During and following this comment period, the Planning Division will evaluate the proposal against the applicable zoning standards, taking into consideration public comments as they relate to the standards, and develop a recommendation for the Planning Commission. This is a list of active projects open for public comment, the list is updated bi-weekly. 810 EAST 800 SOUTH - ZONING MAP AND MASTER PLAN AMENDMENTS Stanford Bell of Altus Development Group has submitted applications for a zoning map amendment and a master plan amendment for the subject property. The site is approximately 6,970 square feet. The applications are to change the zone of the property from R-2 (Single and Two-Family Residential) to CB (Community Business) and the master plan designation from Low Density Residential to Community Commercial. The property is located on the south side of 800 South between 800 East and 900 East. It is just to the west of the Smith's grocery store. The property is currently vacant. The applicant anticipates developing the site with a two-story building with commercial on the first floor and residential units on the second floor. Parking would be located to the rear. The property and associated seven multi-family buildings have frontage on both Orange Street and North Temple. The developer is requesting an increase to the 5' maximum front yard setback on Orange Street for 'Building D' in the development, due to the location of a high voltage power line which requires a 25 setback for safety. The building would be setback approximately 26 to 30 from Orange Street. The modification to the setback requires that the building by reviewed through the Design Review process. Additionally, any development in the TSA zone requires that developments meet a certain number of development guidelines. The applicant has submitted plans and scoring for a 'TSA Development Score Review' and their score is being verified by City Planning staff. If the development receives enough points by meeting enough guidelines, the development can be submitted for building permits. If any buildings in the development do not receive enough points, the developer can revise their plans to receive enough points or proceed to the Planning Commission for a 'Design Review' of the building(s). The proposed text amendments would change the use permissions and standards for child daycare in all zoning districts. The amendments would affect sections 21A.36.130 'Child Daycare', 21A.33 'Land Use Tables', and 21A.62.040 'Definitions of Terms'. The proposed project is for a 104-unit apartment building on a 0.50 acre (21,800 square feet) parcel in the CG - General Commercial zoning District. The proposed building will include 5 levels of apartments above a 3-level concrete parking structure, with one of the levels underground. The apartments will be a mix 1 bedroom, 2 bedroom and studio types. The covered parking will provide 104 parking stalls total. An open deck courtyard for residents is part of the design. The CG - General Commercial Zoning District limits buildings to 60-feet in height. However, taller buildings in excess of 60-feet but not more than 90-feet in height may be approved through the Design Review process. The proposed building will be 75-feet tall. The applicant is going through the Design Review process to request an additional 15-feet of building height over the 60-feet allowed by right in the zoning district. Specifically, the applicant is requesting an increase in the allowable building height from 60 feet to 79 feet through the Design Review and balcony encroachments into the required front yard through the Planned Development. The proposal would rezone the subject property from RO (Residential Office) to D-3 (Downtown Warehouse/Residential) and amend the Central Community Future Land Use Map from Residential/Office Mixed Use to High Mixed Use. The proposed Master Plan amendment to High Mixed Use and rezone to D-3 is intended to allow retail service uses on the property, in addition to office use. The subject property is located in the G-MU Gateway-Mixed Use District. The proposal is to construct a new mixed-use building with an active mix of retail, tenant amenity space, and live/work studios on the ground floor, and residential and common space on the upper floors. The proposal includes 7 stories and will include 203 residential units comprised of studios, 1-bedroom, 2-bedroom and 3-bedroom units. The applicant is requesting a Design Review by the Planning Commission to allow for the use of building materials which are allowed only through the design review process. The applicant is requesting the use of a fiber-cement cladding in both a lap and panel application on levels 3 through 7. The G-MU Gateway-Mixed Use District also requires all new construction of principal buildings be approved only as a planned development. Due to this requirement, the applicant is also requesting planned development approval for the proposed development. The applicant is not seeking alleviation from zoning standards as part of the Planned Development application. This Design Review and Planned Development requires review and approval by Planning Commission prior to any changes on the site being made. Per section 21A.40.090.E of the Zoning Ordinance, all monopoles taller than 60 feet in the M-1 zone require Conditional Use approval. This project was previously reviewed under PLNPCM2019-00542 and was approved in September 2019. However, Conditional Use approvals expire after one year. This request is located within the Inland Port Overlay and will be reviewed by the City's Planning Commission.
