone from 52 units to 39 units which reduces the density from 40 dwelling units per acre to 30 dwelling units per acre. The commercial space has remained 8,000 square feet on the first level. 7. Consider approval of an ordinance changing the zone from Agriculture, minimum lot size 1 acre (A-1) to Single Family Residential 8,000 sq ft minimum lot size (R-1-8) on approximately 15.05 acres located at approximately 2890 South and 3430 East to be known as Red Pine 3 & 4. Case No. 2022-ZC-034 BACKGROUND and RECOMMENDATION: The Red Pine development consists of single family lots with a minimum of 8,000 sq ft lot size. This is the next phases 3 and 4. At their meeting held on August 9, 2022, the Planning Commission held a public hearing recommended approval. 8. Consider approval of an ordinance changing the zone from Agriculture 20, minimum lot size 20 acres (A-20) to Residential Estates, minimum lot size 20,000 sf (RE-20) on approximately 0.646 acres located at approximately at 2890 South 3430 East to be known as Webb Acres. Case No. 2022-ZC-032 BACKGROUND and RECOMMENDATION: Webb Acres is a single-family development. The purpose of this proposed zoning is to match the existing Webb Acres Ph. 2 & 3 subdivision. This piece of land is for a designated through street (3430 E) to connect north and south as per the City's roadway master plan. At their meeting held on August 9, 2022, the Planning Commission recommended approval. 9. Consider approval of an ordinance changing the general plan from Low Density Residential (LDR) to Open Space (OS), Medium Density Residential (MDR) and High Density Residential (HDR) on approximately 14.44 acres located at 1295 North Bluff Street known as Dodge Springs. Case No. 2022-GPA-004 BACKGROUND and RECOMMENDATION: This item was tabled at the June 2, 2022 City Council meeting to allow discussion on the access to the property. The developer for Dodge Springs has met with UDOT and discussed access of their property to Bluff Street. After discussions with UDOT, two options were presented and the developer chose option 2, which allowed for a 'right-out' only on to Bluff Street from the property. Therefore, there will be two vehicle access points to/from the property; a full access at 1250 North and a 'right-out' only at Bluff Street. The original application for this general plan amendment was for Low Density Residential (LDR) to High Density Residential (HDR). At their meeting held on May 10, 2022, the Planning Commission held a public hearing and recommended approval with conditions. The applicant has updated the plan to reflect the recommendations of the Planning Commission and staff. The updates include 4.0 acres of open space along the hillside and 0.95 acres along 1250 North is proposed to be Medium Density Residential (MDR) and the remaining property of 9.0 acres as High Density Residential (HDR). 10. Consider approval of an ordinance changing the general plan future land-use map from Commercial (COM) to High Density Residential (HDR) on approximately 5.72 acres located on the west side of Dixie Drive just south of Gap Canyon Parkway for a project to be known as Dixie Apartments. No. 2022-GPA-005 BACKGROUND and RECOMMENDATION: This proposal is to change the land-use designation on approximately 5.72 acres of undeveloped land from Commercial (COM) potential to High Density Residential (HDR) potential. On April 26, 2022, this item was presented to the Planning Commission. At that time, the request was to change 7 acres to HDR and leave the remaining 3.12 acres as commercial. There were no public comments made during the public hearing process; however, there were two public comments that were sent to staff via email, those comments are shown in Exhibit B. During deliberation, the Planning Commissioners expressed concerns with the reduction of the commercial potential and traffic that comes from high density residential. The Planning Commissioners ultimately voted for a continuance. On the May 10, 2022, the applicant returned with a modified request. The size of the HDR land was reduced from 7 acres to 5.72 acres. This in turn increased the COM area from 3.12 acres to 4.4 acres. At their meeting held on May 10, 2022, the Planning Commission recommended approval. 11. Consider approval of a conditional use permit to redevelop the existing Kmart shopping area by updating the building elevations, landscaping, and parking areas, as well as adding new pad sites to be known as Saint George Place. This project is located at 860 South Bluff Street and will be known as Saint George Place. Case No. 2022-CUP-005 BACKGROUND and RECOMMENDATION: In 2021, a conditional use permit (2021-CUP-006) was approved to redevelop the existing Kmart shopping area; however, the changes were not made, and the previous conditional use permit (CUP) expired on April 29, 2022. The applicants are still planning to redevelop the property and are here to reactivate their conditional use permit. At their meeting held on July 26, 2022, the Planning Commission Meeting recommended approval. 12. Appointments to Boards and Commissions of the City. 13. Reports from Mayor, Councilmembers, and City Manager. 14. Request a closed session to discuss litigation, property acquisition or sale or the character and professional competence or physical or mental health of an individual. ________________________________ ______________________________ Christina Fernandez, City Recorder Date REASONABLE ACCOMMODATION: The City of St. George will make efforts to provide reasonable accommodations to disabled members of the public in accessing City programs.
