N/AMINUTES OF THE REGULAR MEETING OF THE TOOELE COUNTY BOARD OF COMMISSIONERS HELD JUNE 10, 2008 Chairman Johnson called the meeting to order at 3:00 p.m. The time, place and agenda of the meeting had been provided to the Tooele Transcript Bulletin and to each member of the governing body by delivering copies of the notice and agenda at least two days before to each of them. 1. ROLL CALL. The clerk called the roll which showed Commissioners Colleen Johnson, Chairman; Jerry Hurst and Bruce Clegg present. Also present were Doug Hogan, Attorney, and Marilyn Gillette, Clerk. 2. MINUTES. Commissioner Hurst moved to approve the minutes from the Tooele County Commission Meeting held May 27, 2008, as corrected. Commissioner Clegg seconded the motion. The motion carried. 3. TAX ADJUSTMENTS. Commissioner Clegg moved to approve the following tax adjustments: A) Wayne Thornton, Parcel #04-070-0-0002. Delete LA02 acres and value, acre correction to LR01 in 2004, LA02 for 0.18 acres has been double assessed. Relief amount for tax year 2007 - $23.16, 2006 - $24.69, 2005 - $24.72; B) Connie L. Anderson, Plate #78506P. Refund age base fee paid May 8, 2008. Sold trailer April 2007, registered the trailer in error. Relief amount $-10.00; C) Margene Colledge, Plate #P000921201. Refund age base fee paid when issued a temporary operating permit on May 27, 2008. Vehicle is not repairable, unable to pass a safety inspection. Relief amount $-10.00; D) Gary S. Kushlan, Plate #358NRT. Refund age base fee paid March 17. Should have received a Veteran Abatement for 2008. Relief amount $-150.00; E) Mick Lee Mills, Plate #Z753EE. Refund age base fee paid May 30. Should have received a Veteran Abatement for 2008. Relief amount $-110.00; F) Seth R. Hicken, Serial #11-049-0-4060. 10% Vet, did not receive for 2007. Relief amount $250.75. Commissioner Hurst seconded the motion. The motion carried. 4. INVOICES. Commissioner Clegg moved to approve the following warrants: A) Warrants issued May 23, 2008 in the amount of $665,687.50 - Check #091722 thru #091896; B) Warrants issued on May 30, 2008 in the amount of $623,082.68 - Check #091897 thru #092034; C) Warrants issued on May 30, 2008 in the amount of $384,635.45. Warrant #42534 to #42910, Check #2449 to #2490. Transmittal Checks in the amount of $280,487.06, Check #2491 to #2407. Voided Check #2501, wrong amount; D) Warrants issued on June 6, 2008 in the amount of $857,563.57, Check #092035 thru #092222. Commissioner Hurst seconded the motion. The motion carried. 5. APPROVE 2008 TAX SALE. Mike Jensen, Auditor, stated that there were three properties that were for sale. Federal Home Loan Mtg Corp (01-098-0-0032) - $236.20 Successful Bidder - Tooele County (There were no bidders on this property.) Valdez, Leon (01-200-0-0008) - $1,560.26 Successful Bidder - Paul Follet - $3,500.00 Singh, Ranbir (01-102-0-0001) - $324.31 Successful Bidder - Paul Mohebali - $1,475.00 Commissioner Hurst moved to approve the 2008 tax sale. Commissioner Clegg seconded the motion. All concurred. 6. ORDINANCE 2008-12 - ENACTING SECTION 6-4-3, IMPROPER LOOKOUT, OF TITLE 6, PUBLIC SAFETY, OF THE TOOELE COUNTY CODE. Attorney Hogan stated that the reason for this ordinance is that the Utah Code has several other statutes that are often used to cite the driver responsible for causing an automobile accident; however, said statutes, in many cases, are not a very good fit for the specific facts presented by the accident. This statute will more accurately describe the facts associated with many accidents. It is his office that has asked for this to be included in the County Code. Commissioner Hurst moved to adopt Ordinance 2008-12 - Enacting Section 6-4-3, Improper Lookout, of Title 6, Public Safety, of the Tooele County Code. Commissioner Clegg seconded the motion. The motion carried. 7. ORDINANCE 2008-13 - AMENDING SECTION 1-4-2 OF THE TOOELE COUNTY CODE, CONSOLIDATING THE WENDOVER AND TOOELE VALLEY JUSTICE COURT PRECINCTS INTO A SINGLE PRECINCT KNOWN AS THE TOOELE COUNTY JUSTICE COURT. Attorney Hogan stated that the purpose of this ordinance is that currently Tooele County has two Justice Court Precincts. The County desires to consolidate these two precincts into a single county-wide precinct. This single precinct will have jurisdiction anywhere in the county. There will be two physical locations where court will be held; the Gordon Hall Courthouse in Tooele City and the Wendover County Building. There will be one judge covering both courts. This change will allow all county citizens to vote on the retention of the Tooele County Justice Court Judge. Commissioner Hurst moved to approve Ordinance 2008-13 - Amending Section 1-4-2 of the Tooele County Code, Consolidating the Wendover and Tooele Valley Justice Court Precincts into a Single Precinct Known as the Tooele County Justice Court. Commissioner Clegg seconded the motion. The motion carried. 8. ORDINANCE 2008-14 - AMENDING TITLE 6, PUBLIC SAFETY, CHAPTER 1, CRIMINAL PROVISIONS, AND AMENDING CHAPTER 2, JUSTICE COURT, OF THE TOOELE COUNTY CODE, ADOPTING UTAH CODE TITLE 78A, CHAPTER 7. Attorney Hogan stated that this came from his office also. Tooele County has always followed Utah Code concerning the operation of Justice Courts. But if a citizen had a question about how Justice Courts operate, they would not be able to find it in our County Code because the County has never formally adopted this portion of the Utah Code. This ordinance will make said information more accessible to the public. Commissioner Hurst moved to approve Ordinance 2008-14 - Amending Title 6, Public Safety, Chapter 1, Criminal Provisions, and Amending Chapter 2, Justice Court, of the Tooele County Code, Adopting Utah Code Title 78A, Chapter 7. Commissioner Clegg seconded the motion. The motion carried. 9. PUBLIC DEFENDER CONFLICTS AGREEMENT WITH JOEL LINARES. Attorney Hogan stated that this contract covers the Juvenile Court. In Juvenile Court, hearings are often set with only 24 hours notice. It's important that the County Attorney's Office has a list of attorneys Juvenile Court can call with little notice who have experience and have expressed a willingness to work at the county contract rate of pay. This is strictly for conflict work. Commissioner Hurst moved to approve the Public Defender Conflict Agreement with Joel Linares. Commissioner Clegg seconded the motion. The motion carried. 10. CONTRACT WITH ENTERPRISE RENT-A-CAR. Commissioner Johnson stated that this contract is for Judge Pitt to be able to rent a car when he goes out to Wendover to serve as Justice Court Judge. Commissioner Hurst would like to look at other options, perhaps using vehicles that are already owned by the county. Because the contract is with Tooele County and not just Judge Pitt, Commissioners Clegg and Johnson stated it might be a good idea to approve the contract in case any County employee needs to rent a vehicle. Commissioner Hurst went on record to say that he felt the county has vehicles available and that those vehicles should be used before one is rented for county use. Commissioner Clegg moved to enter into a contract with Enterprise Rent-A-Car to have cars available if the county needs them. Commissioner Johnson seconded the motion. Commissioners Clegg and Johnson voted yes. Commissioner Hurst voted no. The motion carried. 11. BOARD APPOINTMENTS. Commissioner Johnson moved to appoint the following people to the Department of Workforce Services Central Region Committee: Louis Caudillo, Questar; Spencer Larkin, Larkin Mortuary; and Markus Schellenberg, St. Marks Hospital. Commissioner Hurst seconded the motion. The motion carried. 12. POINT OF ORDER - STANSBURY PARK VILLAGE SHOPPING CENTER. Commissioner Clegg moved a point of order. In the last meeting there was an appeal from the Stansbury Park Village Shopping Center. Since that time, there was a major water event and there was a lot of observing going on. There was an expert witness that was supposed to be here to give some information and evidence. He asked if it was possible to bring this up at another time. Cody Christensen, Bonneville Development, wanted to be able to get this approved or go back to the drawing table as soon as possible. They have been over this with the County Engineer and their engineer that they are not going to be flooding the neighbors and have not been flooding them. As far as the runoff water seeping into the neighbors yard, they have proven that it is not coming from their property. They are still appealing the fencing requirements. Commissioner Clegg was at a resident's home at 6:00 a.m. and there was a ten-foot square of water in their yard, but it came from the south, not from the shopping center. Cody stated that they are down to the fencing issue on the southwest corner; they have met all of the other conditions. Commissioner Clegg asked if the Commission wants to hold up their subdivision plans for that issue and asked Attorney Hogan for clarification as to where things stood procedurally. Attorney Hogan stated that the only matter before the Commission is the appeal of the condition regarding relocation of the fence. Bonneville has appealed that condition, which places before this body the question of whether or not to uphold the condition or strike it. Commissioner Clegg moved to take the appeal off the table. The motion died for lack of a second. Commissioner Hurst stated the reason he won't second it is because he feels like he doesn't have enough information to make a decision. The one important question that he asked and never got an answer to was if the people knew that the elevation would be changed when they purchased their property. If they all knew it when they purchased that property, then it's buyer beware. But he doesn't have the answer to that question. Cody's rebuttal as to whether they knew the elevation was going to be changed was that the plans were submitted to the Engineering Department. Whatever the process was in the Engineering Department as to notification, he did not know. Commissioner Hurst asked whether the lots had been sold before these plans had been submitted. Cody did not know. Commissioner Johnson asked if there was any way of working with these people. Some of them want more fencing, others do not. Cody stated that they have worked with the Engineering Department on everything, but there are people out there that cannot be satisfied. They have done all that they believe can be done on the fence issue. They now need to work with one more property owner on the corner. Commissioner Clegg restated the motion to bring back to the table the appeal to the Tooele County Commission of PUD #07-02200016 - Stansbury Village Shopping Center. Commissioner Hurst seconded the motion. The motion carried. Commissioner Hurst moved to postpone this motion until they get more information from the developer and the land owners so they can make a more informed decision. Commissioner Clegg seconded the motion. The motion carried. 13. COMMISSION MEETING CANCELED. Commissioner Hurst moved to cancel the Tooele County Commission Meeting scheduled for June 24, 2008. Commissioner Clegg seconded the motion. The motion carried. 14. ADJOURN. Commissioner Hurst moved to adjourn the meeting at 3:40 p.m. Commissioner Clegg seconded the motion. The meeting adjourned.
