3. Discussion/action on setting Public Hearing for zoning map amendment for distribution warehouse by Gardner Batt at approximately 700 North 1800 West.
Staff introduced this item as a zoning map amendment from A-1 to Commercial C-3P for a warehouse. The developer appeared electronically and described the warehouse concept. Staff requested a Public Hearing which was scheduled for the next meeting. The Municipal Code requires a Concept Plan for any zoning map amendment. Staff informed the developer that the Concept Plan is due by August 3, 2020, so we can publish the required notice in the newspaper.
Motion by Vice Chair Meyerhoffer to set a Public Hearing for a Zoning Map Amendment for a distribution warehouse. Seconded by Mr. Schofield. All voted in favor of the motion.
4. Discussion/action on Ordinance adopting MS County Estates Subdivision at 1119 South 1200 West by Joe Marsh.
Last month the Commission tabled this Subdivision in order to reduce the units to comply with the access limits and Fire Marshal. This property was Zoned R-4 by Weber County in the 1980s for multi-family. This zone has continued since Marriott-Slaterville City has been established.
The Commission discovered last month that the proposed 22 lots exceed the 20 unit limit and as such requires a second access. The developer has reduced the Subdivision to 19 units, and added additional parking requested by the Commission. The Commission also requested the Fire Marshal review the Subdivision.
Dave Reed, Fire Marshal, addressed the Commission and said that it conforms to the code requirements applied by the Weber Fire District. There was a discussion about changing the traffic flow to allow for fire truck turn around and that may impact some parking stalls. Staff and the developer will work this out.
Motion by Vice Chair Meyerhoffer to recommend that the City Council approve the Site Plan and Subdivision Applications subject to compliance with the following:
1. Compliance with staff and affected entity requirements.
2. Compliance with requirements of the City Engineer.
3. Development conform to Municipal Code and Public Works standards.
4. Development Agreement to satisfaction of City Attorney.
5. Comply with architecture, landscaping and screening standards.
6. Comply with Dark Sky Lighting and storm water regulations.
Motion seconded by Mr. Tobias. Vote called and all were in favor, none opposed.
5. Discussion/action on Site Plan for Republic Services at 798 West 1700 South by Debbie Green.
Commissioner Schofield disclosed that he lives adjacent to this site and asked about whether a conflict of interest exists. Staff questioned Mr. Schofield if he is financially benefitting from this development or there is bias. Mr. Schofield responded no. The Commission responded that there is no conflict and Mr. Schofield may participate on this item.
Staff reported that this application was tabled at the last meeting pending the applicant being present. The property is zoned Manufacturing and the developer desires to construct a new shop and make other site plan modifications.
The project engineer reviewed the proposed site plan. Commissioners opted to require an eight (8) foot high cement stamped decorative fence along the west boarder to mitigate the adjoining residential uses.
Motion by Vice Chair Meyerhoffer to approve the Site Plan subject to the Staff Report and the following stipulations:
1. Compliance with affected entity and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Construction to comply with all required architecture, landscaping and screening regulations.
4. Architectural detail showing earth-tone building materials and colors. Landscape plan to conform to code.
5. Access to main building will be from the south rear entrance only (disregard the north entrance).
6. Development conform to Municipal Code requirements and any Ogden City requirements.
7. Compliance with storm water requirements and new LID standards.
8. All signs to conform to Sign Ordinance.
9. Comply with Dark Sky Lighting ordinance.
10. Dumpster located with gate.
11. Dedication of water shares for secondary system.
12. Construction of an eight (8) foot perimeter fence as coordinated by City Staff and developer.
Motion seconded by Mr. Schofield. Vote called with all in favor, none opposed.
6. Discussion/action on Subdivision Amendment by Lazy Acres at 2475 West Pioneer Road.
This property is zoned A-1 and Jonathan Pocock, developer, is requesting a lot line adjustment between Lot 6-R and Lot 7-R.
Staff presented the realignment of the lot line between Lots 6-R and 7-R.
Motion by Mr. Pitcher to approve the 1st Amendment to the Lazy Acres Subdivision consisting of this lot line adjustment subject to the Staff Report. Motion seconded by Mr. Tobias. Vote called with all in favor, none opposed.
7. Discussion/action on Site Plan for minor lot subdivision by Alan Brown at 2063 West Pioneer Road.
This property is zoned A-1 and the developer proposes a minor lot subdivision. The proposed residential use conforms to the General Plan. Staff briefly reviewed the proposed subdivision consisting of two (2) lots on an existing road with existing utilities.
Motion by Vice Chair Meyerhoffer that we approve this minor lot subdivision subject to the Staff Report and the following:
1. Compliance with staff and affected entity requirements.
2. Compliance with requirements of the City Engineer.
3. Development conform to Municipal Code requirements and Public Work standards.
4. Development Agreement to satisfaction of City Attorney.
5. Comply with Dark Sky Lighting and storm water regulations.
6. Provide adequate water shares to Special District.
7. Deferral agreement for public improvements.
Seconded by Mr. Hunsaker. Vote called with all in favor, none opposed.
8. Discussion/action on Ordinance for Streetscape referred back by City Council.
Staff reviewed the Streetscape Ordinance which was referred back to the Planning Commission by the City Council. The City Council likes the concept and wants the Planning Commission to modify the draft ordinance to resolve its concerns. Staff outlined the aspects of the ordinance that the City Council likes and presented information from the American Planning Association for model street design concepts. Staff has created a new draft ordinance addressing concerns from the Planning Commission at its last meeting. These changes account for future road widening, reduced front setbacks rather than eliminating them, and creating standards. City Council is interested in development which slows down speeding traffic, improves access and aesthetics, and makes a safer walkable community.
Commissioners discussed the new draft and spoke favorably of some of the new changes. It was decided to think about the ordinance for another month. Mr. Schofield feels we can proceed with a favorable recommendation.
Motion by Vice Chair Meyerhoffer to table the ordinance for further discussion. Motion seconded by Mr. Pitcher. Vote called: 4 in favor and 1 opposed to tabling (Mr. Schofield). Ordinance is tabled until the next meeting.
9. Commission and staff follow-up.
Road projects were discussed including Pioneer Road which will soon be completed and the next phase is about ten (10) years out. The 1200 West and 700 South projects are in progress.
17th Street project is in process for application for corridor funds for acquisition over the next two (2) years with construction in approximately five (5) years.
10. Adjourn.
Meeting adjourned at 8:30 pm.
