III. BUSINESS
Jason Grundy - Subdivision. Jason Grundy- Jason was not present.
Brad Duffin - Culinary Water Connection. Brad Duffin- Brad Duffin with Red Rock Real Estate representing Doug Isabel. Mr. Isabel is thinking of selling his property in Bicknell and was wanting to know if the council will give culinary water connection. Mr. Duffin had a map that was given to all the council members showing where the property is. The property is outside Bicknell city limits. It was suggested that they could maybe go from the sun glow campground line but Scott was worried that the line might not be big enough to supply water to both places. The council said Mr. Duffin would need to talk with the county about fire protection and what all would be needed to get water there. There was some discussion about him being able to work out something with the forest service and Milton Taft as they both get water close by. The council was also concerned about access to this land. The council decided if other terms were met, they would approve the culinary water connection. Mr. Duffin thanked the council and excused himself.
Shannon Robertson- Planning/Zoning Report. Shannon was present to report the planning and zoning report. She said everyone was present at their meeting as well as Amanda Brown who was present to request permission for Jeff Wangsgard to separate his lot into two 1/2 acre lots. The commission said they would approve the lot to be split.
A building permit for Kade Blackburn had been signed by Sharon Cowley and Eric Torgerson. The planning and zoning commission recommended the council to approve this permit. The council was okay to approve as long as he followed all the ordinances regarding building close to the road such as no door or access on the west side of the shed.
Bronson Oyler is wanting to build a holding pen and kill the animals on site for his business on amin street. Shannon looked back in the minutes and said previously Mr. Oyler said there would be no holding pens nor would there be any killing on site. The planning and zoning commission is worried about the smell and the looks of the holding pen on main street. They have stated now the health department is requiring a holding pen and to kill on site to be able to sell the meat in the store. The commission needs more information from the health department and Bronson Oyler as well as the property owner David Love. The planning and zoning commission approved a checklist survey. Rhett was checking into drilling wells on public land. The town plan is looking good just needing little updates. Flooding was again concerning with new builds they want people to be informed about being in flood zone.
Shannon was concerned about the communication within the Planning/Zoning Commission and wondering how someone would get on the agenda, whether they call the town hall and talk to Carrie or Kelsey or call someone on the Planning/Zoning commission. Connie suggested planning and zoning decide who is in charge and how they want someone to get on the agenda. Mayor Johnson said that was something that needed to be worked on. There meeting for November was scheduled for November 2 but Connie informed Shannon they would not be able to use the town hall that day because it was Election Day and the town hall would have people in it for elections all night. Shannon will see if they could maybe meet somewhere else. There December meeting would be help on 30 November 2021 and someone from the commission will be to Town Council Work meeting on 28 November 2021.
Transient Tax Ordinance. Mayor Johnson asked the board if they had any questions about the Transient Tax Ordinance. Mr. Brian asked what it was and if it was like the county transient tax already collected. Mayor Johnson explained to him that it was in fact like the county transient tax but this would go directly to Bicknell Town, it would be a 1 % Tax on public accommodations. She explained that the money received could only be used for tourism and roads. She then explained that in June she went before CIB for road project funding and they asked why Bicknell Town wasn't collecting a transient tax and that is why we had decided to make this ordinance. Kerry Stevens made a motion to adopt this ordinance. Weston second, Bryan ayed, James, ayed, and Mayor Johnson ayed.
Culinary Water Rates Resolution. Mayor Johnson asked if everyone read the Resolution 10-07-2021. This proposed resolution authorizes the town to increase the current culinary water rates. Mayor Johnson said Dave Vandyke said you had to include some water allowance with a base rate, but she talked with Kelly Chappell and that is in fact wrong, you do not have to include any water with the base rate. Dave also mentioned to the mayor that this water was cheap water and didn't think anyone should be complaining about it. Kelly also said that the town needs to set some impact fees and there was some discussion on what fees they would need to set. Also included in this resolution was the current connection fees and the deposit fees, so the rates would be altogether in one resolution. Mayor Johnson stated that the livestock watering would be considered residential and asked if the council had any questions about the Resolution. The council had no questions or comments. Weston made a motion to pass Resolution 10-07-2021. Jim seconded, Bryan ayed, Kerry ayed, Mayor Johnson ayed.
Public Entity Resolution. Connie informed the council in order to get her name removed from the bank accounts tied to PTIF accounts that Carrie and Noreen would have to have a paper notarized and sent to the Office of the State Treasurer. Jim made a motion to approve, Weston second, all ayed.
V. MISCELLANEOUS
Mayor Johnson will put up the flag around the memorial for the holiday on 11 October 2021.
IV. MEMBER REPORTS
Mayor Report. Mayor Johnson had been to CIB earlier that day. She discussed that in June she had went and they only approved for half the funding we needed for our road projects. This time there was some discussion about how the main project road is a road going to a public land and the county was not willing to help with funding. A Mayor Johnson was pleased to announced that the funding for the whole project was passed. $192,000.00 in loan for 10 years with 0.5% interest and $771,200.00 in grant. Also, Dave VanDyke is wanting more water connections down by the lodge for maybe in the future subdivision. He proposed that if he bought a tank for water storage and then after 1 year the tank would them be Bicknell Towns. Mayor Johnson spoke with Kelly Chappell he said that is correct. They would need to see about getting the water there and Dave would be responsible for the cost of getting there, maybe upgrading the line to a bigger line. Kerry Stevens mentioned he was worried about getting water there and the bacteria that would be near the end of the line and there was no way to loop it. They would have to flush it with a fire hydrant to reduce bacteria. Mr. Vandyke would also be responsible for putting in fire hydrants down the line to him.
Scott. Scott had Bruce and Carol Hintze plot information on where they wanted burials. Carrie or Kelsey will get those into the cemetery book. Scott reported the springs on the mountain are producing 27 gallons a minute. The Brinkerhoff Spring pumped 78,400 gallons last month. The tank is down about one foot. Scott read the meters. The last water sample was good. He reported that irrigation water is off. It is not winterized yet but as soon as the pond goes dry, he will finish. Scott also recommended everyone keep drain valves open to prevent freezing and breaking over the winter.
Connie. Connie had a business license from Trevor Johnson for leather work out of his home. This had been discussed previously and the council approved the license. Connie had the money to pay for his license and gave it to Carrie.
VI. FINANCIAL. A list of the bills was presented to the council for payment approval. Bryan made the motion to pay them, Weston seconded, all ayed.
VII. ADJOURNMENT
Kerry made the motion to adjourn at 8:30 pm. Weston seconded, all ayed.
