MINUTES JOSEPH TOWN COUNCIL MEETING NOVEMBER 4, 2021 PRESENT:Troy Campbell, Jared Campbell, Mayor Campbell, Doug Nowell, Marty Anderson, Charles Billingsley, Howard & Greg Hatch, John Spendlove, Gene & Sue Gestring, Steve Healey, Mike Naiser PRAYER: Jared Campbell PLEDGE OF ALLEGIANCE Marty made a motion to accept the minutes as read, Doug seconded the motion. All were in favor. The mayor opened the hearing for Howard Hatch and the actions that were taken on his tree. Charles Billingsley went over the dates in which he sent notices to Mr Hatch and the contact that they had had with each other. He also provided pictures of before and after the abatement. Howard did not like what needed to be done to fix the problem. Charles met with Howard and his son on October 4th along with an arborist Doug Bentley Highway Tree Trimming Services came out to look at the tree to assess the situation and see what needed to be done next. A truck & trailer needs to be able to pass under it and there needs to be a clear view from both sides of the road. Howard said no one could touch his tree but it was explained to him that this needed to be done for safety issues. An abatement was set up for October 13. Doug Bentley, a sheriff's Deputy, was there to keep the peace. The Hatch's were given copies of the state code, county codes, and the towns codes. Also the plot maps showing where the tree was located. Charles said that because of where it was located, the whole tree could have been cut down, but they did not do that. They just trimmed the limbs that were causing the problem and left the rest of the tree alone. Because of the work, and the equipment that was used, the bill came to $1000.00 plus $200.00 for administration fees. He had to use a shredder to clean up limbs and also remove all the bigger logs. Charles felt like this was a reasonable cost for what was done. The town codes cover what was done, and the State code covers this hearing Neglect of property owner removal by municipality cost of removal notice to file a lien property owners objection. Howard, in care of Diana Lenora Webb the owner, has filed an objection in writing. This hearing is to review and determine the actual cost of the abatement. Howard may present his position. At the end of this the property owner will pay any of the actual costs due after the decision of the municipality to the treasurer within 30 days after this hearing. Howard wanted to be shown what the complaint was by the town. He said he thought the only complaint was there needed to be a clear view for vehicles to drive back and forth on the road. He said that when he, his son, and Charles talked about what had been done, that Charles was ok with it. Charles said that they discussed the limbs needed to be cut because the garbage trucks could no longer go under them to dump the garbage. He also said it was discussed that the area around the tree needed to be cleaned up so no one hit those trees. Howard did clean some of it up, but the mayor said the limbs were still a problem and the overhang had to go. Howard said that Charles was denying that the issue was the clear view and that he keeps talking about the overhang. Howard said there had just been a huge storm with very heavy wet snow, and it didn't affect the two limbs that the town had cut down, which were clearly from a tree that was on their property. He felt it was a violation of constitutional principles. He felt that the limbs were not a danger because they had just sustained heavy loads of snow. Where other limbs all over the town and county were brought down. Doug asked if Howard had tried to drive under the limbs with snow on. Doug said he had and they were almost touching the ground. Howards son said Doug was a liar and that he watched people drive under them all day. The Mayor said the point of this whole discussion was not if the tree could sustain and withhold, but that there was no clear vision for people to pass through. It was pushed to one lane. A professional arborist came and removed the limbs that were detrimental to the view and still did not kill the tree. Howard wondered if Charles got a picture of the tree with the snow on the limbs. He did not but did get pictures of the tree limb obstructing the road. Howard stated that the limbs did not need to be trimmed so high, but Jared said if they hadn't we would be in this same situation next year when all the limbs and leaves had grown back. The town is abating any current and possible problems now. Troy pointed out the trees in front of the rental church on Main, that are on private property were trimmed by the power company so they didn't hit the power lines. Howard stated that Charles said the trimming that the Hatches had done was enough, but that the mayor said it needed to be trimmed more. Charles said they had done work on it, but that he couldn't close it out until the hazard had been removed. Charles' son stated that there was a tree next to their tree, in front of Melba's house, that the town should bill her for. Charles said it was the limbs that had fallen from their tree. His son was adamant that it was not. His son also said that Charles had the arborist bump up his price from $700 to $1000 Charles said the Arborist said it would be $700 if they could leave the logs still there. The logs were still there. Jared said that a year & a half ago, the town got bids for tree removal and the bids were no less than $1000. So he felt that was a fair price. His son was still adamant that the price had been raised and they shouldn't have to pay it. He was asked to leave because he was not adding anything helpful, and just causing problems. He was escorted out by Deputy Rich & Troy. Howard still felt it was against his rights. He would file a complaint with the county clerk. The mayor motioned to move forward with the $1200.00 invoice and there is 30 days from today to pay it or else it goes on taxes. Doug seconded the motion. All were in favor. ROADS: Randy and Laura Obray contacted Jared about an encounter they had at the 4 way of Center and Main. They were driving from Sevier to Monroe, and as they made the turn to go towards Monroe, a truck ran the stop sign going 40 mph and had to swerve around them to avoid hitting them, because they were already turning. Jared would like to see a 4 way stop put in right there. He talked to Sheriff Curtis about it and he also agreed. His suggestion was that we write a letter to the county commissioners asking for a 4 way stop there. If they deny it the town needs to get litigation towards the county. Enforcing the commissioners to give us the 4 way stop. Last time the commissioners told us to go to Bob Watts, but the commissioners are over him. Doug said that the flashing light has helped, but we need one both ways. The mayor suggested possibly putting rumble strips 150 ft ahead of the stop sign to get people to slow down. Jared motioned that we need to work up a letter to send to the commissioners or ask them to come to a meeting discussing the issue to see what we can do. Doug seconded the motion. All were in favor WATER: The surveyor was able to get up to the spring. The plan now is to get the design done by the end of November, first of December and have it approved by Rural Drinking Water , and then start bids by the first of January, and construction started by last spring as long as construction can get up there. There was an agreement from the USDA that the town needs to sign, he will send it to Haley. He is still waiting on Preston Parker and the land use agreement. He was frustrated that he already signed it and that it needed to be revised. USDA wanted it revised. Mike has tried to email and call him, but he has not got back with him. Troy said he would talk to him and see what we can do. We should be hearing back from the ARPA funding in a couple of weeks. Mike said almost every town applied. There was $50 million dollars for the grant and there were requests equaling $3 billion dollars worth of projects through the whole state. Jared asked if anyone, specifically those who have bought land, had asked for information about buying water from the town recently. Mike said no, but that he would let the town know if anyone did and that they would have the town's best interest in mind. The mayor said it would be ok to take down the no watering signs. PLANNING COMMISSION: Jared felt like it might be in the town's best interest to annex the people that are buying property around the edge of town who are asking for water. They are using the town's roads to access their property but not paying for any of the use. So is that something the town wants to look at and work toward. Mackelprang would like to meet with the town or someone to talk about the town's future plans. Jared said he would send him Ed Payette's direction. The PC is waiting on the state to see what they decide and then we will follow suit to align our plans with theirs. The PC is working on a Large Animal Ordinance and a mobile home ordinance. MISCELLANEOUS: For our Agreed Upon Procedures our town did not have an Annual Fee schedule. Jared motioned to accept the Annual Fee schedule as written down. Troy seconded the motion. All were in favor. Rebecca Zufelt was wondering if she needed a business license for her Airbnb. When we first talked to her about it we told her no because she was the first one. The town said we should now because she needs it in order to have her business. Doug motioned to adjourn the meeting Troy Seconded the motion.
