Public notice is hereby given that the City Council of the City of St. George, Washington County, Utah, will hold a regular meeting at the St. George City Offices located at 175 East 200 North, St. George, Utah, on Thursday, April 15, 2021 commencing at 5:00 p.m.

1. Consent Calendar.
a. Consider approval of an amendment to the January 16, 2020 Interlocal Agreement with Washington County for Ironman.
BACKGROUND and RECOMMENDATION: Last year the City Council approved an Interlocal Agreement with Washington County to host the Ironman events for 2020-2024. Due to Covid-19, the 2020 event was cancelled and it is proposed that the city council amend the original agreement to include the years 2021-2025. Staff recommends approval.
b. Consider approval to award bid to Watts Construction for Dixie Sunbowl improvements.
BACKGROUND and RECOMMENDATION: This project includes a new ramp from Worthen Park into the Sunbowl, future use locker rooms, new ADA ramps and stairs, concessions, ticket booth and restrooms on the south end. Washington County has agreed to pay the balance beyond the $635,000 commitment from the City, Lions and Greater Zion. Staff recommends approval.
c. Consider approval to award bid to Skyline Creations, Inc. for Thunder Junction Pavilion & Seating Area.
BACKGROUND and RECOMMENDATION: Construction bids were opened on March 30, 2021 for the Thunder Junction Pavilion & Seating Area project (21-063). This project includes removals and installation of a 20'x20' pavilion, concrete flat work, raised planters, and utilities on the north side of the existing playground. See attached pages from the bid plan set for reference. The train will remain in operation while construction is being performed. The city received a total of three bids on the project. Skyline Creations Inc. is the lowest bidder in the amount of $138,540.00. Staff recommends approval.
d. Consider approval of an Agreement to Purchase Real Property from the Lynne Godfrey Trust.
BACKGROUND and RECOMMENDATION: The City has purchased several parcels of property along the Santa Clara River in the vicinity of and within the Creekside Subdivision for flood control and prevention. This parcel became available recently and the city was able to purchase the property. Staff recommends approval.
e. Consider approval of a cost-share/reimbursement agreement for the construction of a traffic signal at Riverbend Drive and Riverside Drive.
BACKGROUND and RECOMMENDATION: Public Works has put together a cost-share/reimbursement agreement with the owner of parcel SG-5-2-33-4106, JBCC Properties, LLC, for the installation of a traffic signal at the intersection of Riverbend Drive and Riverside Drive. As part of the approval of the Hillside Professional zone change application, the owner of parcel SG-5-2-33-4106 agreed to pay the city $125,000 for the cost of this traffic signal as their participation. Owner will pay 20% of this cost with the construction of the first building and the other 80% with the construction of the second building. Staff recommends approval.
f. Consider approval of a new Hangar Lease with Delta Bravo, LLC on Lot 55F at the Airport.
BACKGROUND and RECOMMENDATION: A new hangar is being proposed on lot 55F at the airport. The owner of Delta Bravo, LLC (Brian Geraci) is desiring to build a new hangar with the approval of this hangar lease agreement. Staff recommends approval.
g. Consider approval of a SASO Agreement with Axiom Aviation SGU, LLC at the Airport.
BACKGROUND and RECOMMENDATION: The owner of Axiom Aviation SGU, LLC (Jason Child) is requesting a Specialized Aviation Service Operator (SASO) Agreement in which he would provide flight training to new pilots at the airport. He will be utilizing space currently being leased by the FBO. Staff recommends approval.
h. Consider approval and acceptance of the FAA AIP 39 Grant for $21,909.
BACKGROUND and RECOMMENDATION: The AIP 39 Grant for $21,909 is 100% funded by the FAA. The funds are for concession relief at the airport due to the impact of the coronavirus pandemic. The funds are part of the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA Act) funds appropriated for SGU. Staff recommends approval.
i. Consider approval and acceptance of the FAA AIP 38 Grant for $1,346,696.
BACKGROUND and RECOMMENDATION: The AIP 38 Grant for $1,346,696 is 100% funded by the FAA. The funds are for operations and maintenance at the airport. The funds are part of the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSA Act) funds appropriated for SGU. Staff recommends approval.
j. Consider approval to continue sponsorship of the Downtown Farmer's Market event for Modern Farm & Artisan Co-op on Saturday mornings beginning May 22, 2021, through October 30, 2021, with a holiday market on December 11, 2021.
BACKGROUND and RECOMMENDATION: This annual/seasonal event is held at Ancestor Square on Saturday mornings between 9:00 a.m. - Noon, and one Holiday Market on Dec 11 between 1 p.m. - 5 p.m. The sponsorship request includes: 1) Fee waiver for the Special Event Permit Fee ($150/day), 2) Fee waiver for the Sub-License Fees ($5 each). Staff recommends approval of this sponsorship request, with the conditions they create temporary ADA parking for the two (2) stalls that will be occupied by vendor booths and cancel the markets on 9/18/21 and 10/2/21 for IRONMAN and St. George Marathon, leaving a total of 23 market days.
2. Public hearing and consideration of a resolution to review and approve amendments to the Fiscal Year 2020-21 Budget.
BACKGROUND and RECOMMENDATION: City departments have submitted requests for adjustments to their fiscal year 2020-21 department budgets per their review and forecasts based upon completion of approximately 75% of the fiscal year. Budget opening requests submitted consist primarily of increases in expenditures and revenues due to higher-than-anticipated program participation or product sales; project re-allocations; unforeseen emergencies; and new contractually- funded or grant-funded projects. Staff recommends taking public comment and approval of the resolution.
3. Consider approval of daytime irrigation restrictions for those that irrigate with culinary water.
BACKGROUND and RECOMMENDATION: Generally, this request is made annually in May. However, given the drought conditions the state is in, the levels of the local reservoirs, the Water Service Department is requesting day time water restrictions for those that irrigate with culinary water. Staff is requesting that irrigation using culinary water be done between the hours of 8:00 pm - 8:00 am. It is recommended that customers complete watering before 4:00 am as this is the time of day the system sees the highest demand.
4. Consider approval of a resolution accepting the Municipal Wastewater Planning Program Self-Assessment.
BACKGROUND and RECOMMENDATION: The Utah Water Quality Board administers the Municipal Wastewater Planning Program. As part of the program, each wastewater treatment and collections entity is required to conduct a self-assessment of the condition of the wastewater system and the systems planning efforts. The self-assessment report is required to be adopted by the city council through a resolution. Staff recommends approval.
5. Consider approval of an ordinance changing the zoning from R-1-10 (Residential Single Family, 10,000 sq ft minimum lots) to PD-R (Planned Development Residential) on approximately 12.24 acres generally located on the on the northwest corner of Gap Canyon Parkway and Divario Canyon Drive known as Rilassante at Divario (Divario PA 17). Case No. 2021-ZC-028
BACKGROUND and RECOMMENDATION: The underlying general plan is HDR (High Density Residential) with adjacent zoning of R-1-10 (Residential Single Family, 10,000 sq ft minimum lots) and PD-R (Planned Development Residential). The Planning Commission held a public hearing and recommended approval.
6. Consider approval of an ordinance changing the zoning from R-1-10 (Single Family Residential, 10,000 sq ft lot size) to PD-R (Planned Development Residential) on approximately 24.11 acres located on the west side of the intersection of Canyon View Drive and Gap Canyon Parkway known as Rilassante at Divario (PA 3). Case No. 2020-ZC-040
BACKGROUND and RECOMMENDATION: This property is part of the Divario (fka The Lakes) specifically Planning Area 3. Divario has a development agreement associated with it as well. The applicant brought forward a zone change in November of 2020 which was denied. The applicant is now proposing some changes to the proposed development for City Council's approval. The Planning Commission recommended approval of the original proposal.
7. Consider approval of an ordinance amending the Desert Color Planned Development Residential zone for a new phase in the Desert Color Resort area to be known as Desert Color Resort Phase 5 on approximately 12.03 acres located north-west of the existing community center and west of the lagoon. Case No. 2021-ZCA-025
BACKGROUND and RECOMMENDATION: The proposal is for a multi-family and single-family project within the Desert Color development consisting of 27 single-family and 26 townhomes units with a density of 4.4 dwelling units per acre. The underlying general plan is TC (Town Center). The Planning Commission recommended approval of the application.
8. Consider approval of an ordinance amending the Dinosaur Crossing Planned Development Commercial zone in order to amend the master sign plan. The project is known as Dinosaur Crossing PD master sign plan amendment on approximately 26.89 acres located at approximately 639 South Mall Drive. Case No. 2021-ZCA-026
BACKGROUND and RECOMMENDATION: The applicant is proposing to amend the master sign plan at the Dinosaur Crossing PD in order to remove one permitted monument sign in order to increase the size of another monument sign. The Planning Commission recommended approval of the application. The Planning Commission held a public hearing and recommended approval.
9. Consideration of a resolution to either accept or deny a Petition for Annexation for approximately 174 acres located west of Dixie Drive on the former Burt Burgess property.
BACKGROUND and RECOMMENDATION: This property is west of the recent annexations at approximately 1600 South Dixie Drive. The property owner has agreed to dedicate the portion of the future Gap Canyon Parkway that is located on their property as a condition of annexation. If the representative of the property owner agrees on the record to the condition of the dedication of the alignment of Gap Canyon Parkway to the City as a condition of annexation, staff recommends approval.
10. Consider approval of a resolution to waive the notice requirement and terminating the Interlocal Cooperation Agreement with Washington County regarding the 2019 election services.
BACKGROUND and RECOMMENDATION: On May 2, 2019, the City of St. George and Washington County entered into an agreement titled: Interlocal Cooperation Agreement Regarding Election Services. The County and City have agreed to waive the notice requirement for terminating the Interlocal Cooperation Agreement Regarding Election Services signed in 2019 and approve a new Interlocal Agreement for election services in its place. Staff recommends approval.
11. Consider approval of a resolution entering into an Interlocal Agreement with Washington County regarding election services.
BACKGROUND and RECOMMENDATION: Washington County would like to enter into an interlocal agreement regarding election services for the 2021 elections. Over the past several years, the City has contracted with the County for election services. Staff recommends approval.
12. Consider approval of a resolution adopting the first amended interlocal agreement supporting the renewed Desert Tortoise Incidental Take Permit issued to Washington County.
BACKGROUND and RECOMMENDATION: Washington County applied to renew the 1996 Permit in 2018 and the USFWS is in the final stages of processing the renewal application. If issued, the renewal permit (2021 Permit) will last for 25 years unless renewed or amended. Staff recommends approval.
13. Appointments to Boards and Commissions of the City.

15. Request a closed session to discuss litigation, property acquisition or sale or the character and professional competence or physical or mental health of an individual.
