NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on the 9th day of August 2022, at the hour of 6:00 p.m. of said day in the Council Chambers of Heber City, 75 North Main Street Heber City, Utah the Planning Commission will hold and conduct a Public Hearing to consider:
The Public Hearing will consider amendments to the Commercial Zones C-2, C-3, and C-4, proposed to be consolidated into Chapter 18.28, in Title 18.
Due to the similarities between these zones they have been combined into one chapter. The actual zones remain, C-2, C-3, and C-4, but are consolidated under one chapter heading. The main changes are as follows:
- The purposes have remained the same except for the C-4 which was suggested in the Envision Heber 2050 General Plan that the area along Midway Lane and 600 West become more recreation and tourism oriented.
- Site plans are required as part of an application for a permitted or a conditional use permit
- Consultant suggests dropping agricultural uses
- Consultant suggests allowing mixed uses within a building
- As an alternate only allowing pawn shops, tattoo, massage, second hand stores, and cash stores in the C-2 zone and not within 500' of each other
- Prevent telecommunication towers unless they are stealth and only allow them in the C-2 and C-4 zones
- Defines a new use called 'Commercial Complex' as a conditional use
- Only allow manufacturing/welding in an enclosed building in the C-4 zone
- Consider elimination of public storage facilities - only enclosed temperature controlled storage in the C-2 and C-4 zones
- 1 acre or larger and/or 60,000 square foot or larger developments become conditional uses
- Clarified certain landscaping requirements
- Added gasoline pump requirements
- Building height is also addressed
If the Public is unable to attend, the Public Hearing comments can be emailed to PCPublic@heberut.gov or submitted through heberut.gov; by selecting Agendas and Minutes to access a link to submit public comments. All comments will be read aloud during the open comment portion of the Public Hearing and will be included as part of the permanent public records for this meeting.
