5. Review Conditional Use Permit (CUP) for Petersen Excavating. No filing fee recorded on the DUP application.
Four findings from P&Z, and four recommendations for resolution. CUP application is on file at City Office. Council reviewed each item. Height is an issue. Discussion of footprint. After discussion, 20 feet was deemed acceptable. Noise issue was addressed by P&Z, deemed acceptable. Hours of operation: P&Z was split on this issue. Daylight can be the driving force behind this. Hours 6AM to 8PM were deemed acceptable, except for emergency situations.
Mayor brought up barrier that Petersen has placed on the south side of property. Mayor spoke with Alex Houghton and she allowed that the placement of the concrete barrier (fence) along her property and a little to the north on the east end would take care of her concerns. There was disagreement as to whether or not this barrier should become part of the CUP. This barrier was never discussed by the two parties at any of the hearings. Paul suggested that 'when there is dirt there, a wall should be there.'
The term fence was used, but it was actually referring to a barrier of concrete barriers.
Paul suggested wording, 'a temporary barrier needs to be put up when there is product stored there.' The Mayor wants the barrier written into the CUP.
Howard suggested the wording, 'Petersen Construction may put up a barrier, and leave it at that. May means you can or you can't'.
If constructing a barrier is added, it should be attached to the 'control the dust' section. Howard suggested 'sprinkle pile with water or construct a barrier to control dust'. In the discussion that followed comments to change to 'sprinkle piles or construct barrier to control dust'.
Mayor wants that Kent 'will' erect a barrier included in the CUP to be an added condition. This wording is the problem. Mayor wants to see it in the CUP.
Motion to accept the conditions as written including the change of operating hours-Howard Kunz
Second-Paul Hansen
Motion Carried 3-1. Mayor Wood voted no.
6. Council Reports
Rick Fonnesbeck-Water leak by Terry's Auto Body. Chlorine valve is hooked back up to add chlorine. We need another pump in the well. We are relying on one pump for the town's needs. Four wells come to a collection point and normally flow. Pump comes on every two or three days and fills the tanks back up. It will be and expensive item. Working with Schriebers to work with us on getting a new pump. SCADA system is not yet hooked up. Monitoring wells is an issue until this is completed.
Individual from across the river is leasing from Terry's and he brings cars in and removes catalytic converters and then sells the cars as junk. He needs a Business License in order to continue the operation. Rick said he will inform him of that when he sees him. There may be two businesses in there. They need to come to P&Z and get business licenses. Rick will contact them.
Howard Kunz-Lance Gates has finished as Chairman. Carl Sims is the new chair. Judy Downs would like to be on the P&Z board. She approaches with an agenda. Board needs two people. April Hansen is one of those. Mayor will approach Rayslyn Larsen about being on the board.
Paul Hansen-Doors need to be re-keyed. Need another maple tree planted at park. Will get a hold of Zollingers and see if they have one. James Graf has volunteered to dig the hole for the tree. Trees on the S-curve need to be trimmed and pushed off the road. Town Park-Want to change it at the first of the year to $35 for residents and $50 for non-residents. The Town Hall would be the same. Also the refund policy needs to be looked at. Paul has been very liberal with refunds for cancellations, but that sometimes precludes others that wanted the park from being able to get it. Someone cancels and the park is empty for that day. Eagle board from church will be moved to Town Hall. Youth council-Blake Wilson will be the contact. Probably should have a parent rep to coordinate with them. Katie Jenson has been the rep. They met with Gov. Cox.
Dave Wood-Re-surfacing of 5900 N has been completed. Stop sign will stay. Application for re-surface main road has been submitted. Roads will be mowed hopefully this week, and county will patch some spots on roads. Amalga Town Website is being worked on.
7. Disbursements for August $36,642.47.
