Bicknell Town Council Meeting
2 September 2021
8:30 pm.
I. After closing the Public Hearing for the Culinary Water Project, Mayor Noree Johnson began the regular Town Council Meeting. Those present were council members; Kerry Stevens, Weston Johnson, James Roche, and Bryan Brinkerhoff. Connie Durfey was present to record the minutes.
Scott Woolsey and Carrie Brinkerhoff were present. Kelly Chappell and Brennan Rees from Ensign Engineering were also present.
II. APPROVAL OF MINUTES
Mayor Johnson asked council members if they had any comments or corrections on the minutes of the Town Council Meeting on the 5 August 2021. No changes were made. Kerry made the motion to approve the minutes, James seconded, all aye. Mayor Johnson asked if there were any corrections about the Work Meeting minutes of 26 August 2021. Weston made the motion to approve the minutes. Bryan seconded, all ayed.
III. BUSINESS
Emergency Plan. Mayor Johnson said the council needs to come up with an emergency plan for the town. Kerry said the LDS Church is in the process of making one for them. The LDS Church has a contact tree list in place to get the word out to members in the area, but it wouldn't have non-members names on the list. The WCHC (clinic) has a plan and Wayne County has one too. In an emergency all these different groups would need to correlate with each other, but the town has to figure out what it's responsible for. With the recent unexpected severe flooding in Hanksville, the council realizes how important it is to have an emergency plan in place before it is needed. Personal safety is the number one priority. The town's other priority is to protect the water source. Council members should know where the water valves are located and the fire hydrants. Kelly said he helped Torrey Town compose their plan, and he would be glad to help Bicknell do theirs. He said he would send a copy of Torrey's plan to the mayor.
Culinary Water Project. Mayor Johnson asked Kelly what his opinion was on how the public hearing went. Some of the questions brought up were asked several times, so it's uncertain how much was understood by the public, but hopefully they gained understanding of the project and why it is being done. Probably the vast majority of the people who were against the project were here tonight. It is believed the majority of the people want a more dependable water source. Of the letters that were sent out with the town water bill explaining the project and the proposed water rates 41 were returned. Of those returned, 37 were for the project, and 3 against, with just one having a comment. The bottom line is the water system needs to have the ability to provide 222 gallons a minutes at any time, as that is the peak-day-demand.
Ensign needs to complete the BLM Environmental Process and finish design. Just a couple of weeks after the funding was approved Ensign sent the BLM a Plan of Development, which basically notifies them of the project, requesting the right-of-way for the new tank, and asking if there are an environment concerns which need to be addressed for this project. Kelly said he has sent an email every couple of weeks since then, but he's heard nothing from the BLM so far. He would like the town to reach out to the BLM and request feedback on the documents sent, to keeo this project moving. Kelly would like to meet with them. Kelly will send Mayor Johnson the contact info for the Field Office Manager, Brandon Jolley, and the Real Estate Manager, Mike Uttley. Bryan said Brandon is supposed to call him tomorrow about the overflow pond by the tank and he will talk to him then too.
The proposed new water rates were discussed. It was discussed whether livestock water would fall under commercial rates or not. Regular commercial businesses could pass on the extra cost to their customers, but with livestock there is no one to help with the extra cost. Kelly said he would run some numbers again to see what changes can be made. The town has to pass a Rates Resolution before the closing of the loan. The council decided they would discuss the proposed rates at the work meeting this month and try to have a Rates Resolution ready to adopt in October.
Road Project. Mayor Johnson reminded the council that the next CIB meeting on the road project will be on 7 October 2021. She wanted to know what the council wants her to say at the meeting. Does the council want to accept the $280,000 grant and $280,000 loan with a payoff of approximately $28,000 a year for ten years? That amount will only cover that one block from main to 1st south on 4th west. It would tie up the majority of the B&C road money for 10 years. Kelly said legally the town cannot bond over 80% on their B&C money each year for a loan payment. The town gets about $38,000 a year, 80% of that is about $30,000. Kelly suggested the town write a letter before the meeting stating the town's position again and saying what the town can do and what it can't do and that it would appreciate a second consideration. The council told her to try for the original amount requested, and if the CIB wouldn't go for that to not accept the lower amount.
Kelly and Brennan thanked the council and excused themselves.
Fraud Risk Assessment. The council looked over the Fraud Risk Assessment which has been completed for the State Auditor. Bryan made a motion to approve it, Weston seconded, all ayed. A copy will be submitted to the State Auditor.
Building Permit Application- Lon Christensen. Mr. Christensen's application
for building a house south, on 1st East was looked over by the council. It has been approved by the Planning/Zoning Commission. Kerry made the motion to approve the application, James seconded, all ayed.
V. MISCELLANEOUS
Carrie Brinkerhoff giving the Report of Planning/Zoning Meeting from Steve Albrecht. Carrie said the Planning/Zoning Commission met with Eric Torgerson, the building inspector, who suggested changes be made in approving building permits within Bicknell Town, so they could be approved within 14 days. He suggested designated person(s) on the Planning Commission and on the Town Council would have the authority to approve the permits, instead of having to go before each of these groups. The Planning/Zoning Commission have designated Rhett Jackson, Sharon Cowley, or Marjie Taylor to sign the permits. The council designated Mayor Johnson or Kerry Stevens to sign for the town. The steps for a building permit would be:
- Pick up a form at the town hall
- Return the completed form to the town hall
- Carrie would call someone from Planning/Zoning to sign it
- Person wanting the permit contacts Eric for his signature
- Person returns the permit to Carrie and she gets the either Noreen or Kerry to sign it
Steve Albrecht is going to write a hand out explaining the process for attaining a building permit. It will be put on the town's web site and/or the town's face book.
The council said they didn't think a simple electric meter replacement or inside renovations should have to be approved by the Planning/Zoning Commission, only the town council. Mayor Johnson will let the commission know this. New construction, which deals with set backs and land issues, needs to be approved by the Planning/Zoning Commission first.
Mike Petree was also at the Planning/Zoning Meeting and wanted a variance on the Town's ordinance that prohibits signs on vehicles. He has an old van he wants to paint to advertise his business. The Commission told him no.
FYI. Mayor Johnson wanted the council to be aware of some issues that will be coming up in the near future. She said the Petrees have bought the rest of the building they are in from Adus Dorsey and plan on putting in a couple of apartments, plus live there themselves. This will multiply the parking issue. There may not be a proper septic tank and leech lines for all that, the State may have to get involved. Eric Torgerson, as the inspector, should be aware of these issues too.
IV. MEMBER REPORTS
Mayor Johnson. The work meeting will be 30 September 2021. Discussion will include the propose water rates, the Sub Division Ordinance, and a Transient Tax.
The town received two applications for the position of Town Clerk. One was Karin Ottman from Lyman, and Kelsey Brinkerhoff from Bicknell. Both applicants were quite equal in qualifications. As Ms. Brinkerhoff resides in Bicknell, it was suggested she be given the position. Weston made the motion to hire Ms. Brinkerhoff on a probationary period for 3 months, while Connie can train her, before taking over as the clerk. Kerry seconded, Bryan abstained from voting, everyone else voted aye.
The mayor had a thank you note from Gina Flannigan thanking the council for the money they gave to help provide a luncheon for the emergency personal in the county of September, 11, 2021.
Bryan. Talked with Cindy Leadbetter from the BLM about the overflow area below the water tank. She said that is not her department, but she will have Brandon Jolley call him tomorrow. She gave Bryan his phone number so he could call him directly, if he doesn't hear from him.
Scott. Scott reported the springs on the mountain are producing 29 gallons a minute. The Brinkerhoff Spring pumped 195,000 gallons last month. Scott said the irrigation company had given him some spray to kill the weeds and trees in the overflow ditch from the pond, which he did.
Scott hurt his knee while climbing into the back hoe. He took some time off, while it was healing. He went to the doctor again yesterday and his . knee is improving, he doctor said he needs to take it a little easy for a few more weeks. A water meter for Lon Christensen has been put in. Scott said he has been working on cleaning up things from the flood in town. The cement ditch along 4th west still needs to be cleaned. The road along 200 North and the high school is falling apart, the chip seal on the intersection of 200 N and 300 west is breaking off and damaging the north/south road. In order to save the chip seal on that intersection, it was suggested the intermittent chip seal to the west be removed and the road be graded and filled in around the intersection. Scott said he can probably do the work at the intersection with the town's equipment and level things off. Mayor Johnson said the road by Tony Jackson's and Wade Woolsey's going into the school needs something done there next to the oil. Scott will continue to work on issues created by the flood.
VI. FINANCIAL. A list of the bills was presented to the council for payment approval. Jim made the motion to pay them, Weston seconded, all ayed.
VII. ADJOURNMENT
Kerry made the motion to adjourn at 10:30 pm.
