PUBLIC NOTICE RENEWAL OF A UPDES PERMIT
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to renew and modify a Utah Pollution Discharge Elimination System (UPDES) Permit under authority of the Utah Water Quality Act, Utah Code Sections 19-5-104(9) and 107(2). Said 'permit' refers to the UPDES Permit and the Fact Sheet Statement of Basis (including Total Maximum Daily Loads (TMDL's)) if applicable, as per Section 303(d) of the Federal Clean Water Act (CWA).

BACKGROUND
Kennecott Utah Copper LLC (Kennecott) operates an integrated mining and mineral processing facility that includes an open pit copper mine with some underground development, waste rock disposal areas, water collection system, copper cementation plant, concentrator, smelter, refinery, power plant, reverse osmosis (RO) groundwater treatment plant, sewage treatment plant, and a tailings impoundment. This Permit renewal covers all of the Facility's discharges to surface water, excluding storm water discharges, and the facility's processing and disposal of biosolids. The primary discharge from the tailings impoundment reports directly to the Transitional Waters and Gilbert Bay of Great Salt Lake via Outfall 012. The sediment pond and Outfall 002 remain in place for the discharge of tailings water to the C-7 Ditch and Lee Creek as needed. Outfall 007 for the discharge of seepage and dike runoff water from the tailings impoundment to the C-7 Ditch also remains in place.
PUBLIC COMMENTS
During the public comment period provided under Utah Administrative Code R317-8-6.5, any interested person may submit written comments on the draft permit and may request a public hearing, if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final decision and shall be answered as provided in R317-5-6.12. Public comments are invited any time prior to the deadline of the close of business on March 16, 2022. After considering public comment the Utah Division of Water Quality may issue, revise, or abandon the permit.
