MARRIOTT-SLATERVILLE CITY PLANNING COMMISSION 1570 West 400 North TUESDAY, FEBRUARY 15, 2022 - 7:00 P.M. Commissioners Present: Justin Tobias Dale Neal Maurice Pitcher Kent Schofield Mike Hunsaker Excused: Kent Meyerhoffer Commissioners Electronically: Les Syme, Chair Staff Present: Bill Morris, City Administrator Trent Meyerhoffer, Planning Marilyn Draper, Secretary Zack Loveland, Community Development VISITORS: Annya and Ryan Bowden, Kelly Nielson, Pam and Brad Slater, Lisa and Barry Panter, Dustin Barnes, Gary Ellis, Ray Ellis, and Shauna Meyerhoffer. 1. Call to Order/Pledge of Allegiance. Chair Syme called the meeting to order at 7:00 pm and the Pledge of Allegiance was recited. 2. Discussion/action on minutes. Motion by Mr. Neal, seconded by Mr. Pitcher to approve the minutes from November 16, 2021. All in favor, none opposed. 3. Election of 2022 Chair and Vice-chair. Motion by Mr. Pitcher, seconded by Mr. Neal, that we retain the Chairman and Vice-chairman as now constituted. All in favor, none opposed. 4. Oath of Office for Appointed Officials. Mr. Morris administered the Oath of Office to Mr. Schofield, Mr. Tobias, Mr. Syme, and Mr. Neal. 5. Public Hearing on amending the Zoning Map from A-1 to ITZ at 445 North 1500 West: Ironside Holdings. By common consent Chair Syme opened a Public Hearing. Staff explained that this property is currently zoned A-1 and the developer is applying for a zoning map amendment to the Institutional and Technology Zone (ITZ). The proposed zone conforms to the General Plan. Public Comments: No comments were offered. By consent Chair Syme closed the Public Hearing and re-opened the Public Meeting. 6. Discussion/action on Public Hearing. Motion by Mr. Schofield, seconded by Chair Syme, to recommend approval to the City Council of the Zoning Map Amendment from A-1 to ITZ at 445 North 1500 West by Ironside Holdings. All in favor, none opposed. 7. Discussion/action on Site Plan for Professional Offices at 445 North 1500 West: Ironside Holdings. This property is currently zoned A-1 and the developer is proposing a re-zone to an Institutional and Technology Zone (ITZ) to construct an engineering office. Commissioners discussed the approval requirements and would like to see the completed set of Site Plan drawings along with building elevations that meet the architecture code requirements. Motion by Mr. Schofield, seconded by Mr. Hunsaker, to table this item until the engineered Site Plan and elevation drawings are provided. Motion passed unanimously. 8. Discussion/action for amended Site Plan and expansion of non-conforming use at 1878 West 700 South by Gary Ellis. This property is zoned RE-20 and the owner is requesting a Site Plan Amendment and expansion of non-conforming use. The owner wishes to combine two (2) parcels into one. Once the parcels are combined the business may be considered to expand. It is noted that with growth in this area it may be better situated as commercial on this corner. It has been effectively operating as a commercial business since prior to the adoption of zoning by the county, as this site has been a generational family auto shop for three (3) generations. Motion by Mr. Pitcher that we approve this parcel consolidation and they can return later for expansion. Second by Mr. Schofield. All in favor, none opposed. 9. Discussion/action on amended Conditional Use Site Plan for Conrock at 1200 South 1900 West. Chair Syme expressed some concerns he has with the mud trackout system at the site. He does not think it is being used properly because he observed several trucks drive around the trackout as they exit rather than driving over it. The result is more dirt and dust on the highway. He feels the applicant needs to address this problem and come up with a solution. Another concern is that the height of their dirt pile exceeds the height that was originally stipulated and he would like that addressed also. Mr. Schofield asked Mr. Bowden if acquiring the other piece of property would help them be able to lower the height of the pile. Mr. Tobias said he saw a sweeper on the highway and it looked clean, but Chair Syme thinks the dirt should be maintained on site, not on 1900 West. Ryan Bowden, Conrock, addressed the Commission. He hires Sweeping Utah to sweep for Conrock daily and they purchased a new sweeper with a water system. Conrock has noticed that the trucks have been going around the Trackout so they have parked some equipment there to block it until they can address it. Mr. Bowden said they have signs posted and Chair Syme responded that perhaps they may need to begin fining the drivers who violate that rule. Another suggestion was to use barriers which specifically indicate inlets and outlets. Motion by Mr. Pitcher to amend the Conditional Use Permit to include the new parcel acquired from the City. The lot lines have been adjusted for both pieces of property, and they will eventually be combined. Conditions for approval: 1. Resolve the issue of trucks circumventing the Trackout. 2. Decrease the height of the existing dirt pile to the prior Conditional Use limitation. 3. Amend the Conditional Use Permit to include the new combined 11.5-acre parcel acquired, in part, from the City. Motion seconded by Mr. Tobias. Vote called with all in favor, none opposed. 10. Annual Training: a. Rules of Procedure and Ethics. b. Annual Ethics Pledge and Disclosure Statement. c. Open and Public Meetings Act. d. Workplace Non-discrimination and Policies. e. Storm Water Education for Local Officials. Mr. Morris and Mr. Loveland presented the above training to the Commissioners and staff. 11. Adjourn. By consent a motion was made to adjourn and the meeting was adjourned at 8:14 PM.
