Description/Agenda
Minutes of Planning and Zoning Work Meeting held April 12, 2022 The meeting was held at the Oak City Town Hall located at 30 West Center beginning at 7:00p.m. The following were in attendance: TOWN OFFICIALS OTHERS Chairperson Sharla Anderson Traci Callister Member Cameron Nielson Member Peggy Kooyman Member Ron Erickson Mayor Shim Callister Secretary Karen K. Lovell Member Colin Christensen was not in attendance. The following agenda items were discussed: A. Invocation. The invocation was given by Cameron. B. Adopt Agenda. Sharla moved, seconded by Cameron, to adopt the Agenda as written. Roll Call Vote: Chairperson Anderson-Aye. Peggy-Aye. Cameron-Aye. Ron-Aye/ C. Adopt Minutes of Planning and Zoning Commission Work Meeting held January 12, 2022. Sharla moved, seconded by Ron, to adopt the Minutes as written. Roll Call Vote: Chairperson Anderson-Aye. Cameron-Aye. Peggy-Aye. Ron-Aye. D. Discuss Kevin Styler Shed. The Mayor reported that Kevin is out of compliance on his shed. Kevin has changed things around in his shed in order to allow for a family to move in temporarily until they can find housing. Kevin does have a separate lot for the shed. Shim told Kevin to get with the building inspector which he did. The building inspector told Kevin to make some changes which he did. The shed will have to have its own water and power connections and septic tank and leach lines. Kevin is working toward splitting the property into two lots and he has enough property to do so and stick with setback requirements. The Mayor will give Kevin a conditional use permit for the shed. E. Discussion on Setting up any Type of Recourse for Those not Building According to Town Policy. Sharla wondered what other Town's do when someone just builds a shed or building without a building permit and/or following Code. Peggy said that most towns would make them tear it down. The Mayor mentioned that the new Code book is out and he will be looking through it. Sharla stated that the Planning and Zoning Commission talked about having someone monitor buildings as they progress but the Mayor thought the building inspector should be doing this. Sharla thought it would be wise to have a list which could be marked off before, and as, buildings are done so the process is followed. Ron felt like the building inspector doesn't really see what is being done until the end of the process. He wonders if the Town should have someone inspecting building regularly. He felt there needed to be rules with some teeth to make sure the Codes are followed and not have to work with people after they have already broke Code. The Mayor and the Commission had a discussion on sheds and buildings that don't follow Codes and how conditional use permits are given and why. The Mayor stated that when Dallin Christensen's new home is built, it will be one that will have to be looked at as far as how to put in water lines. The Mayor pointed out that the new Code can be looked at and changes made going forward that will help in the future. Ron would like to see all rules and Codes universal for all not from property to property. F. Water Lines for Private Lanes. Ron felt that every home should have its own water line and water connection. If the home owner wants a bigger line they should pay for it. Property owners need to put in water lines or pay for them from the point of the Town meter. If someone adds a house after the last home, they should have to pay for their water line from the last meter. New owners can build water lines bigger if desired to get better pressure but can't have multiple homes on the same water line. Had a discussion on roads and making sure property owners know at what point they will have to turn a private lane into a paved road and that they will need to pay for paving the road. G. Discuss Mobile Home, Boise Cascade Home, or Trailer Guidelines. Sharla felt these type of homes devalue properties and changed the look of the Town. Talked about the difference between mobile homes, modulars, and pre-fab homes. Mobile homes have to have a HUD sticker, therefore; those trying to put in shipping container houses can be stopped as they don't have a sticker. H. Discuss the Curtis Jones Property Setbacks on Lover's Lane. Sharla asked if the 15 ft. variance had been allowed for the Curtis Jones shed. The Mayor reported that the Board of Adjustments had recommended the variance not be allowed. However; Curtis might turn his house. If he does this could cause set back problems. Sharla felt that the people who move in on Lover's Lane need to either trade property or purchase property for future roads. The Mayor stated that he hasn't really had a discussion with Sam Nielson, currently the only home owner located on Lover's Lane, on future roads. I. Recap of What Was Learned at the State Meeting on Zoning. Sharla understood that future developers have to figure out how to put in roads and water lines. The Mayor's major idea from the training was that when a decision is made, you have to have a concrete reason why you made that decision. J. Conclusions on Lover's Lane Road. The main conclusion would be that future developers will need to put in roads and water lines and pay for them. K. Set up a Committee for Building Permits. The Mayor is going to set up a check list of items that need to be followed on building and conforming to building permits. If there were issues, parties could come before the Planning and Zoning Commission. The Commission was open to the idea of having monthly meetings, at least for awhile, in order to keep up with current issues. This would allow the Commission time to go over sections of the new Code each month also. The Mayor will work on getting a book for each Commission Member. L. Discuss Ideas for a New Planning and Zoning Commission Chair. The Commission felt to appoint Ron Erickson for the new Commission Chair. If Ron were to be chair, he would like to start working on the Town Code to add pertinent new rules and Codes. Ron will try the position for 6 months and go from there. M. Adjournment. Sharla moved, seconded by Ron, to adjourn. Roll Call Vote: Chairperson Anderson- Aye. Ron-Aye. Peggy-Aye. Cameron-Aye. The meeting adjourned at 8:36 p.m. Respectfully submitted ____________________________ Karen K.
