POLICY SESSION CALL TO ORDER: Mayor Shepherd OPENING CEREMONY: Councilmember Bush APPROVAL OF MINUTES: September 14, 2021 - Policy Session PUBLIC HEARINGS: 1. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON A PROPOSED DEVELOPMENT AGREEMENT WITH ANTELOPE PARK REAL PROPERTY LLC FOR THE PROPOSED MIXED-USE DEVELOPMENT LOCATED AT APPROXIMATELY 1608 SOUTH 1000 EAST BACKGROUND: The developer has been working with staff, the Planning Commission, and City Council and proposes to develop a mixed-use subdivision at 1608 South 1000 East. The proposed development would include a C-store, townhomes, and live/work units along 1000 East. The City Council approved the General Plan amendment and rezone requests, subject to an executed development agreement. The development agreement was crafted to address the proposed City park that was planned within the City's current storm water basin and any other standard deviations. The Planning Commission reviewed the request and recommended approval of Draft B of the development agreement. Draft B includes language that would permit the City to cease maintaining or continuing with the use of the storm water basin as a park only after a public hearing with the City Council. The City Council held a work session to discuss the Planning Commission's recommendation and determined there were significant issues with the proposal to use a storm water detention basin as a park. They asked that the proposed park be removed from the development agreement and the investment by the developer be transferred to increased amenities and fencing. RECOMMENDATION: Receive public comment. 2. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON AN AMENDMENT TO TITLE 11 - LAND USE TO ALLOW FOR INTERNAL ACCESSORY DWELLING UNITS BACKGROUND: The Planning Commission and City Council began discussion on allowing Accessory Dwelling Units in July 2019 and asked for additional research on the topic. The Legislature passed House Bill 82 during the 2021 legislative session mandating all municipal agencies adopt regulations to allow Internal Accessory Dwelling Units within municipal boundaries. A subsequent discussion was held with the City Council in August 2021 that included the identification of important elements that needed to be included in the proposed ordinance. The Planning Commission reviewed the request on September 15, 2021 and recommends its approval. RECOMMENDATION: Receive public comment. SCHEDULED ITEMS: 3.
