Town of Goshen Council Meeting SPECIAL MEETING Goshen Town Hall October 22, 2019 Town Board Meeting 7:00 PM A. Pledge of Allegiance Charles Pipkin B. Prayer- Kathy Peterson C. Disclosures- None D. Public Input/ Reports (limited to three minutes) Non- agenda items: Steven explained why they were holding a special meeting; it is pertaining to agenda item number one. They need to have these documents signed and in before November 8th. We just received them to move forward. 1. Adopt a Resolution requiring the re-certification of the Goshen Justice Court: We had a brief description last meeting from Brett Rich, Town Attorney, and this is just the contract to keep Goshens Justice Court. Charles Motions we accept, Kathy Seconds, all in favor, Samantha is absent at this time. 2. Halloween Update: The Office posted information up to encourage house to house trick or treating this year as well as the regular Trunk or Treat. They were going to do a Fall Fest prior to Trunk or Treat, but decided that after some feedback from public, to do this even in November instead. Currently gathering information/addresses that people call and give us for a list of homes that will be participating in the house to house trick or treating this year, this list will be given out to parents and trick or treaters. 3. Review Ordinance #2019-06-01 An ordinance amending the Goshen Town Ordinance which preciously established the planning commission: Kathy had asked to have this on the agenda tonight; she attended the meeting held on October 19, 2019. She noted that she did like the outcome; however there were things that she wanted to research. She brought up the handbook that is given to the cities and towns of Utah. She read from the book, Many commissioners try to involve themselves in matters such as business license, animal regulations, nuisance informants, and this is only appropriate if the council has delegated that the planning and zoning. She then went back to the meeting and referenced her attendance to the meeting and them talking about the papers from Fillmore, that Charles-chairman, wants to adopt, that tells how many animals someone can have, antennas on house, how many day cares-children per daycare. She feels like this is crossing over into council and it isnt okay. It was brought up that we already have these ordinances and they just are not very organized, but being worked on. Her case and point is when they redid the ordinance for planning and zoning, we already had an ordinance for that back in year 2000, and it states that you can have a council member can be on the zoning and planning, but can not be the chairman of it. We need to redo the new ordinance anyway due to it saying that we have (3) planning and zoning, and (2) to pass. We have (5) on board currently. Steven stated that the old ordinance is not in effect due to council passing the new ordinance. Lindsay noted that her interpretation from Charles was to adopt the zoning of the Fillmore codes or ordinances, not all the rest of it. Jim Jasperson, zoning board member, stated that Charles made the motion to adopt all (188) pages of that document which encompasses everything. Magen Carlisle mentioned that part of that document states that it causes conflict to the Ordinance that was passed recently pertaining to the Secondary living that would allow people to live in a secondary living (trailer etc) for a one year term. Lindsay added that they agreed that it would need to be dissected and only use what applies. Charles noted that Jimmy made the motion to wait for two weeks while they study this document further, which passed unanimously. Kathy brought up the ordinance that was already in place, but her point is how many ordinances that we have that we dont know about. Her concern is that we are passing things that we already have. Jimmy stated that part of the conversation was they didnt need Fillmores; we could come up with what we already have and use them. As far as this goes, he hasnt seen any of them and does not know about them. Lindsay added that the Town has black binders that have all the ordinances; she has been working with a company and scanning them, for the company to organize and work on things for future organization. Kathy also brought up the ordinance that they recently passed, and read from it, Two members of the planning commission shall constitute as a quorum and shall require two yes votes. Council discussed some confusion as to what the interpretation is as far as council members and numbers of council members. Steven stated that it should of stated in that, and it may have been overlooked, that it should be or the majority. Charles read from the current ordinance I.-A., Said Commission shall consist of (3) members, one to be designated from among its own members by council, and (2) to be appointed by the mayor with the consent of the town council from among qualified electors of Goshen. Members shall be selected without respect to political affiliations and shall serve without compensation except for reasonable expenses. Each member of the commission shall be appointed by the mayor for a term of (5) years or until his/her successor is appointed. After discussion the number of officials that it states, they agreed to amend it due to confusion. Kathy then confirmed that was her confusion and also stated that she feels like we need to find ordinances we may already have and go from there before we pass more. Steven spoke to council, and stated he was not there at the meeting, however his hopes for that meeting was for the board to focus on what zones we need in town, and what do those zones look like, what constitutes residential and commercial etc. and then after that decide generic topics, like how tall of buildings etc. There was never the thought, according to him, that there wasnt a plan to adopt Fillmores entire ordinance. Kathy read from the handbook, Some confusion has risen over the power of planning commission or individual commission, what power do they have, not very much, which concludes that they are just an advisory board and to bring suggestion to council. Lindsay asked Charles, did you have the intention of adopting the entire Fillmore document? Charles did state that he did motion, and there was no second, and did not pass. Charles clarified that his intent was to bring it forward to a public hearing and to see what they did and didnt want and to give more time to study it. The planning and zoning had one other motion, and that was to change the zoning of the Okelberry edition, to minimum of one acre, and that passed unanimously and then forward it to Town Council. He then noted that since that, there has been some questions raised as to if that was appropriate due to it not being on that meetings agenda, but then stated that it was held on other previous agendas and it was thought that it could be done that way, however it will need to be put on the next meetings agenda. Kathy stated that she thought the same. Rachel Pena brought up the Utah Code, an insert that was sent to her pertaining to this matter of agendas, from Brett Rich the Town Attorney, Section 52-4-202(6) of the Utah Code allows a public body to discuss an item that is brought up by a member of the public, but prohibits taking final action on any item not listed on the agenda. There is an exception for emergency meetings held pursuant to Section 52-4-202(5). Charles asked if that was definitive if it could be carried forward from a previous agenda. Rachel said, It clearly states, that if it is not on the agenda for that meeting, it cant not be voted on. Steven said it is a matter of public transparency, people didnt come thinking nothing was going to happen, and Lindsay responded that they all did come thinking that it was going to be decided on, and that was what was told to them (her and owners of properties involved to Okelberry Annexation). Council discussed some confusion with this matter, and argued states of legitimacy. Lindsay added that from the public hearing minutes, the commission of planning and zoning stated that they would come back in two weeks, next meeting, and motion to rezone the properties/decision would be made. Steven then added that it should have said this on the agenda, and it didnt. Kathy thought they could just go ahead and do it because everybody knew. Lindsay asked if now they tell them public involved, that now we have a decision made but it isnt an official decision, because it wasnt on the agenda. Jimmy Jasperson asked who makes the agendas, Rachel replied that she will take the information from whoever, mayor or chairman, and then apply it to agenda. Steven noted that they only thing he is concerned about is that they moved along without the descriptions of the zones, again, and not deciding what each zones are and details explaining them. Rachel Pena spoke and explained that when she started work here, Larry was gone, and Dorothy showed her some things, but she was thrown into a seat expecting to pass things without knowing or getting information on what needs to be done before passing anything on the board. (She directed this to Jimmy, and asked him if he felt like this as well). Jimmy replied yes! I do feel that way, yes. He then gave examples of residents who come to meetings and are always here, and there isnt a lot of clarification of where certain people sit, and their situations, it was voted for one acre because it resolved issues for people who have been here that want to move forward with whatever the process is for them. But also he agrees that they know nothing about the zones, or how they want the zones to be setup, so there is a bunch of different things going on, no clarity. Lindsay noted that Greggs response was that an R-5 was (5) acres, and Jimmy confirmed that was in the general plan, and that was the only thing that was given to him with information. Charles added that his position was, he was unable to find a comprehensive zone ordinance, bringing in Fillmore code as this is unified and put together, but perhaps that was jumping the gun etc. Steven stated that his agenda, and that is to Get things right first. We have been handed a lot of things that have not been done right, and need to get things in a row to move forward and have a direction to where things are going. The Mayor and council would like to have zones, and definitions put in place, to declare what type the Okelberry, and other properties that may arise. This is the recommended ordinance that be passed, Jimmy agreed. Jimmy stated that this Fillmore Ordinance has too much information that doesnt pertain to them, and he seconds a general detail of each ordinance to be passed and clarified. Steven noted that the right decision to wait was made, and that is why they have this board, is for advising the council etc. Charles directed to the council that it appears that they need to amend the ordinance for planning commission to be a (5) member board, and language. Kathy asked if they wanted to put in what the old ordinance said, a council member can not be chairman. The Council didnt think it was necessary; they are just an advisory board and not the final say. Further discussion went on to solidify this decision. Kathy still has questions as to if a council whom is on both boards, do they have two votes or just the one. Charles asked the council what is to be done with the Okelberry Annexation, for the rezone that passed, to a minimum of one acre lots. Steven said it is to know what you are putting that zone under, what type of zoning youre advising and designating. Rachel Pena replied and read from an example code for residential zoning, A third acre minimum lot size, the objective to establishing the R residential zone is to provide residential zone in which is characterized by smaller lots and some what more dense residential environment than characteristic of the other residential zones. None the less this zone is characterized by spacious yards, and other residential amenities antiquate to maintain desirable residential conditions. She added that if we do not have a code like this, this is where planning and zoning would come in and actually look, and if not adopt the state or counties code and go off of what they describe as that. We dont know where these codes are, but if we have the map in the chambers, we must have had some before, and that is where the company who is organizing our ordinances, that Lindsay if working with, they will be able to tell us what we have etc. The issue with the Okelberry properties is it is not currently on the zone map we have for Goshen. We need to designate its own color and zone with a definition. It was clearly stated by mayor and council, that nothing is not passed for the rezone, it just needs to be defined by the next council meeting to make things moved forward and solidified. Steven added Planning and zoning still has time to get that and bring it to the council for pass. Further discussion between the council took place explaining what the possible description would or could be. They discussed and clarified to each other why they would need that, and the purposes of said description, one that was never done. Jimmy asked if Goshen was interested in doing like Fillmore, and creating a 5 year, 10, year plans etc. They were interested in that. Steven gave an example of what Planning Commission might recommend to council after their next meeting, amending the document to add a description to the one acre minimum lots that were re-zoned in Okellberry annexation. Something similar to We are going to make a recommend that we do this amendment with the new definition for zoning for the one acre, we recommend that with this new definition, we pass the said properties definition, and the change to one acre zone. That way, when there are future things that come up, we have direction with said descriptions etc. If Charles and commission get that done, and back to council at their meeting, they will review it and if agreed, pass. Discussions about previous mentioned topics above took place for clarity, and talk about examples of agendas, and verbal communications on agendas, wording and details etc. Meeting minutes from this meeting were requested from Jimmy and Charles to be emailed and sent to them prior to their meeting on November 1st. Lindsay asked about the piece that is in a sliver of property that is across the road that she owns that is involved. And to take note on that, her and Charles talked, (recorder could not make clear of conversation). Updates: Steven gave some updates and he mentioned he had been working with Genola and UDOT about HWY 6 improvements, and he said that they came up with a proposal and ways that they can improve and make it a lot safer for people. They proposed solutions for most of the hwy into Santaquin, including passing lanes etc. The amount of money for this is 16 million dollars, and could get access for 4 million. This is 3-4 years away, make a note. So they will continue to look into this and have them focus on the hill with a passing lane up the hill, pertaining to 400 West. Steven and the Mayor of Genola are going to continue to go to meetings and look for funding. Updates on the water, we are currently meeting with state, and have had to formally request permits for the spring, tank, distribution, now that had passed, then request a could other temporary permits for chlorination etc. They are hoping to get us the permanent permits and then the 2 or 3 temp permits that will not stop us but allow us to fix more stuff on our project. He stated that we have been assigned a new engineer, her name is Cheryl and she took Tammy Norths place. So nothing is going to happen until those permits are here. Rachel asked if they are going to cap the building. The council doesnt think it is necessary. Steven explained that the state needs to have accurate monitoring at the spring and tanks to see exactly how much water we have coming out of that spring. They will put a meter up there to monitor that and prove how much flow we do have. Everything is in play to keep doing things right and moving forward. Council feels that we have enough water to sustain the growth that wants to come here right now. E. Adjournment: Charles motions to adjourn, Lindsay seconds. All in favor. Those who Attended: Steven Staheli, Charles Pipkin, Sammy Steinfeldt, Kathy Peterson, Lindsay Farnsworth, Magen Carlisle, Rachel Pena, Randy Thomas, and Jim Jasperson.
