DIVISION OF WATER QUALITY UTAH DEPARTMENT OF ENVIRONMENTAL QUALITY PUBLIC NOTICE OF RENEWAL OF UPDES PERMIT PURPOSE OF PUBLIC NOTICE The purpose of this public notice is to declare the state of Utah's intention to renew a Utah Pollutant Discharge Elimination System (UDPES) Permit under authority of the Utah Water Quality Act, Section 19-5-104 and 107, Utah Code Annotated 1953, as amended. Said 'permit' refers to UPDES Permit and the Fact Sheet and Statement of Basis (including the total maximum daily loads (TMDL's)) if applicable, as per Section 303 (d) of the Federal Clean Water Act (CWA). PERMIT INFORMATION PERMITTEE NAME: Hiawatha Coal Company, Inc. - Hiawatha Mine MAILING ADDRESS: PO Box 1240, Huntington, UT 84528 TELEPHONE NUMBER: 801-857-0399 FACILITY LOCATION: Near the Town of Hiawatha, Utah off State Hwy 122 UPDES PERMIT NO.: UT0023094 PERMITTED OUTFALLS: 001, 002, 003, 004, 006, 008, 009, 010, 011, 012, & 013 RECEIVING WATERS: Cedar Creek and Miller Creek BACKGROUND INFORMATION The Hiawatha Coal Company's Hiawatha Mine (Mine) is an inactive underground coal mine operation with Standard Industrial Classification 1222, for bituminous underground coal mining operations. The Mine is located near the town of Hiawatha, Utah in both Emery County and in neighboring Carbon County. The Mine currently has a total of 11 outfalls which are authorized to discharge under this UPDES permit. Discharge of mine water drains continuously via Outfall 001. A portion of that mine water from Outfall 001 is piped to Hiawatha for drinking water. The surplus drinking water that is not used is discharged from Outfall 002. The remaining discharge points, Outfalls 003 to 013, are either from sedimentation ponds that collect storm water, or other identified discharge points throughout the Mine facility. These remaining outfalls have not discharged in many years. This UPDES renewal permit will once again authorize discharges from the Mine during the next five years. PUBLIC COMMENTS Public comments are invited any time prior to the deadline of the close of business on December 10, 2020. After considering public comment the Director may execute the permit issuance, revise it or abandon it. The permit is available for public review at https://deq.utah.gov/public-notices-archive/water-quality-public-notices.
