PUBLIC HEARINGS:
1. TRUTH IN TAXATION HEARING TO RECEIVE PUBLIC COMMENT ON CERTIFIED TAX RATE AND THE FISCAL YEAR 2023 BUDGET
BACKGROUND: The Clearfield City Council adopted a tentative budget for fiscal year 2023 on May 10, 2022 and set a public hearing on the certified tax rate and proposed budget for August 9, 2022. The Council is now proposing to adopt the fiscal year 2023 budget, which includes a tax rate of 0.001307. This would decrease the tax rate from last year but would be higher than the certified tax rate of 0.001172 proposed by Davis County, consequently requiring a 'truth in taxation' hearing.
RECOMMENDATION: Receive public comment.
2. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON THE PROPOSED FISCALYEAR 2023 INTERFUND TRANSFERS
BACKGROUND: Staff is requesting the transfer of monies from several Enterprise Funds into the City's General Fund for the cost of providing services necessary for each individual fund to operate, and the transfer of resources from the Water Fund to the City's General Fund. Pursuant to Utah Code Ann. § 10-5-107 and § 10-6-135, the City is holding a public hearing to receive public comment on the transfers.
RECOMMENDATION: Receive public comment.
3. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON A REQUEST BY CLEARFIELD CITY TO AMEND CLEARFIELD CITY CODE AS IT APPLIES TO THE REGULATION OF MONUMENT SIGNS IN THE P-F (PUBLIC FACILITIES) AND FORM BASED CODE CV (CIVIC) ZONES
BACKGROUND: Clearfield City is considering changes to the regulations for monument signs in the P-F (Public facilities) zone and the Form Based Code CV (Civic Zone). The purpose of these changes is to address regulations to permit larger signs that will allow the City to publicize events and other happenings in various locations. Additionally, staff is addressing regulations for monument signs to better accommodate the needs along the corridor. The proposed modifications to monument signs are focused on needs for civic properties in the CV zone but will also benefit all businesses and properties within the Downtown Form Based Code area.
RECOMMENDATION: Receive public comment.
4. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON A ZONING MAP AMENDMENT REQUEST BY CLEARFIELD CITY TO REZONE THE PROPERTIES DESIGNATED AS PARKS WITHIN THE CITY FROM THE CURRENT ZONING DESIGNATOIN TO P-F (PUBLIC FACILITES)
BACKGROUND: The subject properties encompass the entirety of the Clearfield City Park System. With their current zoning designations which vary from park to park it is important for the City to maintain these areas as parks and retain the regulatory ability for what can and cannot be developed within these park spaces. By rezoning the parcels to P-F, the City is better able to maintain and regulate uses that are akin to municipal uses and services. Additionally, Clearfield City sees the rezone as a vital component for the future growth and long-term establishment of community parks.
RECOMMENDATION: Receive public comment.
5. PUBLIC HEARING TO REVIEW AND RECEIVE PUBLIC COMMENT ON THE PROPOSED LAKESIDE APARTMENTS DEVELOPMENT AGREEMENT FOR THE MIXED-USE PROJECT LOCATED AT 325,373,375,377,381,385, AND 389 SOUTH STATE STREET.
BACKGROUND: The applicant is seeking approval of a development agreement for modifications from the Form Based Code. The City Council began review of the Planning Commission recommendation and aspects of the development agreement in a work session on July 26th, 2022. Administrative, Legal, and Community Development Staff are working to provide edits to the developer prior to the August 9th, 2022, public hearing. That, however, will not provide enough time to submit the final development agreement and exhibits in time to be considered at the public hearing on that date. This necessitates tabling the public hearing to a future City Council meeting to provide city staff and the developer sufficient time to complete the development agreement and exhibits.
RECOMMENDATION: Table the public hearing to a specific date no sooner than September 13, 2022.

1. CONSIDER APPROVAL OF THE MINUTES FROM THE JULY 26, 2022 POLICY SESSION
SCHEDULED ITEM:
2. CONSIDER APPROVAL OF THE EXCHANGE OF REMNANT CDRA PROPERTY LOCATED AT 497 SOUTH MAIN STREET TO MORGAN PAVEMENT
BACKGROUND: The CDRA owns a parcel of real property that is 0.04 acres (1742.4 Square Feet) immediately south of the Maintenance and Operations Center (MOC) (Tax ID Number: 12-902-0002). Despite not being a part of the property utilized by the MOC, this parcel of land shares the same address as the MOC, 497 South Main Street. This parcel is located immediately adjacent to the northwest boundary of Morgan Pavement and has been maintained (weeding, spraying, etc.) by Morgan Pavement since they located in Clearfield, approximately 22 years ago.
Morgan Pavement recently purchased a single-family dwelling located west of the parcel in question and would like to use the new property, along with the parcel in question to upgrade their facilities by building a new shop at this location.
