NOTICE OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF ST. GEORGE, WASHINGTON COUNTY, UTAH Public Notice Public notice is hereby given that the City Council of the City of St. George, Washington County, Utah, will hold an electronic regular meeting at the St. George City Offices located at 175 East 200 North, St. George, Utah, on Thursday, April 1, 2021 commencing at 5:00 p.m. The meeting will also be broadcast via Zoom. The agenda for the meeting is as follows: Call to Order Invocation Flag Salute 1. Consent Calendar. a. Consider approval to purchase eight (8) 2021 Ford Police Interceptors from Larry H. Miller Ford. BACKGROUND and RECOMMENDATION: The Police Department currently has eight (8) Interceptors that are in need of replacement. The vehicles that are due for replacement are experiencing mechanical issues due to years in service and mileage. These issues are causing the vehicles to be sent for service on a reoccurring basis and the cost of repairs is excessive in comparison to the vehicles' worth, which issues also cause some safety concerns for the drivers using the vehicles. The vehicles would be purchased using a State Contract with Larry H. Miller. These vehicle purchases would replace eight (8) existing police emergency vehicles. Staff recommends approval in the amount of $307,647.12. b. Consider award of bid for 750 Primary Wire from Irby in the amount of $147,051.75. BACKGROUND and RECOMMENDATION: Two bids were received, one from Irby and one from Anixter. These are the only 2 companies approved for our system. This is for work being done on the Ledges 3rd Circuit. Staff recommends approval. c. Consider approval of a Memorandum of Understanding between UDOT, the City of St. George and QRS Development to prepare plans, specifications and estimates of costs for a proposed grade separated service interchange along State Route 18 located at or near milepost 7 to provide access to the proposed The Trails development. BACKGROUND and RECOMMENDATION: This MOU requires QRS to work with UDOT to develop plans, specifications, and cost estimates for the construction of an interchange at The Trails development south of The Ledges on SR 18. The only City obligation is to review plans for compliance with City ordinances and requirements in a timely manner. Staff recommends approval. d. Consider approval of a Lease Agreement between the City of St. George and Oakes Family Auto, LLC for commercial space located at 176 West St. George Blvd. BACKGROUND and RECOMMENDATION: This Lease Agreement outlines the terms for Oakes Family Auto, LLC to lease commercial space located on city-owned property at 176 West St. George Blvd. The lease term expires on September 30, 2021 and shall continue thereafter on a month-to-month basis until either party delivers to the other a written notice of termination. Staff recommends approval. e. Consider approval of an Airline Use and Lease Agreement between Skywest and St. George City. BACKGROUND and RECOMMENDATION: The previous agreement with Skywest for the use of the terminal building has expired and needs to be renewed. This new agreement with Skywest has been updated. The area in the terminal building being leased by Skywest has slightly increase compared to the previous agreement. Staff recommends approval. f. Consider approval of a new Hangar Lease with Dawson Development, LLC on Lot 51A at the Airport. BACKGROUND and RECOMMENDATION: Dawson Development, LLC (Brandon Dawson) is requesting to build a new hangar on lot 51A at the airport, which requires a hangar lease with the City. Staff recommends approval. g. Consider approval of a new Hangar Lease with TMC Utah 10, LLC on Lot 58F at the Airport. BACKGROUND and RECOMMENDATION: The existing hangar on lot 58F was sold to TMC Utah 10, LLC (Travis Korella) by the previous owner. This request is for a new hangar lease with Mr. Korella. Staff recommends approval. h. Consider approval of the minutes from the meetings held on January 19, 2021; February 4, 2021; February 8, 2021; February 10, 2021; February 11, 2021; February 18, 2021; February 25, 2021 and March 4, 2021. 2. Consider approval of a resolution supporting Utah's Dixie. BACKGROUND and RECOMMENDATION: The Mayor and Council wish to show their support of the 'Dixie' name by signing this resolution. 3. Consider approval of an Interlocal Agreement with the State of Utah (UDOT) for the provision of a bus shuttle service from St. George to Springdale ('Zion Shuttle'). BACKGROUND and RECOMMENDATION: This agreement provides the City $15 million in exchange for the operation of a bus route from St. George to Springdale ('Zion Shuttle') for a period of ten years. Staff recommends approval. 4. Consider approval of an Interlocal Agreement with Washington County for the provision of a bus shuttle service from St. George to Springdale ('Zion Shuttle'). BACKGROUND and RECOMMENDATION: This Interlocal Agreement provides a financial 'backstop' of County transit and TRT tax revenues for a period of ten years in exchange for St. George operating the St. George to Springdale bus system. Staff recommends approval. 5. Public hearing and approval of the Consolidated Annual Performance Evaluation Report (CAPER) for the 2019 program year of the Community Development Block Grant (CDBG). BACKGROUND and RECOMMENDATION: On or about April 2, 2021, the City submitted a Consolidated Annual Performance Evaluation Report (CAPER), for the 2019 Program Year, to the U.S. Department of Housing & Urban Development (HUD). The CAPER is a financial and public benefit summary of the City's use and expenditures of federal Community Development Block Grant (CDBG) funds. The report evaluates how the City used these federal funds during the past program year to carry out priorities identified in the City's adopted 2019 Annual Action Plan. Staff recommends approval. 6. Public hearing and consideration of a subdivision amendment for Stone Cliff Phase 8 Partial Amendment A (Lots 803 & 804) by merging the two lots together into one lot and vacate the public utility easement located on the common lot line. BACKGROUND and RECOMMENDATION: This request is to consider merging to subdivision lots together into one lot and vacate the public utilities and drainage easement on the common lot line of Lots 803 & 804 of Stone Cliff Phase 8. This is located at 1849 Cliff Point Drive in the Stone Cliff Development; zoning is PD-R. The Joint Utilities Commission recommended approval. 7. Consider approval of a conditional use permit (CUP) to amend an existing short-term rental/bed and breakfast to allow for construction of an on-site manager suite located at 217 North 100 West. BACKGROUND and RECOMMENDATION: This property has a landmark site designation as the Woolley Foster Home. The property was previously called the Seven Wives Inn and is now known as the Mulberry Inn (REF 2020-CUP-005). Currently the facility operates as a short-term rental/bed and breakfast with an owner-manager living in one of seven guestrooms. The applicant would like to convert part of the garage into a manager suite allowing all seven rooms to be guest occupied and the potential for management to be hired out and not owner managed. The Planning Commission recommended approval. 8. Consider approval of an ordinance amending the Desert Color Planned Development Residential (PD-R) zone to allow 20 new multi-family units to be known as Desert Color Resort Phase 2D on approximately 1.15 acres generally located east of I-15 and south of Southern Parkway. Case No. 2021-ZCA-024 BACKGROUND and RECOMMENDATION: Phase 2D of Desert Color Resort was approved in May of 2019. That approval included 13 townhome units. They are now proposing to increase the number of units from 13 to 20 which will increase the density on this parcel to 17.39 units per acre. The Planning Commission recommended approval. 9. Consider approval of the preliminary plat for Desert Color Resort Phase 2D, a 20-lot residential subdivision located at the intersection of Marilla Drive and Periwinkle Lane within the Desert Color Development. BACKGROUND and RECOMMENDATION: This proposed preliminary plat is located at the intersection of Marilla Drive and Periwinkle Lane within the Desert Color Development. The Planning Commission recommended approval. 10. Consider approval of the preliminary plat for Desert Color Resort Phase 5, a 57-lot residential subdivision located within the Desert Color development along Lagoon Parkway just west of the intersection of Scarlet Hill Drive. BACKGROUND and RECOMMENDATION: This proposed preliminary plat is located within the Desert Color development along Lagoon Parkway just west of the intersection of Scarlet Hill Drive. The Planning Commission recommended approval. 11. Consider approval of the preliminary plat for Abberly Farms, a 6-lot residential subdivision located along Seegmiller Drive (3220 East) just east of 3210 East. BACKGROUND and RECOMMENDATION: This proposed preliminary plat is located along Seegmiller Drive (3220 East) just east of 3210 East. The Planning Commission recommended approval. 12. Consider approval of the preliminary plat for Webb Acres, a 49-lot residential subdivision located at approximately Seegmiller Drive and 3330 East. BACKGROUND and RECOMMENDATION: This proposed preliminary plat is located at approximately Seegmiller Drive and 3330 East. The Planning Commission recommended approval. 13. Consider approval of a resolution declaring the intent to consider adjusting a common municipal boundary line with Washington City. BACKGROUND and RECOMMENDATION: The City Recorder's office received a request to adjust the boundary line with Washington City southeast of the intersection at 3000 East and Mall Drive. The purpose of the adjustment is to align boundaries of adjoining properties with the new boundary which alignment will more easily facilitate development and reconstruction of future roads and utility infrastructure without creating islands of land within the boundaries of the City. Staff recommends approval. 14. Consider approval of an ordinance amending certain impact fees for building permits and final plats pertaining to the 2021 Washington County Habitat Conservation Plan. BACKGROUND and RECOMMENDATION: Per the 1996 Washington County Habitat Conservation Plan, the City of St. George (the 'City') was required to collect impact fees consisting of $250 per acre of property being developed and 0.2% of the estimated construction costs which the City has been collecting on building permits and final plats. The 2021 Amended HCP has reduced the impact fees by eliminating the $250/acre cost for final plats and 2% (.002) of Valuation impact fee to continue to be collected for building permits. Staff recommends approval. 15. Appointments to Boards and Commissions of the City. 16. Reports from Mayor, Councilmembers, and City Manager. 17.
