Description/Agenda
Minutes of Oak City Town Board Regular Meeting held January 21, 2021 The meeting was held at the Oak City Town Hall beginning at 7:30 p.m. in the Main Hall. . The following were in attendance: TOWN OFFICIALS Mayor Shim Callister Council Member Dave Steele Council Member Monica Niles Council Member Dallin Dutson Council Member Stewart Rowley Town Clerk Karen K. Lovell Oak City Volunteer Fire Department, Russel Dewsnup OTHERS Tom Nielson Lambert Dutson Jeff Teichert Tammy Rowley Town Clerk Karen K Lovell Marion Ray Anderson Monica Christensen The following agenda items were considered: A. Invocation. The invocation was given by the Mayor. B. Adopt Agenda. Dave moved, seconded by Dallin, to adopt the Agenda as written. Roll Call Vote: Mayor Callister- Aye. Dave-Aye. Dallin-Aye. Stewart-Aye. C. Adopt Minutes of Regular Town Board Meeting held December 17, 2020. Stewart moved, seconded by Dave, to adopt the Minutes as written Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Stewart-Aye. Council Member Monica Niles arrived at this time. D. Discuss the Tom Nielson Annexation Proposal. The Mayor passed out copies of an information sheet showing the number of building permits sold from 2014 until the end of 2020. 2014 was when the Town water system study was done. The sheet also showed the annexations approved since 2009. The Mayor presented the information to show why he was not concerned with the annexations going in causing any water shortage problems for the Town. Even with the annexation of over 200 acres, the Town has not met the projected 20 year average of about 3 to 5 connections per year. It is currently at 1.71 connections per year. Back in September the Mayor asked the engineers about how many water connections were still available and was told about 358 and this was before the spring development was done which has made the springs even more productive. Stewart pointed out that the reason he had wanted to discuss the Annexation was because he had looked at the property description in the legal notice printed in the newspaper and believed it was a totally different area than he thought. After looking at the map that Dallin gave him and Tom explaining the area, he understood it to be located where he had thought it was and realized that Lambert Dutson's property was included in the description, so he was okay with the Annexation as proposed. Dave explained that there are annexation ordinances and subdivision ordinances and they differ. An annexation ordinance pretty much just adds the proposed property to the Town. Sub-division ordinances address road, water, and power issues and require the sub-divider to cover their costs for each of these. Dave also explained that several years ago, a past Town Council set up an expansion area around the Town, as they wanted to encourage growth but have some kind of control over where the growth went..The Mayor mentioned that Stewart is currently looking at the possibility of the Town obtaining even more water storage through aquifer recharge. E. Discuss the Cemetery Veteran Monument. Shim checked the Monument and it is very hard to read the names. Something at the Park would be nice but the Monument at the Cemetery has the mountains as a backdrop and is so nice. Dave felt the Cemetery was a more hallowed spot for the Monument also. He felt the Monument could be cleaned up and maybe do some landscaping around it. Stewart wondered if there was a way to get the letters redone. Maybe a monument company could come redo the letters and clean up the Monument. He will check on this. The Mayor stated that Matthew Anderson was the one that brought it to his attention and he is willing to do a fundraiser to obtain monies for costs of redoing the Monument. It might be good to form a committee for this. The Mayor will see if Matthew would be the committee chair. F. Discuss Possible Ordinance for the Purpose of Requiring Water Connections to be Installed Within Six Months of Purchase. There has been a question arise on the viability of an outside water connection. There is no paper trail associated with the connection and the original owner passed away about 50 years ago (Ellis Anderson). However; there is information that looks like the connection was transferred to Daniel Anderson (also deceased) and Daniel's son, Mason, was wondering if it was a viable connection. The Town has several connections that have been purchased over the years and have not been installed. Originally, these connections probably cost as little as $100 but at current pricing they would be significantly higher. It was the consensus of the Board members that one year was more reasonable than six months. The Town's attorney said that the adoption of an ordinance would work and it could be retroactive. The ordinance could also include a clause that would allow parties to sell the connection back to the Town for what they paid for it if needed. Dave stated that he has been working on a utilities ordinance for some time but it has never been finished. It includes a water section and a power section. He read through several of these sections, they are pretty much what would be needed at this time. This ordinance would address all utilities instead of doing them separately. Dave will start working on this ordinance again. When he has it done, he will e-mail it to the Council members to get their input. He will make sure to check on any State codes and regulations that might need to be included. He will make sure it states that parties cannot transfer or sell water connections that would need to be moved. G. Discuss Private Lane Requirements to New Homes. The Mayor pointed out that this will be an issue with Lambert Dutson's property. In the Code, it states that the Town follows the Uniform Fire Code which says that fire department access roads should be 20 ft. wide. Shim pointed out the reasons for this was apparent during the big 2012 Oak City fire, there was a big fire engine on the road and the Oak City Fire Department truck couldn't get past it to get away from the fire. The road was too narrow. Shim pointed out that when setting up road requirements, he wouldn't expect the road would follow any certain specs but it would need to be wide enough. The Mayor will check into this further and will get a copy of any information he finds to the Council members. He will check to see what other communities are doing also. H. Public Comments. There were no public comments. I. Financial Report. The Financial Report was Read and Approved by Board Action. The delinquent amount is down and not too many are on there. There is one party set up on a payment contract and they are paying it faithfully. J. Departmental Reports. Monica Niles. Monica talked to Nathan Henderson about fixing the back door at the Hall. The Mayor stated that he had found out that Doug Nielson had a tool that would fix the door problem. Doug fixed the back door and did some work on the front door also. The Mayor has been having Nathan change out old lights and replacing them with new LEDs at the Hall. Monica is working on the lights at the Pavilion and will be getting paint for the Pavilion. Dallin Christensen. Got the fuel problem resolved at the City Yard. Jeff Lyman reported a flat tire on the backhoe. Gordon Porter was called to repair it. Replaced a Yield Sign at the intersection of Center Street and 100 West. Had a fire call last Sunday late at night. Dallin was wondering if the fire personnel were able to find the hydrant ok in the dark. The Mayor stated that those called out knew where the hydrant was so they were okay. Dallin wondered if it might be wise to put reflector tape on each hydrant to make them easier to see. Stewart liked this idea. Where Nathan Nielson blows out hydrants periodically, he could put on the tape. The fire department members could help also. The tree committee met last night and will be getting going on this. Stewart Rowley. Jones and DeMille got back with him on the water study information. The costs would be a little higher than they thought. An aquifer recharge study analysis and reporting would be $33,800. Could possibly qualify for a grant from the Department of Drinking Water (DDW).for this. The cost to do the entire project including new 8' water pipe going from the old post office to the Cemetery would be around $287,000 with a 20% contingency included. Might be able to get a grant for the entire project but of course, grants aren't guaranteed. It is pretty likely the Town could get a grant for the study. Jones and DeMille will apply for the grant for the Study for the Town. That application could be sent within a couple of weeks. Stewart wondered if the 8' pipe was really necessary. The Council felt it would need to be done sometime in the future if not now. The Council decided to go ahead with the Study. Stewart will inform Jones and DeMille. Dave Steele. The power drop at approximately 70 West 100 North (Anderson Home) started sparking at the house , right before the meter. Dave opened the fuse for the service. It now needs to be inspected before it is reconnected. Talked to Dwight Day, Oak City Town's Utah Associated Municipal Power Systems (UAMPS) representative to give him input on how much to budget for Oak City Smart Energy Rebates. Decided to go with about $500. Kendall Dewsnup's new building is connected to the power now. Checked with Flowell Electric on the status of the backup transformer. They had no information on this. Dixie Escalante has acquired Flowell Electric however; so they might be able to look into this. They will be approaching the Town with a new contract and will be wanting to do a power study of the Town and implement a new call center arrangement. UAMPS and NuScale have entered into a development agreement for the construction of the Carbon Free Project. Dave requested assistance from UAMPS to see if they could, or if they could recommend someone, help Dave do a rate analysis for Oak City Town Power. The current costs are not being met and things will just get more expensive in the future. K. Miscellaneous. Karen Lovell. Karen reported that she has purchased a new laptop for her use as Town Clerk for the typing of Minutes, Agendas and etc. She was wondering if it would be okay for her to install Word Perfect on the laptop as she finds it a very user friendly program for her. She realized, however; that some of the Council members can't open the files if she sends them in Word Perfect format. She wondered if she could just send them in a different format. She will install Word Perfect on her computer and then save the files and PDFs. She had also talked to Dave Steele, who posts all information on the Town's Website, and asked him if the Minutes, Agendas and other items could be posted on the Site. Dave stated that it would be cumbersome. He recommended that Karen just post the link to the Utah State posting website. She will do this. Since Karen had purchased her own laptop, the idea of giving each Council member a stipend for the purchase of a lap top, I pad, or something of their choice was discussed. Dave felt it would be a good idea and suggested the possibility that the devices that were purchased could even be passed on to new Council members. Karen will place this item on the Agenda for further discussion at the February Town Board Meeting. L. Adjournment. Dave moved, seconded by Stewart, to adjourn. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Monica-Aye. Dallin-Aye. Stewart-Aye. The meeting adjourned at 9:54 p.m. Respectfully Submitted, Approved by: ___________________________________ _____________________________________ Shim Callister, Mayor Karen K. Lovell, Oak City Town Clerk
