MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS THE MEETING WAS CALLED TO ORDER BY MAYOR WILLIAM MILLS AT 7:30 P.M. PRESENT: William M. Mills - Mayor Randy Christensen - Councilmember Jay Mecham - Councilmember Frank Riding - Councilmember Amy Stanley - Councilmember Micheal Stringer - Councilmember GUEST: Patrick Painter, Jay Christensen, Tana & Brett Buchannan, Jacob Newell, ALSO PRESENT: Myrna Trautvein - Times News Reporter Michelle Dalton-Secretary/Treasurer, Chad Phillips Gas/Water, Lyla Spencer -City Recorder, Sara Samuelson Director of Finance, Tony Openshaw -Green Waste OPENING PRAYER: Councilmember Jay Mecham APPROVAL OF JULY 26, 2021 SPECIAL COUNCIL MINUTES: Councilmember Micheal Stringer moved to make a motion to accept the minutes of July 26, 2021 Special Meeting as written. Councilmember Randy Christensen made a second to that motion. All voted in favor, motion carried. (1st Motion) APPROVAL OF JULY 27, 2021 COUNCIL MEETING: Councilmember Randy Christensen moved to make a motion to accept the minutes of July 27, 2021 as written, with a second by Councilmember Micheal Stringer. All voted in favor, motion carried. (2nd Motion) PLANNING AND ZONING: Planning and Zoning Chair Lynn Ingram presented action items for their meeting on Wednesday August 4, 2021 to the council for approval. The first action item was an accessory building permit for Wanda Towne at 741 South 200 West. Ingram told the council everything is ready and recommended the council issue an accessory building permit for Wanda Towne at the above address. Mayor Mills called for a motion to approve an Accessory Building Permit for Wanda Towne at the above mentioned address. Councilmember Jay Mecham moved to make a motion MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS to issue a building permit for Wanda Towne at the above address with a second by Councilmember Amy Stanley. All voted in favor, motion carried. (3rd Motion) Mark Holden also came in for an accessory building permit, located at 563 East Center Street. The building will be 30x14 1200 SF. Ingram suggested the council issue Holden a building permit for the above described building at 563 Center Street, contingent on the building inspector's stamp of approval. Mayor William Mills called for a motion to issue a building permit to Mark Holden, at the above address. Councilmember Jay Mecham moved to make a motion to issue an accessory building permit to Mark Holden, as described above & contingent on a stamp of approval from the building inspector, with a second by Councilmember Micheal Stringer. All voted in favor, motion carried. (4th Motion) Bryce Chappel came in to inquire about an Automotive Repair Shop that he wants to build on Main Street. Ingram told the council an Automotive Repair Shop would not fit under the current zoning code on Main Street. Ingram added, 'Main Street was not zoned for that type of business and it would not work in that area.' Chappel also inquired about a strip mall at the old Humphrey building site, and that also would not work because Main Street is zoned for one-half block deep commercial development. 'We had a discussion with him about businesses that might be approved' It was suggested they will need to have further discussion with Chappel. Thomas Newell came in with questions concerning water lines for a new building at 330 West Center Street. There are still some issues with the water line and gas needs to be run to the area. Ingram said, 'He wants to split the property so that there can be another house built on the property, the problem is that the city water line doesn't go that far.' The current line to his home is substandard and doesn't meet city code and will need to be brought up to standard before a home could be added. 'Newell said that if the city would bring the line up to code, he would extend the line.' Ingram told the council. There were no recommendations until the council can figure out what they want. Mayor Mills responded by telling those present 'We have applied for a grant to upgrade the water lines in the city.' Until the city has the money to upgrade, they will not be able to do this. Quinton and Doran Kay want to split ownership of a duplex they own so they can pass the ownership to their sons. 'They want to split the house and split the property as well,' Ingram told the council. Each of the brothers would own one-half of the property, splitting the duplex down the middle. Mayor William Mills said, 'You cannot split the one-third acre.' Mills said the Kay property was grandfathered in when the acreage requirement was changed to one-half ace per building lot. MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS Mona City Attorney Rob Patterson was present at the meeting advising the council; the Kays cannot build on it, they cannot change its present use, and they cannot subdivide the land because there is not enough property to do that under the current ordinances. 'While they are grandfathered in, any changes to the property would require that they meet current ordinances and standards.' Patterson said. 'They can keep it and it can stay as it is but they cannot change it.' Patterson added. This will not prevent them from splitting ownership on the deed. Since they each want to deed half to each of their sons, they could split ownership on the deed but that would still not allow them to subdivide. Councilmember Amy Stanley asked, 'Can they split ownership as a private agreement?' They can do that legally, Patterson said, they would go to the county recorder and make a change by each being listed as an owner rather than as co-owners. Patterson added, anyone who bought the property would buy the same arrangement that was in place, no changes could be made without the property meeting current code. Cliff Hales proposed Subdivision for 146 homes would be called Willow Creek Farms, the subdivision is proposed for the area south of Cemetery Lane on the east side of the community. The issue was brought to the council's attention through Planning Zoning's agenda. Ingram told the council they brought their attorney to the last planning meeting. Their concern was that the city was not moving fast enough. The developers still need to get some work done before they can receive preliminary approval for the project. A list was given to them, we asked if they had completed the list and they did not have a lot of answers. Their attorney asked a lot of questions; Ingram said they did their best to answer them. We had addressed concerns about the city system having the capacity to provide water for culinary purposes and fire suppression. The developer inquired if there had been a study done that showed the capacity of the system and they want to talk to Sunrise Engineering about the water study they did, we told them that Jones and DeMille Engineering is working on studies and that the city was currently engaged in building those models and a new water tank. DELEGATIONS: Chad Phillips Gas/Water Operator: The roof on the city shed has been replaced, the safe school sidewalk has started and they have blue stakes along the street. The contractor wants to have the work completed before school starts. We have scheduled a meeting with them every two weeks, beginning at 9 a.m. at the site. Their first meeting will be tomorrow and Councilmember Christensen is welcome to meet with them. They are installing new gas and water lines on 100 N for a new house at 150 North 350 East. MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS DELAGATIONS CONTINUED Patrick Painter asked the council to approve the warehouse he is proposing to build, which requires a commercial building permit. The council had some reservations because the building needs an automatic sprinkler system to water down an indoor fire if it is 5,000 square feet or more. Rob Patterson Mona City Legal council was also present at the meeting. Painter presented a letter from Chief Scott J. Spencer, Payson Fire and Rescue to the council along with a technical memorandum from Marie E. Owens, PE AE2S giving background current compliance status and Recommendation for Patrick Painter. After a lengthy discussion Mayor Mills called for a motion to issue a building permit without water and without an automatic overhead sprinkling system used to water down an indoor fire. Councilmember Michel Stringer moved to make a motion to issue a building permit to Patrick Painter with the above language, a second was made by Councilmember Amy Stanley. All Voted in favor, motion carried. (5th Motion) Mayor Mills told Painter the meter has to stay the way it is. And added 'The bathroom and the office cannot be installed until the water delivery issue is solved.' Painter told the council he had received their punch list and added, 'If I knock off two feet the building would be at 4,800 square feet.' Mills said that the state had told him if the building was 5,000 square feet it will need sprinklers. Rob Patterson said, in the international fire code it was clear that the building did not require an automatic fire sprinkling system. He may have to come back to P&Z if he changes his building plans, Ingram told him. The discussion on the water issue was tabled until the first council meeting in September. The Hand outs are attached to the minutes for public viewing DIRECTOR OF FINANCES, SECRETARY/TREASURER & RECORDERS REPORT: Secretary Michelle Dalton reported the city has finally received the CARES Act Money and thanked County Commissioner Clinton Painter for helping the city receive the funds. The city has received half of the funds requested the amount that the city received was $5,500. Director of Finance Sara Samuelson presented the Disbursement Listing for Mona City Disbursement Listing Checking - dated 7/28/2021 to 8/09/2021 with five (5) checks over the allotted amount of $2,000. There was a question on check #7292022, issued to Main Street Pizza in the amount of $70.00. The report is attached to the minutes for public viewing. MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS COUNCIL BUSINESS: There was one fence permit presented for Rachell Lawrence at 579 S 200 E, a 3' 2x4 wire front yard, no corner, single family. Mayor Mills called for a motion to approve a front yard 2x4 wire fence, not on a corner, single family. Councilmember Micheal Stringer moved to make a motion to approve a fence permit for Rachell Lawrence with the above description, a second was made by Councilmember Randy Christensen. All voted in favor, motion carried. (6th Motion) Councilmember Amy Stanley is hoping that the council members are on board to help with the Fall Festival to be held in October. The pumpkin toss along with a lot of other fun activities will be available at the festival. Mona City residents were encouraged to take a survey in regard to the 24th of July celebration, as of 8/10/2021, 25 had taken the survey. Survey results are attached for public viewing. City Finance Director Sara Samuelson said the bill this year for the fireworks order for 2022 was smaller and was wondering if the city would like to change the amount, it was approximately $1,000 less than budgeted. The council was okay with the suggestion and Stanley will contact the fireworks company. Councilmember Amy Stanley told the council the bounce houses were going to cost $2,200 which is over the $2,000 limit she asked if the council would approve the $2,200 figure. Mayor Mills called for a motion to approve $2,200 to for the bounce houses. Councilmember Micheal Stringer moved to make a motion to approve $2,200 for the bounce houses with a second by Councilmember Randy Christensen. All voted in favor, motion carried. (7th Motion) Councilmember Stanley called Custom Electrical Services LLC, Ephraim to give her an estimate on the work needing to be done and the cost for doing it. Attached is a quote in the amount of $2, 428.13. Stanley told the council since the figure is over the $2,000 allotted amount this will have to go out for bid. Councilmember Stanley suggested to put all the revenue back in the account, there was no motion called, all councilmember's' were in favor. Councilmember Jay Mecham wants to know if the council still wants to schedule the sewer clean out. The contractor would GPS all the city's lines but only clean the ones that are needed. Councilmember Randy Christensen will be meeting with the CIB board to discuss the water line upgrade that is needed for the city. Councilmember Frank Riding the city park and ball fields are doing g well and the sprinkling systems are working. Councilmember Micheal Stringer thanked Tony Openshaw Street Supervisor and Chad Phillips Gas/Water Operator for the work on the roads and sidewalks. Mayor Mills closed the meeting by stating: We will have a virtual bond closing for the new proposed water tank on August 19 at 1:30 p.m. The closing will be in the council chambers. Everyone is invited. MONA CITY COUNCIL MEETING AUGUST 10, 2021 COUNCIL CHAMBERS FYI: There were eight (8) motions voted upon and passed, a motion to approve the July 26, 2021 minutes, a motion to approve July 27 minutes, a motion to approve an accessory building permit for Wanda Towne, a motion to approve a building permit for Mark Holden, a motion to approve a building permit to Pat Painter, a motion to approve a fence permit for Rachell Lawrence, a motion to approve additional funds for the bounce houses, and a motion to adjourn this meeting of August 10, 2021. PAY FINANCES ADJOURNMENT: Councilmember Jay Mecham moved to make a motion to pay the finances and adjourn; Councilmember Amy Stanley made a second to that motion, all voted in favor, motion carried. (8th Motion) The city council meeting was then adjourned at 9:45 p.m., with no further comments.
