Public notice is hereby given that the City Council of the City of St. George, Washington County, Utah, will hold a regular meeting at the St. George City Offices located at 175 East 200 North, St. George, Utah, on Thursday, April 29, 2021 commencing at 4:00 p.m.

2. Discussion regarding the zone change for Rilassante at Divario (PA17).

a. Consider approval of a land swap with the Springs H.O.A. for the trail system leaving Springs Park.
BACKGROUND and RECOMMENDATION: The Springs H.O.A. had requested that the City transfer to the association some property inside the Springs Park boundary that abuts to the H.O.A. equestrian property. In the past the H.O.A. had encroached on the City property. This property transfer will also help rectify the encroachment and allow them to expand their riding arena. There is no cost to either the City or the H.O.A. Staff recommends approval.
b. Consider ratification of a change order for repair of the 400 East Storm Drain.
BACKGROUND and RECOMMENDATION: The City has a contract open with AUI, Inc from storm drain pipe repair work on the 400 E SD south of Riverside Dr. A sink hole has appeared on a section of pipe located north of the construction area. This change order (amount of $475,552) will allow the contractor to install an additional 400 lineal feet of Hobas fiberglass pipe upstream. This section of pipe was anticipated to be replaced within the next year or two; however, due to the current sink hole and any unknown voids around the deteriorating corrugated metal pipe, it is recommended to repair this section at this time. Staff recommends approval.
c. Consider approval to award bid to L.N. Curtis for Fire Personal Protection Equipment.
BACKGROUND and RECOMMENDATION: Bids were opened on March 20, 2021 for the Fire Personal Protection Equipment (PPE) bid #21-077. This bid award includes helmets, hoods, structure gloves, bunker boots, and turnout gear bags. The purchase is part of the Program Year 2020 Annual Action Plan for the Community Development Block Grant. Staff recommends approval.
d. Consider approval of a blanket professional services agreement with Avenue Consulting for traffic signal trouble shooting & consulting services in the amount of $90,000.
BACKGROUND and RECOMMENDATION: Avenue Consulting has from time to time provided traffic signal trouble shooting and consulting services, to simplify the payment process a blanket professional services agreement has been requested. Staff recommends approval.
e. Consider approval of a Professional Service Agreement contract modification for the 1450 South Environmental Studies Project.
BACKGROUND and RECOMMENDATION: A professional services agreement was executed with Rosenberg Associates in June 2020 to complete initial FEMA mapping and erosion risk analysis for the 1450 South Extension from River Road to Crosby Drive (I-15) in the amount of $24,810. This change order completes the FEMA map revision work, and environmental permitting for the project. The total contract amount including this change order is $74,720. Staff recommends approval.
f. Consider approval of a Car Rental Concession and Lease Agreement with Enterprise Rent-a-Car of UT, LLC at the Airport.
BACKGROUND and RECOMMENDATION: This agreement is a renewal of the previous agreement with Enterprise which has expired. Staff recommends approval.
g. Consider approval of a Car Rental Concession and Lease Agreement with St. George Landsmen, LLC (DBA Avis Rent-a-Car) and Salt Lake City Landsmen, LLC (DBA Budget Rent A Car) at the Airport.
BACKGROUND and RECOMMENDATION: This agreement is a renewal of the previous agreement with Avis and Budget which has expired. Staff recommends approval.
h. Consider approval of a new Hangar Lease with Southern Utah Aero, LLC on Lot 57G/58H at the Airport.
BACKGROUND and RECOMMENDATION: Southern Utah Aero (Wayne Ott) has purchased the hangar on 57G/58H from Bambam Holdings, and as such, this new hangar lease being proposed is between Southern Utah Aero, LLC and the City. Staff recommends approval.
i. Consider approval of a new Hangar Lease with 7D Venture, Inc. on Lot 55D at the Airport.
BACKGROUND and RECOMMENDATION: 7D Venture (Tom Hoskins) is building a new hangar at the airport on lot 55D, and he is requesting a hangar lease with the City. Staff recommends approval.
j. Consider approval of a new Hangar Lease with 52 Alpha, LLC on Lot 52A at the Airport.
BACKGROUND and RECOMMENDATION: 52 Alpha (Shane Losee) is building a new hangar at the airport on lot 52A, and he is requesting a hangar lease with the City. Staff recommends approval.
k. Consider approval of a new Hangar Lease with Clubhouse Aviation, LLC on Lots 300-303 and 500-502 (T-Hangars) at the Airport.
BACKGROUND and RECOMMENDATION: Clubhouse Aviation (Troy Belliston and Tucker Nielson) is building a new T-hangars at the airport on lots 300-303 and 500-502, and they are requesting a hangar lease with the City. Staff recommends approval.
l. Consider approval of a new Hangar Lease with Snap Roll Aviation, LLC on Lot 55k at the Airport.
BACKGROUND and RECOMMENDATION: Snap Roll Aviation (Brett Wayne and Celeste Matarazzo) is building a new hangar at the airport on lot 55k, and they are requesting a hangar lease with the City. Staff recommends approval.
m. Consider approval of the minutes from the meetings held on January 21, 2021; March 18, 2021; March 25, 2021; April 1, 2021; April 8, 2021; and April 15, 2021.
4. Consider approval of a Hillside Development Permit to construct the project to be known as Willow Bend Townhomes on 10.53 acres located on the east side of Riverside Drive between Judy Lane and Foremaster Road. Case No. 2021-HS-002.
BACKGROUND and RECOMMENDATION: This is a request for a Hillside Development Permit to allow the applicant to cut into the (20-40%+) hillside for access to a proposed townhome development. The cut would also allow construction of the northern portion of the townhome site. The Planning Commission and Hillside Review Board recommended approval.
5. Consider approval of an ordinance changing the zone from R-3 (Multi Family Residential) to PD-R (Planned Development Residential) for a project to be known as Willow Bend Townhomes on 10.53 acres located on the east side of Riverside Drive between Judy Lane and Foremaster Road. Case No. 2021-ZC-031.
BACKGROUND and RECOMMENDATION: Willow Bend is a townhome project located on Riverside Drive north of Judy Lane on approximately 10.53 acres. The property is currently zoned R-3. The applicant is requesting to build eighty-one (81) individual townhouse units. The Planning Commission recommended approval.
6. Consider approval of an ordinance amending the Target PD-C (Planned Development Commercial) to renovate the exterior facade. The property is located on approximately 8.71 acres located at 275 S River Road. Case No. 2021-ZCA-029.
BACKGROUND and RECOMMENDATION: The Target commercial center is a PD-C (Planned Development Commercial) site which was originally approved by the City Council. When a significant change is made to a PD-C, such as a significant change in the building's appearance, then a ZCA (zone change amendment) is required. The Planning Commission recommended approval with the conditions outlined in the staff report.
7. Consider approval of an ordinance changing the general plan from MDR (Medium Density Residential, 5-9 dwelling units per acre) to HDR (High Density Residential, 16-22 dwelling units per acre) on approximately 7.51 acres generally located at 1700 West Canyon View Drive known as Canyon View Drive General Plan Amendment. Case No. 2021-GPA-002
BACKGROUND and RECOMMENDATION: The applicant proposes to modify the General Plan Land Use Map to support development of a High Density Residential (HDR) multi-family development project. HDR would support approximately 120 to 165 units on the property. Currently, the property is R-3 and typically will accommodate approximately 13 du/ac, which is a MHDR land use designation. The Planning Commission recommended denial.
8. Consider approval of a conditional use permit for buildings with a ground floor area of 20,000 square feet, to be known as St. George Place on approximately 20 acres located at approximately 850 South Bluff Street. Case No. 2021-CUP-006
BACKGROUND and RECOMMENDATION: The subject property was the former home of Kmart and has been developed for many years. The applicant is proposing to redevelop the site by upgrading the building elevations, landscaping, and adding new pads. The code requires buildings with a footprint over 20,000 square feet to obtain a conditional use permit. The Planning Commission recommended approval.
9. Consider approval of the preliminary plat for Cascata at Divario Phase 3, a 64-lot residential subdivision located within the Divario development south of Sentieri Vista Drive at approximately the intersection of Karersee Drive and Appian Way.
BACKGROUND and RECOMMENDATION: This proposed preliminary plat is located within the Divario development south of Sentieri Vista Drive at approximately the intersection of Karersee Drive and Appian Way. The Planning Commission recommended approval.
10. Consider approval of a preliminary plat for Cecita Crest at Divario Phase 3, a 129-lot residential subdivision located within the Divario development south and west of Divario Canyon Drive at approximately the intersection of Lesina Heights Drive and Alserio Lane.
BACKGROUND and RECOMMENDATION: This proposed subdivision is located in the Divario development south and west of Divario Canyon Drive at approximately the intersection of Lesina Heights Drive and Alserio Lane. The Planning Commission recommended approval.
11. Consider approval of the preliminary plat for Woodhaven Estates, a 30-lot residential subdivision located on the northeast corner of the intersection of 3430 East and 2450 South.
BACKGROUND and RECOMMENDATION: This proposed subdivision is located on the northeast corner of the intersection of 3430 East and 2450 South. The Planning Commission recommended approval.
12. Appointments to Boards and Commissions of the City.
13. Reports from Mayor, Councilmembers, and City Manager.
14. Request a closed session to discuss litigation, property acquisition or sale or the character and professional competence or physical or mental health of an individual.
