Description/Agenda
Minutes of Oak City Planning and Zoning Commission Emergency Meeting held August 21, 2019 The meeting was held at the Oak City Town Hall located at 30 West Center beginning at 8:00 p.m. The following were in attendance: COMMISSION MEMBERS OTHERS Chairperson Charles Chamberlain Trevor Finlinson Member Tyler Finlinson Dallin Christensen Member Sharla Anderson Garth and Venice Finlinson Member Jacob Nielson Philip and Kathryn Burton Member Sam Nielson Secretary Karen K. Lovell The following agenda items were discussed: A. Invocation. The invocation was given by Tyler Finlinson. B. Adopt Agenda. Charles moved, seconded by Sharla, to adopt the Agenda as written. Roll Call Vote: Chairperson Chamberlain-Aye. Sharla-Aye. Jacob-Aye. Sam-Aye. C. Discuss Trevor Finlinson's Request to Rent out a Trailer Located at 80 West 200 South. In Oak City, Utah. Charles pointed out that it has been some time since the Planning and Zoning Commission has met and Trevor asked him about this issue sometime ago. He apologized that it had taken so long to get this discussion scheduled. Charles pointed out that the Planning and Zoning Commission is not a governing body. It is to look at issues and then make recommendations, to the Town Council, on those issues. When the Commission members were appointed, they were reminded to forget personal preferences and just do what is right for the community accord to ordinances. Therefore; he wanted to make sure that the decisions tonight were made based on what it right for the community according to ordinances and regulations. Charles stated that he had a party contact him, a past Planning and Zoning Commission Member, who had concerns about the trailer. He explained that when the trailer was originally put it, it was by a variance due to a hardship. The homeowner next to the trailer, Larry Densley, had parents that were invalids and needed him close. Therefore; a variance was allowed for the trailer to be located next to Larry as it didn't meet set back requirements and regulations but allowed Larry to be close to his parents. This variance was granted to Larry only for the duration of the use for his parents with the knowledge that as soon as that use was over, the trailer would be removed from the property. However; Larry's parents have passed away and so has Larry and the trailer was never moved. Therefore; when Trevor purchased the property, he inherited the trailer. Trevor wants to use the trailer and not have it just deteriorate so he was hoping to also get a variance to fix up the trailer and rent it out. Charles pointed out that the Town Code is very strict on trailers. It states that trailers are not allowed to be located in Town unless they are placed in a trailer court. The only trailers allowed outside of a trailer court were grand fathered in. Trevor's trailer meets part of the grand father clause but not all. The trailer has not been in continual use. It has been abandoned for years and is questionable as to stability and safety. It would not be insurable so Trevor would be liable if there were a fire or other disaster. Charles stated that he did not just take the reporting past Commission Member's word on the details of the variance on the trailer. He called past Mayor, Mike Anderson, and asked him what he remembered on the details of the variance and he agreed with the Commission member. The trailer was to be removed after Larry's parents no longer needed it. Therefore; Charles feels it is the Commission's responsibility to follow the ordinances on this and not allow its continued use unless, of course, Trevor wanted to move it and put it on its own separate piece of property, outside of Town limits, on a foundation. Trevor stated that the trailer is built to the same specifications as a mobile home, and he just wants to see it be fixed up and used rather than falling apart.. Charles asked the Burtons how they felt about the trailer issue as they are located next to the trailer. Philip stated that they are not happy with the idea of it being fixed up. They are closer to the trailer than Trevor and feel that it could be a hazard to them. Trevor stated that he talked to a past Oak City Town Council Member and they didn't remember of any agreement being made as far as the use of the trailer ending at some point. He wondered if the trailer couldn't be rented out or could he use it as a air B & B. Jake pointed out that there are some parties in Town which are in violation of the Town's ordinances and are no longer in compliance with variances, which is unfortunate but from this point on, he feels that the Town needs to make sure everyone is in compliance going forward. Trevor's trailer is in violation of many parts of the ordinances. Sam stated that if the Town says no to one however; they should say no to all. He mentioned a particular home that it out of compliance right now as it has become a multi-family dwelling. Charles pointed out that there are just too many issues with the trailer and it was never supposed to be used after Larry's parents passed away. Karen stated that she could look in the Minutes to see if she sees anything on the variance set up on the trailer. It was pointed out though that whatever ways decided, the trailer is no longer in compliance. Jake stated that a variance is granted when there are exceptional circumstances that warrant one. He didn't feel Trevor's situation merited one. It should probably be removed. Dallin Christensen felt that it wasn't really fair that Trevor couldn't fix up his trailer where there are others throughout Town that are not following Code. However; Dallin understood why the Commission needs to follow the Code strictly from now on. The Commission agreed that things have been done in the past that should not have been done or that should never have been allowed to continue after the variance no longer applied. Jake stated that the Town has codes. Are they right? If not, need to change them. If they are okay, need to uphold them. The entire Commission was in agreement that things needs to be consistent from now on. Sharla stated that the Commission must follow the Code from now on and if people aren't in compliance, they should be given notice to get in compliance. Charles suggested that Trevor could put wheels on the trailer and paint it and he would, most likely, sell it. Charles asked for a vote of the Commission on the Trevor Finlinson trailer issue Charles moved, seconded by Jake, to recommend that the Oak City Town Board reject Trevor Finlinson's request to rent the trailer he owns at 80 West 200 South. Roll Call Vote: Chairperson Chamberlain-Aye. Jake-Aye. Sharla-Aye. Sam-Aye. Tyler-Aye. Charles or Karen will inform the Town Council of this decision at their September Town Board Meeting. D. Discuss Garth and Venice Finlinson's Annexation Proposal. Garth and Venice presented a map showing the location of the property. It is a 6.2 piece and if it was annexed, it would 'square up' the area. They understood that it was adjacent to the Town limits. It was stated that they would need to have a right-of-way connected to the property. Garth explained that they already have a right-of-way. He also mentioned that there used to be a road across the property that went up to Rocky Ridge. He wasn't sure if that road was still there. He also explained that someone had built a fence across the property which he has concerns about. They are having a survey done on the property at this time and will then get a new map done. Charles mentioned that the main problem would be if the property is not adjacent to current Town limits. The Finlinsons will be checking into this and will get the needed paperwork to the Mayor. E Discuss Joseph and Angie Young Building Lot Approval. Karen thought that Charles had the information on this lot and Charles thought she had the information. Sam stated that the Mayor had mentioned the Lot to him but he had no information on its location or size. Therefore; the Commission did not discuss this item. As a side note, Sam mentioned that he has heard a rumor that a current home owner in Oak City Town was going to use some of his property to park three trailers on and put a bunch of stuff on the lot. He wondered if this is legal. It was felt that there was probably not much that could be done if they are just putting everything inside their own lot. Sam mentioned that this is just one of the things that are happening in Town and this is why the Commission needs to be consistent on sticking to the Code. F. Adjournment. Sharla moved, seconded by Jake, to adjourn. Roll Call Vote: Chairperson Chamberlain-Aye. Jake-Aye. Sharla-Aye. Tyler-Aye. Sam-Aye. The meeting adjourned at 9:30 p.m. Respectfully submitted __________________________________ Karen K.
