Town of Goshen Planning & Zoning Meeting Goshen Town Hall December 3, 2019 Planning and Zoning Meeting 7:30 PM A. PLEDGE OF ALLEGIANCE- B. PRAYER- C. PUBLIC COMMENT: Time has been set aside for the public to express their ideas, concerns, and comments (comments limited to 3 minutes per person with a total of 30 minutes for this item) Mr. Boone asked if he would be able to extend his land and have it rezoned to .33 acre lots. Charles Pipkin then stated that if he wants to purchase land and the seller wants to sell it to Mr. Boone, that it is between the two of them. Charles states that if Mr. Boone is already in a minimum .33 acre zone, that he doesnt see why Mr. Boone wouldnt be able to do the zone change to his property. Charles also stated that Mr. Boone would still have to get a water permit to build, as soon as we get the issue with State on the water resolved. Mr. Boone asked if he would be able to purchase land and add it to his existing lot. Charles stated that Mr. Boone is free to do that, and that he would not have to ask permission from Town to do so. Charles explained that as long as you are not planning to build or develop that parcel, you can purchase it without the Towns permission. Loyle Steele stated that just because you have the land and can rezone, does not mean you will be able to build on that property. He noted that he has 25 acres and the Town can have 2% growth a year. He wants his rezoned so a developer can build on it. Charles stated that the Town does not have just a 2% growth, and that it is in our future projection. Charles explained that the Town has not passed an ordinance that states we can only grow 2% a year. He continued to explain that it is part of the Planning process and it is just a projection. Gregg Jasperson had a comment on Loyle Steeles property. He stated he is not in favor of one acre lots. He explained that he could rezone five acres to .33 acre lots and leave fifteen acres for cattle. Gregg said he would have the same amount of houses on the property. Loyle commented that he just wants it zoned residential so he has an opportunity to sell the property. Gregg explained that if Loyle sells it to a developer, they will have to propose plans for a subdivision. Gregg stated that with the properties involved in the Okelberry annexation, that all of the property owners live on their properties. His concern is that he doesnt know what is going to happen with the Steele property. Gregg stated that if the Town rezones it as residential, industrial and agricultural it would leave it open for the developer to choose. Loyle explained that you can not have it be residential, agricultural and industrial, it can only be one. Gregg explained to Loyle his concern with the health department even approving the lots. Loyle explained his water table is at least six feet deep and that he has been checking it for the last couple of years. Gregg stated that we are now getting water form Nephi and that we havent for at least ten years. Charles interrupted and explained that it is the Health department that will decide how much land and what the water table has to be. He noted that it is not the Town who decides that. Charles explained that the Planning and Zoning controls the zoning with the Councils final approval. Charles continues on with the property owner has asked us to rezone to RRA-1. He asked if there is a strong reason to no grant the property owner this zone change? Gregg said they are to decide what is best for the property, he does not think that one acre lots will be the best option. Loyle argued that the board does not decide that. Gregg explained that the board is a land use board. Charles explained that the Planning and Zoning does the frame work and as long as the property owner is within the framework then the property owner is free to choose what they do. Charles noted that they are in the process of deciding what that framework will be. If someone were to buy the parcel of land, and wanted to change the zoning they would have to go through the same process. They would need to fill out an application and pay the fee. Loyle stated that someone may want to put a road all the way through there. Charles explained that they would have to complete the road and deed it to the city. Loyle explained he can not sell it zoned as industrial and it needs to be rezoned residential in order for him to sell. Gregg asked if there are any potential buyers if it is zoned as residential. Loyle explained that he could sell it right now if he sold the trailer park too, but he is not selling the trailer park. Lindsay Farnsworth would like to clarify that the two possible zone changes are different parcels of land. The Okelberry annexation is already residential and they are requesting RRA-1 lots, the Steele property is Industrial and would need to be rezoned to Residential as well as size. Lindsays concern is that people would think they were the same thing. Charles explained that it is public comment period on both properties, and that they can discuss both properties. He explained that if she wanted to discuss only one that is was okay to do so. Gregg went back to ask Loyle what the potential buyers want in the property. Loyle said he doesnt know, but as long as its industrial no one will buy it. He explained there is no Industry in Goshen. He has no idea why his property was zoned industrial years ago. Gregg asked where industrial would go if someone were to want to bring some Industry to Goshen. They discussed where Loyles property lines are and where they meet with other property lines. Loyle understands the Boards concern, and explained that the potential buyer could also want to change it. Gregg explained that if it will keep getting changed, they are wasting his time. Loyle explained that, that is the way it works. Gregg mentioned that Loyle has not convinced him to vote for it. Mrs. Steele said that is Greggs choice. Gregg wants to know how this zone change will help the town, Loyle stated it will be places for people to live. He explained that the Town has been held up on building for years, Gregg explained that is due to the water. Charles mentioned that the Town is fixing the water issue. Mrs. Steele said that will take three years. Charles said you are probably right. Loyle explained how two years ago he was approved for 5 acre lots, and he turned it down because he really wanted one acre lots. He explained how Main Street used to be zoned one acre lots and that has since changed. He said they could do the same thing on his property. Gregg expressed his concern with the water table, and Loyle does not think that will be an issue. They argued back and forth with their opinions on the water table. Pam Haring asked if Industrial were to come in to Town, where would that be. Charles explained that if there was anything to come in that it would be adjacent to Goshen. He explained that he doesnt think Goshen has the size for any big industrial. They would need to purchase and annex into Goshen. Charles noted that The Council would have final say. Gregg explained that Steeles would not need to rezone before selling, he noted that the potential buyer could present their wants to the Board and go from there. Loyle explained the water issue has been the biggest problem. Gregg went back and asked Loyle why he wanted the zone change he requested. Rachel Pena spoke on behalf of Chris Finster, she wanted to present to the Board the possibility of storage units on their property. Charles stated that it has nothing to do with RRA-1. He explained that she would have to apply to get the residential parcel rezoned to commercial. If completed she could do engineering and present that to council. The Board explained where the property was located. Barbara Lowe asked about the possibility of the Town getting natural gas. Charles explained that there is a possibility, he explained how the legislator passed a law about a year ago explaining how if outlining communities had natural gas it would draw people away form the busy communities.
