Date: July 16, 2020 THE SALT LAKE VALLEY LAW ENFORCEMENT SERVICE AREA BOARD OF TRUSTEES ('BOARD') MET ON THURSDAY, JULY 16TH, 2020 AT 10:00 AM. AS PROVIDED IN AN EXECUTIVE ORDER ISSUED BY GOVERNOR HERBERT ON MARCH 18, 2020, THE BOARD HELD THE MEETING AS AN ELECTRONIC MEETING WITHOUT AN ANCHOR LOCATION. THE PUBLIC WAS NOTIFIED THAT THEY MAY JOIN THE OPEN PORTIONS OF THE MEETING BY CALLING 1-669 900-9128 AND ENTERING MEETING ID 93444745584# AND PASSWORD 349989#. THE PUBLIC WAS ALLOWED TO LISTEN TO ALL OPEN PORTIONS OF THE MEETING. USING ZOOM TECHNOLOGY, BOARD MEMBERS AND PERSONS PARTICIPATING BY PHONE WERE ABLE TO HEAR ALL DISCUSSIONS. Present: Excused: Attended Via Phone: TRUSTEE APOLLO PAZELL, COPPERTON TRUSTEE SHIREEN GHORBANI, SALT LAKE COUNTY TRUSTEE JIM BRADLEY, SALT LAKE COUNTY TRUSTEE DAVID BREMS, EMIGRATION CANYON TRUSTEE PAULINA FLINT, WHITE CITY TRUSTEE ALAN PETERSON, KEARNS TRUSTEE STEVE PROKOPIS, MAGNA TRUSTEE CAROLYN KEIGLEY, BRIGHTON TRUSTEE MAX BURDICK, SALT LAKE COUNTY ALSO PRESENT: CHIEF OF POLICE JASON MAZURAN, UPD CHIEF OF POLICE UNDERSHERIFF JAKE PETERSEN, SALT LAKE COUNTY UNDERSHERIFF FRANK NAKAMURA, SLVLESA DISTRICT ADMINISTRATOR/SLVLESA LEGAL COUNSEL LISA DUDLEY, SLVLESA CHIEF FINANCIAL OFFICER RICHARD MOON, SLVLESA TREASURER MARCIE KAY, SLVLESA CLERK Item #1-Call to Order. Jim Bradley called the meeting to order. Item #2-Disclosure of Conflicts of Interest Action Requested: Identify Conflicts, if any Discussion: Trustee Bradley asked if there were any conflicts of interest. None were identified. Item #3-Public Comment: Trustee Bradley asked if anyone was present who wished to give public comment to the Board. The SLVLESA clerk, who monitored the Zoom meeting, indicated there was no one from the public calling in to make a comment. Public comment was closed. Item #4-Present Second Quarter Report, monthly expenditures and other financial information. Action Requested: None Discussion: Richard Moon presented the check register for the month of June. He said there were payments by check to EDA Architects for $2,800, the Utah State Bar for $425 and the UPD for $1,394,924. He asked if there were any questions from the Board about the check register. There were no questions. Item #5-Discuss Directing the Lobbyist Retained by the UPD to Work with the Utah Legislature to Modify Tax Levy Legislation. Action Requested: None Discussion: Frank Nakamura and Lisa Dudley presented the discussion about retaining a lobbyist to work with the 2021 Legislature. He said the UPD has an on-going contract with R & R Partners to provide lobbying services as a shared service. Under the contract, the UPD pays a monthly retainer. He introduced Brittany Karzen, from R & R Partners, who will lead the SLVLESA lobbying efforts. He said section 17B-1-1002 of the Utah Code, a copy of which was sent to the Board members, provides in part, that the tax rate a law enforcement may levy cannot exceed .0023. The certified tax rate adopted by the SLVLESA Board of Trustees on June 18, 2020 is .002254. Although the certified tax rate was expected to increase in 2020 based on the increase in budgeted property tax revenues of 3%, the amount of increase in the certified rate was unexpected. Lisa Dudley explained that the Utah State Tax Commission issued a ruling this year in favor of Kennecott reducing its assessed valuation by $650 million. This reduction in centrally assessed valuation results in an unexpected increase in the certified tax rate in order to maintain the same level of budgeted property tax revenues. Frank Nakamura said that presently, SLVLESA may increase budgeted property tax revenues by approximately 2% before it is limited by the statutory ceiling. He said if SLVLESA needs to increase budgeted property tax revenues in the future, the statutory ceiling must be modified. Further, since the tax rate changes based on assessed valuation, a decrease in centrally assessed valuation, like what occurred this year with Kennecott, would place SLVLESA in a vulnerable situation in the future if the tax ceiling is not modified. Although SLVLESA is a member of the Utah Association of Special Districts, the Association has indicated that they lobby for matters that impact Utah special districts generally. The Association will provide support for a legislative modification in the tax levy maximum but suggests that it would be more effective if SLVLESA use its lobbyist who will focus on working with the Legislature to make the modification. The modification would also benefit the Unified Fire Authority. He would need to contact UFA to see if they would possibly join SLVLESA in the effort. He said if SLVLESA wants to pursue a statutory change, it needs to start soon. He stated R & R Partners needs time to do what is necessary to effectuate the modification. The work would be performed under the existing contract between R & R Partners and the UPD. Trustee Max Burdick motioned to go forward with retaining the lobbyist. Trustee David Brems seconded the motion. All voted in favor; none opposed. The motion passed. Item #6-Present Financial Model for SLVLESA and Discuss Budgeted Revenues for Calendar Year 2021. Action Requested: None Discussion: Lance Brown presented his financial model to the Board. He referenced his electronic presentation and discussed incorporating the UPD budgeted expenditures for the upcoming year. After Lance Brown's presentation, the Board discussed whether to consider levying a tax rate that exceeds its certified tax rate for calendar year 2021. The Board was asked to check with their respective councils to see if they want to increase budgeted property tax revenues for calendar year 2021 by no more than 2%. Trustee Bradley said he did not think it was a good time to levy a tax rate that exceeds its certified tax rate if SLVLESA's fund balance can absorb the costs. He recognized that in later years, there may be a need to increase property tax revenues by a larger percentage than what has historically been done to replenish the fund balance. Board member Flint said there were too many unknowns on the costs of law enforcement services such as the impact of Taylorsville leaving the UPD and she does not think it is a good time to talk about levying a higher tax rate. Trustee Peterson asked if Frank Nakamura would be willing to be on the agenda for the Kearns council to discuss the status of the SLVLESA finances. Frank Nakamura said he would. Trustee Paulina Flint also said she would like to put Frank Nakamura on the White City council agenda to discuss the 2% increase in budgeted property tax revenue. Frank Nakamura said he would like to get started in August on the truth-in-taxation process if the Board intends to levy a tax rate above its certified tax rate so he is not scrambling like last year to meet the strict timelines of the truth-in taxation process. Item #7-Report by Under-Sheriff Jacob Petersen. Action Requested: None Discussion: Under-Sheriff Petersen reported that there was a protest recently, but it went peacefully. He said they had planned for it to be larger than it was. He said that they over-planned and that is always the goal. He asked if the Board had any questions and they did not. Item #8-Approval of Minutes for the June 18, 2020 meeting. Action Required: Motion and Vote. Discussion: Trustee Flint motioned to approve the minutes from the June 18, 2020 meeting. Trustee Brems seconded the motion. All voted in favor; none opposed. The minutes were approved. Item #9-Adjourn. Trustee Bradley adjourned the meeting.

The public will be allowed to listen to all open portions of the meeting. Public comment will be allowed during the Public Comment portion of the meeting which will start no sooner than 10:00 a.m. Board Members will participate by Zoom. The audio for the Board member will be amplified so that other Board members and persons present at the meeting will be able to hear all discussions.
