The Committee addressed the need for new roads. Lambert Dutson, Dallin Christensen (representing Tom Nielson) both stated that the owners of the property being annexed would be using private lanes to access their buildings and the Town would not be responsible for any new roads.
After discussion, the Oak City Planning and Zoning Committee recommend the annexation proposal as presented to them in the meeting October 15, 2020; Sharla Anderson Planning and Zoning Chairperson.
Will have the Town's Attorney look at the Tom Nielson Annexation Map.

E. Discuss Possibility of Obtaining a Town Water Connection at their Farm/Clarke and Monica Christensen.
Clarke explained that he is planning on building a house on his farm North of Town and wondered if the Town would sell him an outside water connection. He also stated that Craig Schmutz wants to build in the area and he would like the use of a water connection also. Dave pointed out that if a water connection were granted, it would be considered an outside water connection which is not allowed at this time and would run the risk of being shut off if the Town had a water shortage. Dave suggested looking at what the wording says on the Utah Constitutional Amendment D, that is up for a vote on November 3rd, to see what the changes are for delivering water outside of Town boundaries. If it were annexed, the water connection would not be an outside connection. Will look into this.
Marion Ray Anderson asked about what the Fire Codes are for a private lane? Would this effect the water connection? He also wondered when the Town will be forced to go with a sewer system? The Council wasn't sure on this.
Stewart went over some general water connection info on the Town. Back in 2014, there was a study done on the water system. That study showed the Town had about 250 current water connections and the Town could handle about 400 total connection with current water supply.
The consideration of the Clarke and Monica Christensen water connection will be placed on the Agenda for the November Town Board Meeting.
F. Discuss GIS Mapping Program Presented by Jones and DeMille Engineering. The Mayor passed out copies of the Program cost breakdown to the Council Members and gave a general explanation of the Program. He stated that the Maps would include gas lines, roads, ditches and could include other items. The bid for the Program was $3,550 if the Map included only water and power. Such a Program would help more if there could be overlying layers showing future roads and other items. If roads were added to the Map, it would cost an additional $1,350. The Town could just get the basic Map first and add additional components later. If the entire Program were implemented now, it would cost about $9,000 but this would not include software. Licenses for viewing and updating would be another $750. The Council Members would have to be responsible to keep the Map updated. After some discussion, it was decided that the Mayor should check with Jones and DeMille to clarify what software and other miscellaneous costs would be. Dave also wondered if Jones and DeMille might be willing to mark a current Map with the items that they had mapped out years ago. This item will be placed on the Agenda for further discussion at the November Town Board Meeting.
G. Review the Consolidated Fee Schedule. The Mayor gave the Council Members a copy of the Current Consolidated Fee Schedule. He explained that by the end of the year, he would like the Council to go through the Schedule and update it. He feels the Town is a little behind most communities on the cost of a burial plot, even doubling the cost would not put the price of a plot over most current plot cost for other communities in the County. He asked the Council Members to look through the Schedule, especially their own departments, and be ready to discuss this further at the November Town Board Meeting.
H. Public Comments. Geri Peterson Hoskins read a letter from the Peterson Family Trust, Denny Peterson, Trustee, to the Council. The subject of the letter was concerning the recommendations, from the Oak City Planning and Zoning Commission, on current proposed annexations. The concerns addressed in the letter were if there had been an inventory of water availability from planned future development of existing available land within the current city limits. An inventory of the present and future capacity of the Aquifer allotted to the City. Possible number of homes that could be built within current City limits and homes to be built on annexed land. The letter also asked if the Commission's proposals include looking at the power availability of possible development of land in the existing City limits and potential lots with the planned annexation.
Denny recommended that if the Planning Commission had not addressed these issues when making their proposals on the current annexations, that all proposed annexations be delayed until these issues could be addressed.
Stewart addressed the water availability issue by reminding everyone of what he had reported from the water Study done in 2014. According to that Study, the Town could and add sixteen water connections per year for the next twenty years
with current water supply. An Aquifer recharge study has been discussed and will be done soon.
As far as power, Dave explained the current power situation for the Town and that the Town has sufficient power except
during peak use. This is when the Town needs to buy extra power. The Town is looking at new power resources including buying into a small-scale nuclear power plant. This is about seven years out if it happens. He also explained that the Town is purchasing a back-up transformer for the sub-station.
There will be a public hearing on each of the proposed annexations and public comment can be given at those hearings and concerns addressed. The Town will be getting information from Jones and DeMille on the water issues. The Town doesn't want to grow to the point that it puts stress on power and water supplies so the Council is having these issues looked at.
I. Financial Report. The Financial Report was Read and Approved by Board Action. The Mayor had been contacted by one of the delinquent account owners who will try to have their account current by next month. He will contact all those who have received cut-off notices to try to work out payment arrangement. He pointed out that the Frontier Communication Account is delinquent but this won't be paid very soon as they are going through bankruptcy at this time.
The County will be donating some monies towards the cost of the Town's Clean-up Day so this will offset some of the costs there.
The payment that the Town just made to Jones and DeMille should be the last payment for the operating permit for the most recent water system upgrades.
J. Departmental Reports.
Monica Niles.
Will have DeAnn Steele, Oak City Town Treasurer, order new lights for the Park Pavilion. Will take the old ones to Shim.
Dallin Christensen.
Dallin's brother is an engineer and has noticed that the Town has not updated its road mileage which would give the Town much-needed revenue. Dallin will get this done.
There are grant monies available through the CARES Act for sidewalks along State Highways, which the Town's Main Street is. Will look to see if the Town could qualify for some of this money. Will look into what sidewalks need to be done along Main Street. Dallin has contact information for a Steve Nielson who can help with information on a sidewalk in Town that needs to be redone but a culvert needs to be put in. There is a newer section of sidewalk that needs to be redone due as it is very uneven. Will look at doing this in the Spring.
The Town dump truck had a bad battery. Replaced it.
Jeff Lyman, Oak City Cemetery Sexton, has had concerns with the loads that are placed on the Town's Truck when burial plots are dug and he is not sure that the replacement truck that Dallin is looking at will be big enough. Dallin will talk to Kim Nielson and get his input on this.
Dallin will be working on removing some volunteer trees.
Shim stated that there are a few small dumpsters at the Town's transfer station. He believes the Town is supposed to use these and the County will be the only ones using the larger dumpsters. More information will be coming from the County.
Stewart Rowley.
Will get with Dan Hawley, of Jones and DeMille, to get the water information.
Stewart will look at what the expenditure cap is on the water project, new pipe from the old post office to the
cemetery. Will be looking at what monies the Town could get as a 0% loan or low interest loan. The Mayor
suggested boring or using a missile to run water connections from the newer water line on the West side of Main Street between First and Second South to the houses on the East side of that section of Main Street. Stewart will be talking to Jon Christensen , of the State Road Department, on this also.
The Mayor mentioned that thinks things are okay between Mason Anderson and Taylor Shipley on the water for Taylor's new home but Dave will need to look at the power situation.
Dave Steele.
Flowell Electric is in the process of upgrading the power line on Main Street.
There were a couple of power outages during the month.
Chrissie's power upgrade is still being worked on.
Will be installing a power pole near 60 West 200 North (Bertha Jacobson).
The Carbon Free Project is forming a Limited Liability Company (LLC) to take it through the construction phase.
K. . Miscellaneous.
Mayor Callister.
Got the conduit underground from the main building to the shed at the City Yard. While he was there, Kevin Styler talked to him about the possibility of donating a large fuel tank to the Town. It is large enough that it would have to be contained. It is currently up to the City Yard. Dallin felt the Town could get along without it. Shim will talk to Kevin a little more about it and the Council will consider this.
Jeff Lyman would like the dirt that is piled up at the Cemetery moved to the borrow pit along the junk yard road. Shim will do this.
Stewart Rowley.
Stewart was concerned about a rumor he heard that someone is living in the home located at 115East Center (the old Molly Anderson home) without water or power being turned on. Dave stated that this was a rumor as there is power and water turned on there.
L. Adjournment.
Stewart moved, seconded by Monica, to adjourn. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Monica-Aye. Stewart-Aye.
The meeting adjourned at 9:15 p.m.
