The following were in attendance:
TOWN OFFICIALS
Mayor Shim Callister Council Member Dave Steele
Council Member Stewart Rowley
Council Member Dallin Christensen
Town Clerk Karen K. Lovell
Town Treasurer DeAnn Steele
P & Z COMMISSION OTHERS
Sharla Anderson Nathan Nielson
Dylan Finlinson Ken Christensen
Cameron Nielson Glade Nielson, Nephi Mayor Dale Pratt
Council Member Monica Niles was not in attendance. Commission Members Ron Erickson and Tyler Finlinson were not in attendance.
The following agenda items were considered:
A. Invocation. The invocation was given by Mayor Callister.
B. Adopt Agenda. The Mayor had two corrections for the Agenda: The Mayor of Nephi was changed to Glade Nielson and the Resolution number was changed to 2021-04.
Dave moved, seconded by Dallin, to adopt the agenda as amended. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Stewart-Aye.
C. Adopt Minutes of Town Board Public Hearing and Regular Meeting held April 15, 2021.
Dallin moved, seconded by Dave, to adopt the Minutes as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Stewart-Aye.
D. Discussion on Growth in Small Communities/Glade Nielson, Mayor of Nephi, Utah. Shim brought Glade up to date on the concerns the Town has with annexations, infrastructure, and requests for rezoning. Mayor Nielson applauded the fact that the Town is anticipating these challenges and trying to prepared. Dave brought up his concerns with Santaquin City where the houses are too close, the roads are too narrow, and it seems like the contractors are just ordering the City around. Mayor Nielson stated that Nephi just redid their annexation document and maps and feels like they are good. He stated that these documents can be found on their website. They set up a three-tier map showing zoning one, two, and three. With a tier one annexation being one that already has most everything it needs, water and power, level two would be a little more complicated, with level three being one that there are a lot of hoops to jump through but would be considered. The maps can overlap each other and help to see where each annexation fits. He said that about a year ago, the legislature passed rules allowing island annexation so this has to be looked at too. Nephi has tried to deny all island annexations except one that is right next to City power and water.
Nephi has a development agreement that forces each request to be looked as far as fences, roads, and green space. It allows more control. He suggested Oak City develop such a plan. He also suggested staying linked up with the planning and zoning commission and the County so the Town has controls in place and everyone is on the same page.
Another issue they have faced is looking at water that might be going to waste and places to store this water.
Glade also discussed impact fees. Growth needs to fund itself. Get every fee you can. He suggested a Parks and Recreation impact fee among other fees.
Ken Christensen brought up the fact that unused water connections or ones purchased but never installed are a problem in Oak City that needs to be addressed.
Dave wondered what to do about areas that have been set up in the County that now want to annex into the Town and are going to leave large amounts of property not developed. Should these be dealt with when subdivided or up front when annexed?
Glade stated they have had problems with issues that have already set a precedent and he knows Oak City has these also but he reminded the Council that the Town has the right to say sorry but that was then this is now. Need to make sure the current ordinances and resolution cover the bases now.
Try to watch for legislation that does not benefit the community and try to block it.
Ken asked Glade about his feeling on annexation as Millard County recommends communities annex as much as possible to maintain control but the Town has to supply water, power etc. Glade felt that the Town did need to watch out for itself.
Glade recommended the Town should own as much land as it can by purchasing what it can throughout Town. That way the Town has more control over land use.
He felt the most important issues were getting on top of annexations and zoning. Make sure your ordinances and resolutions are in place, and a development agreement, and most issues will already be covered. Remember ordinances and resolutions can be tweaked when needed.
Dave felt that it might be wise to annex the Marion Ray Subdivision (Oak Meadows) in to get the added tax base and opportunities to get grants.
Glade stated that the property values in Nephi are up much higher which is good for property owners but not parties wanting to buy homes. There is very little obtainable housing for parties coming in such as new school teachers, town employees etc. Try to encourage obtainable housing. Glade is going to have their attorney, Casey Wright, send information to the Mayor that he thinks might be helpful.
Glade suggested working on getting building permit requirements in writing and have a process. Maybe contract with someone or get a committee.
Cameron asked Glade's feelings on sidewalks. He felt they were nice but these are done at the discretion of the Town. Don't have to have them. If you do them and end up having to put in a sewer system, you have the problem of putting in curb and gutter and sidewalks can end up being a hindrance in someways due to drainage issues.
Dave asked how Nephi got their nice street lights. Glade said they were purchased mainly through grants through the Utah Department of Transportation (UDOT). A grant should be available to the Town for Main Street at least where it is a State road.
The Council thanked Glade for coming.
Dave suggested looking at what ordinances and resolutions the Town has in place and compare it to what Nephi and Delta have in place. Then come up with our own plans. Need to redo the General Plan also.
Dave pointed out that the Planning and Zoning Commission takes a load off the Town Council by coming up with their best ideas of how different issues can be dealt with and then making recommendations to the Town Council.
Sharla asked if it would be best then to just look at a policy, say the annexation policy, and see what it states and what it needs? Dave agreed. There are certain rules that are required by law so they need to be included but the issues that are particular to the Town need to be included.
Dave found a copy of a good document from Ogden City. Of course, there is a lot in it that would not be necessary for Oak City but it would be a good reference point. Went through it quickly with the Council. Dave has suggested to the Mayor that the Resolution on the Agenda be tweaked a little and be included as part of a rules and standards document. Dave stated the idea of a technology stipend could be rolled into this document also. He will be working on the document and will get a copy of it to the Council and then put it on the agenda for the June meeting. Once a Plan is in place, it could have a mandatory review every five or ten years.
The Mayor has been in touch with a group that will help the Town put together a very detailed General Plan. If they do it themselves, it would cost between $20 to $30 thousand dollars. If the Town Council and Planning and Zoning Commission help with it, it could end up costing about $5 thousand but it would be a lot of work. Lots of times the Community Impact Board (CIB) will help with funding also. Dave thought the group could help put the Plan together and the Town could help with the leg work.
Dave pointed out that up until this point, the Town has not had to deal with a major subdivision request. However, it needs to be something the Town is prepared for.
E. Discuss 2021-22 Oak City Town Budget and Prepare it for a Public Hearing. DeAnn had passed out budget worksheets. The Council went through these quickly. She needs to get numbers to plug into the next year expense columns. If anything is going to be spent before June 30th, she needs that information. She would like this information within the next two weeks. If a department's expenditures will basically be the same as the last year, she can transfer that across but any larger expenditures need to be noted. DeAnn will get a final budget to the Council Members a couple of weeks prior to next month's Town Board Meeting. The Mayor will remind everyone in a couple of weeks. There will
need to be two budget public hearings in June. One to discuss the old budget and one for the new budget. If anyone has any questions, call DeAnn.
F. Discuss the Idea of Placing a Temporary Moratorium on Annexations. The Mayor mentioned that at their last meeting, the Planning and Zoning Commission voted to recommend that the Town Council place a temporary moratorium on annexations until infrastructure can be put in place. The Town attorney felt the Town can just deny any new annexation until further notice. Along these lines, the Mayor has sent the information about the new Town boundaries and zoning updates to Adam of Jones and DeMille to start working on the maps. Might have it by next week, not sure.
Dave pointed out that the moratorium is for the purpose of the Town getting its policies in place. Need to make sure that the County is informed of the Town's policies so they are prepared to follow through on their end.
G. Discuss and Possibly Adopt Resolution 2021-04 Prayer at Oak City Town Public Meetings. This Item was tabled as it will be included in the rules and procedures pamphlet.
H. Public Comment. Dale Pratt thanked the Council and the Planning and Zoning Commission for all the hard work they do.
I. Financial Report. The Financial Report was Read and Approved by Board Action.
J. Departmental Reports.
Monica Niles.
Monica was not in attendance and had left no report.
Stewart Rowley.
Would it be okay to put a Notice in the Chronicle on the Program for Memorial Day so all can know what will be happening? The Council approved this. Stewart is not going to be here for the Program but Jeff Lyman will be in charge. The Town will need to provide a speaker and a microphone. The Young Men will put up the flags.
Dave stated that his daughter, Melinda, has been going up and working on cleaning the Veteran's Monument at the Cemetery. It looks better. Don't know if there is anyway to update it so it is more readable. It would be nice to have a new map but not sure it could be redone well, if so, it would be pricey.
Talked to Laura Facer to see if the Town could buy some property from her to put in a new tank. She is willing to sell some property to the Town.
Brian Anderson has found out that Harward Farms owns two outside water connections and he wants to buy one. He asked about how he could move the connection if he bought it. Stewart told him that the connection could not be moved. If the property is annexed, the connection would not be an outside connection but there would be expenses to extend it.
Still waiting for the water study information.
Need to start metering the water that is being used at the Cemetery and the Park so this needs to be included in the budget for next year. It will cost about $20,000 for the supplies.
Dallin Christensen.
Topped off the fuel tanks.
Met with Jones and DeMille and went over the bridges. There were no real danger signs but there are spots to watch.
The bridge by the Howards has water eddying on one sight that might work its way under the road with time. The engineer is thinking it may need a cement wall. Thinking of widening John Christensen's bridge but it may be difficult. A drawing will be done on it.
Ordered some signs.
Replaced a few of the street name signs around town. Will be working to replace more of the worst ones.
The sidewalk by 60 East 100 North (John Kapler) needs to be worked on.
Hoping to get bids on the sidewalk located near 20 West 100 North (Ken Christensen). Will try to get this done next year. Will put this on the new budget.
The tree committee has been working very hard taking out bad trees, trimming trees, and getting new trees in.
Dave Steele.
The Carbon Free Project is still moving forward. They have been getting estimates on fewer units. They have six new communities that have submitted letters of interest. A smaller project should be more efficient. Several studies have just been finished on the site.
Received a letter stating that Lehi City is selling a substation structure. Dave is trying to find out if they would consider selling only part of the structure to Oak City Town.
Dixie Power put in the power line extension to Dave Lyman. The service is not in yet.
Dave has been replacing a few metrers that have had issues.
Dixie Power is in the process of installing automatic water and power meters in another community and they have offered to set up a system for Oak City. Looking into this.
K. Miscellaneous.
Mayor Callister.
Shim has contacted two parties to be on the Board of Adjustments and is trying to get two more. When he gets it staffed, he will run the names by the Council.
Sent out some information for bids on the wash between Craig Dutson and Nathan Henderson. Asked that the bids be returned by the first of June.
Discussed upgrading the Cemetery Monument. The Mayor has talked to some other communities about their costs and it was very pricey. At the very least, he would like to update the flag poles. Could possibly get a committee to look at how to improve the monument or update it. Matthew Anderson could probably chair the committee.
The fuel tank blew into the fence by the fire station shed at the City Yard and made a crease in the fence. Nathan Nielson, Oak City Public Works Specialist, and Shim moved it back.
Talked to the Town's lawyer about the rezoning request that the Town has been receiving. The lawyer feels that they should not be done individually but all at once. Therefore, a public hearing will be held in conjunction with the June Town Board Meeting to get public comment on all current rezoning requests and updates.
The tree committee is looking at getting new trees for the Park and moving or trimming more trees. Purchased some Burr Oak trees. Getting bids on the tree removal. Dave has a couple of trees he would like trimmed out of power lines also.
Two parties have asked Shim about putting solar panels on their homes. The Mayor told them the Town doesn't have a power buy back system and they were fine with that. Dave stated that they need to talk to the county building inspector to make sure the systems are put in correctly.
L. Adjournment.
Stewart moved, seconded by Dave, to adjourn. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Stewart-Aye.
The meeting adjourned at 10:49 p.m.
Respectfully Submitted, Approved by: _______________________________ Shim Callister, Mayor
