PANGUITCH CITY COUNCIL MINUTES APRIL 12, 2022 CITY COUNCIL - 6:30 P.M. 25 S 200 E PANGUITCH CITY OFFICE PANGUITCH, UT 84759 PANGUITCH, UTAH 84759 Those present at the City Council meeting were Mayor Kim Soper, City Manager Lori Talbot, City Attorney Barry Huntington, City Recorder Tyrissa Howell, Council Members Trudi Owens, Paul Dastrup, Mark Boshell and David Dodds. Council Member Mike Sarles was absent. Others present were Sheriff Danny Perkins, Kelly Holman, John Crandell, Pat Oetting, Dave Owens, Lorraine Owens, Shirley Chidester, Lola Henrie, Benjamin Rains, Mike Tebbs and Jonelle Molenda. The meeting was called to order at 6:30 pm. OPENING CEREMONY Mayor Kim Soper conducted the opening ceremony. ADOPTION OF THE AGENDA Mark Boshell moved, seconded by Trudi Owens to adopt the agenda. The motion passed with all in favor. APPROVAL OF THE MINUTES Trudi Owens moved, seconded by Paul Dastrup to approve the minutes. The motion passed with all in favor. KELLY HOLMAN - SOFTBALL/BASEBALL FIELD Kelly Holman informed the City Council that he, Denny Orton, Kambree Howell, Abigail Holman and Karma Albrecht met with the School Board to discuss the plans for the field next to the new elementary school. There are currently 50 youth playing softball and there is a need for an additional field. The school board had discussed building housing for teachers at the location. Denny Orton, a local realtor came up with the idea of putting housing on the land next to the high school as an option to leave this field open for a softball field. The school district has already budgeted for sod and sprinkler lines. Kelly Holman received a quote from Markey Englestead for chain link for a backstop and other fencing for $20,000. There would also be a cost for dug outs. The item was tabled until further information could be gathered. JOHN CRANDELL John Crandell had a sub-contractor Matthew Steinert on the phone who stated that after his crew had the dirt on the ground a lady came and told the crew to stop. She said everything needed to be behind the power poles. They used a skid steer to push the dirt back. She came back said it looked good as long as it stayed behind the poles. The crew added the rock and then went to St. George. Mayor Kim Soper and Council Member Paul Dastrup went to Mr. Crandell house and measured the berm in some areas it is higher than 3 feet. They discussed that it obstructs parking. City Manager Lori Talbot stated that she did agree that the dirt was behind the power poles. But now the rock is not behind the power poles. Mr. Crandell passed around pictures of other properties he feels have right of way obstructions. City Council Member David Dodds stated that Mr. Crandell had his property surveyed and asked him why he placed the landscaping on his property. Mr. Crandell stated the contractor Mr. Hansen talked to the Panguitch City before he started his own landscaping project. Mayor Soper stated that Mr. Hansen did not come into the City for approval before the landscaping began. City Attorney Barry Huntington stated Mr. Crandell's landscaping is on the Panguitch City's right of way and the council needs to decide what they want to do about it. He writes letters when he receives complaints. If Mr. Crandell would like his pictures of other properties to be complaints, he can send letters. Mark Boshell moved, seconded by Trudi Owens to enforce the landscaping to be behind the poles to a height no greater than three feet measured from the base. To be complied within 90 days. The motion passed with all in favor. OFFICER REPORT Sheriff Perkins stated the officers are busy and tourist season is here. HORSE SHOE PIT COVER - BENJAMIN RAINS Benjamin Rains discussed with the City Council the possibility of placing a fabric building over the horse shoe pits to create year-round use. He received a quote from ClearSpane of $400,090 and is waiting on other quotes. The City Council asked for Mr. Rains to look into more options and come back. OPEN MEETING TRAINING Barry Huntington did an open meeting training for the City Council and the Cemetery Board. FIRE STATION/ SOCIAL HALL CAMERA'S A bid for five cameras at the fire station was received for $6743. The county has agreed to pay half. There is also a need for camera's at the social hall. David Dodds moved, seconded by Paul Dastrup to purchase a home security system and self-install at the social hall. The motion pass with all in favor. Erma Galloway is no longer cleaning at the social hall. The Council discussed asking if the current contracted janitor that cleans the city office would be interested in adding the social hall to her contract. ELEMENTARY SCHOOL ZONE LIGHTS The original bid for flashing lights was bid with the wrong poles. When the bid was corrected it went up $7000. The council discussed if the new poles are the required poles. The school zone lights was tabled for further information. WHITTNI ORTON MONUMENT Kenny Orton has talked to Council Member David Dodds about doing a monument to recognize Whittni Orton's accomplishments. The council discussed possible options. SIGNAGE - BLUE PINE MOTEL Paul Dastrup moved, seconded by Trudi Owens to approve the sign for the Blue Pine Motel. The motion passed with all in favor. AIRPORT ROAD CRACK-SEAL Straight Stripe crack sealed the road at the airport for $1000. BUSINESS LICENSE- KING LEGACY RANCH LLC DBA MAINSTREET CAF Mark Boshell moved, seconded by Trudi Owens to approve the business license for King Legacy Ranch LLC. The motion passed with all in favor. BUSINESS LICENSE - AURORA COLOR LLC Paul Dastrup moved, seconded by David Dodds to approve the business licensed for Aurora Color LLC. The motion passed with all in favor. VACATION RENTAL - SILVERLAKE LLC @ 276 ASPEN VALLEY DRIVE Trudi Owens moved, seconded by Mark Boshell to approve the business license for Silverlake LLC at 276 Aspen Valley Drive. The motion passed with all in favor. EMPLOYEE MEDICAL BENEFITS Employee medical benefits costs increased by 5.8% and dental benefits decreased 1%. COLA INCREASE The Social Security Administration has projected the Cost-of-Living Increase to be 5.9% which will cost the City $26,000 in taxes and retirement. Gary Steineckart The City Council had previously given Mr. Steineckart 30 days to clean up his property. That has not been done. Barry Huntington will send another letter giving him 30 days at which time the Panguitch City will clean it up and bill him for the cost. DEPARTMENT REPORTS Zoning Letters- Barry Huntington has sent out two letters. One for people living in camp trailers and one for a Conex box siting in the City's right of way. Five Counties - CIB has placed the firetruck #1 on their list and the water line #6 for need in the Garfield County. Grant - Chad Booth's grant was turned down and he would like to reapply. BLM Landfill transfer - Council Member Mark Boshell has been waiting for the new well location before completing the BLM land transfer. Tax rate - A local business owner has concerns over the local sales tax rate. Panguitch City's sales tax is 8.10%, 4.85% goes to the state, .25% goes to Garfield County, 1% goes to Garfield Memorial Hospital, 1% goes to Panguitch City and 1% it a resort tax. Summer Help - The summer help positions are advertised in the newspaper. Triple C Position - The new Triple C assistant has torn his rotator cuff and hurt his shoulder so the position has been placed in the newspaper. Liquor Store - The liquor store might be moving into the old H&R building.
