Morgan County Purchasing Request for information Broadband Service Solicitation#__________ Morgan County, Utah ('Morgan') is requesting qualified responses for a reliable, high-speed Internet connectivity solution ('Broadband Service') for all County residents. The County is releasing this solicitation to better understand the different conceptual approaches to solving the County's inadequate Broadband Service and their resultant costs and obligations. The goal of this project is to provide 21st century communications services to residents, businesses, and visitors. Broadband can enable communities to participate on a more equal footing in the emerging global economy. The Internet can enable many types of businesses to locate anywhere-as long as there is enough bandwidth at an affordable price. High-tech firms and other companies that rely on high connection speeds will go where they can flourish. Similarly, professionals in a variety of fields are increasingly able to settle wherever access to broadband enables them to stay connected to their work. Broadband-enabled communities generally, have higher property values, improved job creation and retention, and better quality of life. Responses to this RFI should state how the respondent's approach will further the County's goals of attracting and retaining businesses and residents, enticing visitors, and encouraging economic development. The County's broadband service will be shaped by the community's values and a desire to maintain a competitive edge, even as more communities throughout the U.S. deploy broadband. To reach these goals, we are seeking to work with partner(s) to deliver: - Ubiquitous access to Gigabit-class broadband infrastructure: The respondent (individual or entity) will provide the infrastructure to a designated geographical area. The respondent may propose an area or use area suggested. This area will provide the needed backbone to allow last miles projects to enable Morgan County homes, business, visitor, and public or private institution the opportunity to access affordable high-speed broadband connections to the Internet and other networks; - Open access: The individual or entity will demonstrate, support, and build a nondiscriminatory, open-access infrastructure that should, to the maximum extent possible, be open to all users, service providers, content providers, and application providers, and be usable via all standard commercial devices; - Unfettered access: The Fiber to the Premises (FTTP) network will deliver an unfettered data offering that does not impose caps or usage limits on one use of data over another (i.e., does not limit streaming). All application providers (data, voice, video, cloud services) are equally able to provide their services, and the consumer's access to advanced data opens up the marketplace; - A competitive local broadband marketplace: The individual or entity will facilitate a local broadband marketplace that is as competitive as reasonably possible. We envision significant progress toward an operational backbone network in one year, with commitments and a shared common vision to make Gigabit-class bandwidth available to all residents, workers, and visitors within the backbone geography, Morgan County. Respondents may include competitive language for first right of build out and service provisions. Included with your company's response should be a description of the technical model and approach your firm is proposing, the underlying assumptions of this approach (including the responsibilities and obligations of the County, the costs to the County for this solution and the timeline to completion. Once your proposed solution has been implemented, describe the pricing plan or plans available to the County's residents including download and upload speeds. Your company's response should be detailed enough to provide the County with a thorough understanding of the steps required to complete your work and should be broken down into major phases following the outline below. Responses should detail procedures for additional providers to access the infrastructure to include any requirements for first right of service or charges to access, if any. See attached suggested geographical area of network build out. Respondents may propose additional areas or reduced areas in their response. - Project Major Phase - Phase Name - Phase Description (i.e. What will happen during this phase of the project?) - Phase Timeline/Duration (i.e. when could this phase begin and how long is it anticipated to last?) The total duration for deployment must not exceed one year from the date of the execution of an agreement with the County. - Phase Cost to County - Rough order of Magnitude Estimate (+-25o/o) - Phase Payment Model (i.e. Bond Direct Payment Installment Payment etc.) - Phase Assumptions (i.e. What assumptions are you making; including County participation, access, easements, assets, infrastructure, etc.?) - Phase Dependencies (i.e. What must happen before this phase can begin?) - When the Project is complete, what will be the ISP Plan offerings? - Plan Offering(s) to Consumer o Speed Up (Mbps or Gbps) o Speed Down (Mbps or Gbps) o Cost to Consumer (breakdown if cost includes more than ISP cost) o Installation Costs to Consumer o Equipment Costs to Consumer While Broadband Service is the County's primary objective, please feel free to detail any additional optional bundles of services, if any, including streaming entertainment and/or network television, landline telephone or other services that your company may provide to County residents. Protected Information The Government Records Access and Management Act (GRAMA), Utah Code Ann., Subsection 63G-2-305, provides in part that: The following records are protected if properly classified by a government entity: 1) trade secrets as defined in Section 13-24-2 if the person submitting the trade secret has provided the governmental entity with the information specified in Section 63G-2-309 (Business Confidentiality Claims); 2) commercial information or non-individual financial information obtained from a person if: a) disclosure of the information could reasonably be expected to result in unfair competitive injury to the person submitting the information or would impair the ability of the governmental entity to obtain necessary information in the future; b) the person submitting the information has a greater interest in prohibiting access than the public in obtaining access; and c) the person submitting the information has provided the governmental entity with the information specified in Section 63G-2-309; 6) records the disclosure of which would impair governmental procurement proceedings or give an unfair advantage to any person proposing to enter into a contract or agreement with a governmental entity, except that this Subsection (6) does not restrict the right of a person to see bids submitted to or by a governmental entity after bidding has closed; .... GRAMA provides that trade secrets, commercial information or non-individual financial information may be protected by submitting a Claim of Business Confidentiality. To protect information under a Claim of Business Confidentiality, the offeror must: 1) provide a written Claim of Business Confidentiality at the time the information (proposal) is provided to the county, and 2) include a concise statement of reasons supporting the claim of business confidentiality (Subsection 63G-2-309(1)). 3) submit an electronic 'redacted' (excluding protected information) copy of your proposal response. Copy must clearly be marked 'Redacted Version.' A Claim of Business Confidentiality may be appropriate for information such as client lists and non-public financial statements. Pricing and service elements may not be protected. An entire proposal cannot be identified as 'PROTECTED', 'CONFIDENTIAL' or 'PROPRIETARY' and may be considered non-responsive if marked as such. To ensure the information is protected, the Division of Purchasing asks the offeror to clearly identify in the Executive Summary and in the body of the proposal any specific information for which an offeror claims business confidentiality protection as 'PROTECTED'. All materials submitted become the property of the Morgan County. Materials may be evaluated by anyone designated by the County as part of the proposal evaluation committee.
