Description/Agenda
Planning Commission Present: Len Gasser Shawn Begay Linda Simmons Shari Pugh City Planner Present: Bret Hosler City Counsel Present: Kellen Nielson City Manager Present: N/A Minutes: Nicole Holliday Item #1: Len called the meeting to order. Len let everyone know that Robert Ogle resigned from his position in the Planning Commission. Len is now the new Chairman. He asked if everyone had a chance to look over the minutes from June's meeting and if they saw anything that needed corrected. Shawn made a motion to accept the minutes, Shari seconded it and it passed. Len welcomed the new commission member, Linda. She introduced herself. Item #2: The city council is planning a public hearing to consider David Laws' request to 'disconnect.' The city council has asked the planning commission to make a recommendation on the issue. David Laws wants to take a piece of his land that is in city limits and disconnect it, meaning that he wants that piece of land to be in the county. It is on the city/county border and Laws has already developed the county land, there are storage units on the property. He wants to build more storage units. The new units would go into the land that is in the city limits and the city has it zoned as R2, which doesn't allow for storage units. Laws has obtained a building permit for the units, the building permit is from the county. The piece of land that is being requested for disconnect is .43 acres. The whole area is in the long term annexation plan. Meaning, the city has identified that land would eventually become a part of the city at some point in time. Some questions were asked about future annexation and what would happen with the land and the zoning. Bret explained that if the disconnect went through and the storage units were built, they would be 'grandfathered' in. The commission had a back and forth discussion with Laws about the land and his storage units. They asked about the size of the units and about property tax on the land. The commission expressed their opinions on the request to disconnect. Shari made a motion to accept the disconnect request made by David Laws. Linda seconded the motion. It passed unanimously. Laws expressed his gratitude to the commission for working with him. Item #3: The commission discussed the proposed changes to the commercial zone for residential development. Bret gave a recap of what has already been discussed in past meetings. There has been some discussion of concerns about residential eating up commercial space. The commission has discussed and tried to figure out how to allow for those who already have houses in commercial zones to continue to be able to utilize their house as they would like, and what the commission came up with, is to not allow any lots that are larger than a half acre to be subdivided. So the big properties that are commercial will stay commercial. And existing residential properties that are in the commercial zone that are smaller than a half acre can be subdivided. Bret explained that the smaller lots would allow for residential use as follows: 1. Multi-Family Housing 2. Minimum street frontage allowed 40 ft. 3. Minimum lot size 4000 sq. ft. 4. Setbacks as follows: front setback 20 ft., rear setback 15 ft., side setbacks 7 ft. All setbacks are measured from roof lines. 5. Maximum lot coverage of the dwelling, including garage or carport, is 45% 6. Residential uses as part of a commercial use must not occupy street frontage. 7. Residential uses as part of a commercial use must have a separate entrance. 8. Residential uses as part of a commercial use shall not exceed 25% of the main floor level. Bret explained that these are not set in stone and they are up for discussion. The group discussed it, they all felt good about it and had no concerns. Linda made a motion to move the proposed changes, as documented in the 10-6A-5: Conditional Uses document, on to the city council. Len seconded the motion, and it passed. Item #4: Bret advised that he is scheduled to be gone for the next planning meeting. The group discussed it and agreed to change the meeting from Sept. 9 to Sept. 16. The change has been posted on the state website. Len made a motion to adjourn the meeting. Shari seconded the motion.
