The City is required by the state to update the storm water regulations and include Low Impact Development Standards by March 1, 2020. Staff has updated these regulations in conjunction wit the City Engineer to comply with the state mandate.
Public Comment:
No public comment was offered.
Chair Syme closed the Public Hearing and re-opened the Public Meeting by consensus.
5. Discussion/action on Public Hearing.
Mr. Morris reviewed the storm water regulations including a number of changes and the Low Impact Development Standards as part of Ordinance 2020-02. Staff addressed brief questions from the Commission. Vice Chair Meyerhoffer suggested including irrigation facilities as part of the access limitations. This change was made by consensus.
Motion by Vice-chair Meyerhoffer to recommend the City Council approve Ordinance 2020-02 with the changes discussed. Motion seconded by Chair Syme. Vote called and passed unanimously.
6. Discussion/action on site plan for Maverik at 1332 West 12th Street.
This property is zoned C-2P and the developer desires to construct a gas station/convenience store.
Matt Reider, representing Maverik, said the site has been re-mediated from its prior use as a service station and is ready for development. Staff said the high water table existing on that property will need to be taken into consideration, and the engineer will need to meet storm water requirements. Maverick anticipates approximately 160 days for construction and hopes to open in January 2021. They also wish to have a taller sign than our ordinance allows because of the freeway. This change would be subject to a variance by our Appeal Authority.
Access from State Road 39 and UDOT installing a median was also discussed. Mark Nelson from High Country Inn spoke and said UDOT is not requiring a median as far as he knows.
Mr. Reider said the lighting will comply with the Dark Sky Ordinance. The fuel tanks are located as far to the east as possible, which allows the tanker to drive over the fuel farm to fill the tanks and also capture the gas fumes. He was asked if Maverik plans to have an electric charging station, but Mr. Reider said they do not due to the cost. There will be no propane storage either. Staff informed Mr. Reider to obtain the water rights associated with the property so that they can be transferred to the City for connection to the pressurized secondary system.
Motion by Vice chair Meyerhoffer to approve the commercial Site Plan for Maverik subject to the following stipulations:
1. Compliance with affected entities and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Construction to comply with all required architecture, landscaping and screening regulations.
4. Access to main building will be at the south entrance.
5. Architectural detail showing earth-tone building materials and colors.
6. Development conform to Municipal Code requirements.
7. Follow storm water requirements.
8. All signs to conform to the Sign Ordinance, subject to variance by Appeal Authority.
9. Follow Dark Sky Ordinance requirements.
10. Location of dumpster to be approved.
11. Dedicate any water shares to the City.
