HARRISVILLE JUSTICE COURT PUBLIC DEFENDER SERVICES REQUEST FOR PROPOSALS (RFP) Harrisville City is requesting proposals from a qualified attorney or firm for Public Defender Services (PDS). The qualified attorney or firm would provide the following services: - For an individual appearing in Court involving the City in accordance with the 'Indigent Defense Act' set forth in Utah Code 78B-22-101, et seq. - In other matters where a court has appointed a qualified individual to receive legal defense services related to the City. - In any case involving mental health, or related matter, where an individual identified by the City requires a right to counsel regardless of whether the case is heard before a Court. GENERAL INFORMATION Harrisville City currently contracts for PDS. Public Defenders are appointed to defend those individuals who are eligible to receive indigent defense services in the Harrisville Justice Court. Applicants must be available on the 2nd and 4th Wednesday of every month starting as early as 8:00 a.m. Applicants must be licensed and in good standing with the Utah State Bar. 1. Purpose - This RFP is to contract for the services outlined above. 2. Who May Respond - An attorney currently licensed and in good standing with the Utah State Bar who is authorized to practice law in the State of Utah. 3. Instruction on Proposal Submission. a. Closing Submission Date. Proposals must be submitted no later than Noon on June 10, 2022. b. Submission. Submission or inquiries related to this RFP should be mailed to: Jennie Knight, City Administrator 363 West Independence Blvd Harrisville, Utah 84404 Or emailed to: jknight@cityofharrisville.com 4. Scope of Services. Attorneys shall be readily available to perform the following legal services: a. Attend court up to bimonthly on the 2nd and 4th Wednesday of every month, or as otherwise instructed, starting as early as 8:00 a.m. or other times designated. b. Represent and defend individuals appointed or designated by Court and/or City. c. Case management and trial preparation as needed. 5. Billing Statements. Attorneys shall be prepared to submit monthly detailed billing statements. Include the case for PDS or summaries of work performed on other matters. a. Price per case for indigent PDS. b. Price per hour for mental health and other cases. 6. Attorney Qualifications. Attorney should have experience with Misdemeanor cases in the Utah Justice Court System. Descriptions should include: a. Professional and educational background. b. Prior experience with respect to the required experience listed above. c. Education, years and types of experience, and continuing professional education will be considered. d. Maintain professional liability insurance and provide proof to the City of the same with this RFP and as requested during the course of any contract. SUBMISSION REQUIREMENTS The following information is required in the RFP submittal: 1. Letter of Interest: The letter is not intended to be a summary of the proposal itself. The letter must contain the following statements and information: a. Name, address, website, and telephone number of the attorney or firm submitting the proposal. b. Statement of your understanding of the services to be performed and positive commitment to provide the services as specified. c. Statement indicating the proposal and cost schedule are valid and binding for ninety (90) days following this RFP and will become part of the contract that is negotiated with the City. 2. Service Description: a. Description of how you are positioned to provide the services in this RFP. b. A history of experience on providing similar services. 3. Reference Information. Name, title, address, and telephone number of three (3) references. Municipal clients are preferred. 4. Availability. Attorney must be available to attend Court. 5. Insurance. Documentation showing that you are maintaining a current professional liability policy, such as the policy cover page. 6. Proposal Summary (not to exceed two pages): a. Summary of your proposal and your qualifications. b. Statement on how you meet the qualifications and requirements of this RFP. c. Any other pertinent information that helps the City determine your overall qualifications. 7. Cost of Services. Fee schedule, per case, for PDS. Hourly rates for other services. EVALUATION CRITERIA AND PROCESS A selection committee will conduct an evaluation of qualifications and will rate each submittal based upon the following criteria: 1. Experience. 2. Attorney's ability to meet the City's needs. 4. Attorney's performance in possible interviews. 5. Successful completion of a professional and criminal background check/record check. 6. The proposed price and terms. DEADLINE FOR SUBMISSIONS OF PROPOSALS Two (2) sealed copies of the proposal in addition to one (1) electronic copy must be received by Harrisville City prior to Noon on June 10, 2022. All copies of the proposal must be under sealed cover and plainly marked as 'Public Defender Services Proposal'. The City reserves the right to reject any and all proposals for failure to meet the requirements contained herein, to waive any technicalities, and to select the proposal which, in the City's sole judgment, best meets the requirements of the project. 2. This RFP creates no obligation on the part of the City to award a contract or to compensate the proposer for any costs incurred during proposal presentation, response, submission, presentation, or oral interviews (if held). The City reserves the right to award a contract based upon proposals received without further discussion or negotiation. 3. The City further reserves the right to make such investigation as it deems necessary to determine the ability of proposers to furnish the required services. Proposers shall furnish all such information for this purpose as the City may request. 4. Harrisville City is an equal opportunity employer. Harrisville City is requesting sealed proposals from a qualified attorney or firm to provide public defender services on a contractual basis in the Harrisville Justice Court. Responses to this RFP shall be submitted to City Administrator, 363 West Independence Blvd, Harrisville, Utah, no later than Noon on June 10, 2022. LATE PROPOSALS WILL NOT BE ACCEPTED.
