Minutes of Oak City Town Board Public Hearings and Regular Meeting held November 21, 2019 The meetings were held at the Oak City Town Hall beginning at 7:30 p.m. The following were in attendance: TOWN OFFICIALS Mayor Ken Christensen Council member Dave Steele Council member Warren Rogers Council member Craig Dutson Council member Monica Niles Town Clerk Karen K. Lovell OTHERS Sarah Ray Sewyn Josh Ipson Shaye Rogers Bryan Anderson Chalice Smith Dallin Christensen Russe1l Dewsnup Chelsie Hathaway Dailene Anderson Ron and Susan Sumsion Shim and Traci Callister Nathan and Amy Nielson An invocation was given by Craig Dutson. The Mayor started the meeting by apologizing for the way the October Meeting was handled. He felt that things were said by the Council members, himself, and others that were said in the 'heat of the moment' and not really meant and that the discussion around Nathan went way too long. He hoped this meeting would be much better. The purpose of the First Public Hearing was to get public comment on ORDINANCE 2019-01 AN ORDINANCE MODIFYING TITLE 10-07 of the OAK CITY TOWN CODE BY DEFINING RURAL RESIDENTIAL DISTRCT LOT AREAS AND SET BACKS. The Mayor explained that the Oak City Planning and Zoning Commission went through this Ordinance some time ago and changes were made in a Resolution but needed to be adopted in Ordinance form. He went through the Ordinance quickly At this time, Sarah Ray asked if there wasn't some kind of ordinance pertaining to the problem of parties parking disabled vehicles along Town streets. The Mayor said there is a clause in the Town's Nuisance Ordinance that prohibits this. Sarah stated that there is a party that has such a vehicle parked in front of their yard along the street. The Mayor will talk to this party to and request removal of the vehicle. This ended this Public Hearing. Warren moved, seconded by Monica, to adjourn the Public Hearing. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Craig-Aye. Monica-Aye. Warren-Aye. The Hearing adjourned at 7:40 p.m. The Second Public Hearing began at 7:41 p.m. The same parties were in attendance. The purpose of the Second Public Hearing was to get public comment on Ordinance 2019-02 AN ORDINANCE MODIFYING TITLE 10-10 of the OAK CITY TOWN CODE BY DEFINING THE SQUARE FOOTAGE REQUIRED FOR A BUILDING PERMIT. The Mayor quickly explained this Ordinance. Russell Dewsnup asked who would enforce the Ordinance. The Mayor explained that the Town Council would enforce the Ordinance. This ended this Public Hearing. Warren moved, seconded by Craig, to adjourn. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Warren-Aye. Craig-Aye. Monica-Aye. The Hearing adjourned at 7:45 p.m. The Regular Town Board Meeting began at 7:46 p.m. The same parties were in attendance. The following agenda items were considered: A. Adopt Agenda. Dave moved, seconded by Monica, to adopt the agenda as written. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Craig-Aye. Warren-Aye. Monica-Aye. B. Adopt Minutes of Town Board Regular Meeting held October 17, 2019. Warren moved, seconded by Dave, to adopt the Minutes of Town Board Regular Meeting held October 17, 2019 as written. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Craig-Aye. Warren-Aye. Monica-Aye. C. Mandatory Review of Ordinance 2018-01 THE COMPENSATION ORDINANCE FOR STATUTORY OFFICERS AND EMPLOYEES OF OAK CITY TOWN. Dave reported that the Social Security Administration was giving a 1.6% increase for the year 2020. He went over what the wage increase would be for the Town Clerk, Town Treasurer, and Meter Reader wages if their wages were to increase by this percentage. Dave pointed out that the current salary for the Mayor and Council members has not changed since 2011. It has also been 11 years since the Clerk and Treasurer base pay was set. However; the work load for both positions has increased, especially for the Treasurer position. After some discussion, the Council decided on a 3% wage increase for the Town Clerk, Treasurer, and Meter Reader positions. The Council felt the base wage for the Treasurer position should be increased but will have to try to look at the amount of hours that is spent filling the job requirements then, adjust the wage accordingly. Dave will prepare the new Ordinance with the changes. This will be Ordinance 2019-03 and a public hearing on this Ordinance will be held in conjunction with the December Town Board Meeting. D. Adopt Ordinance 2019-01 an Ordinance Modifying Title 10-07A of the Oak City Town Code by Defining Rural Residential District Lot Areas and Set Backs. Dave moved, seconded by Monica, to adopt Ordinance 2019-01. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Monica-Aye. Warren-Aye. Craig-Aye. E. Adopt Ordinance 2019-02 an Ordinance Modifying Title 10-10 of the Oak City Town Code by Defining the Square Footage Required for a Building Permit. Before adopting the Ordinance, Dave had a couple of concerns. What is the definition of a habitable building? How is it decided if a building is livable or not? The Mayor stated that he had been trying to come up with a definition but has been unable to do so, even after looking at Ordinance from other communities. This will have to be looked at. The Ordinance states that a Minor Accessory Structure is defined as 600 sq. ft. Dave felt that this was too large. He has found that most towns go with 200 sq. ft. The Council agreed so the Ordinance will be changed to 200 sq. ft. The Mayor felt that Title 10 should be codified. Warren moved, seconded by Dave, to adopt Resolution 2019-02 with the 200 sq. ft. minor accessory structure change. Roll Call Vote: Mayor Christensen-Aye. Dave-Aye. Craig-Aye. Warren-Aye. Monica-Aye. F. Work Session to Establish Personnel Policies for Oak City Town. The Mayor stated that since last meeting, he has realized that Nathan Nielson, Oak City Tow Full-time Employee, had went from part-time to full-time without ever really knowing what was expected of him. Establishing policies and procedures will help Nathan know what is expected and the Town to know what he will be accomplishing. The policies are not only for the full-time position but all part-time positions also. The Mayor obtained a copy of Delta City's Policies and Procedures and has read it through several times. He felt it was a good Policy and he would like to set it up as Oak City's procedures with some changes, if the Council approves. At this time, Dave explained that the Town has had some Policies and Procedures in place for some time but they have never really been followed. The Mayor stated that he didn't even know they existed. Dave presented the Council with copies of these but where they were established between 1993-98, he felt they were too outdated to use anyway. The Mayor went through some of the main items in the document. He liked that it offers days off for years of service for the full-time employee. Where Nathan has worked for the Town about 10 years, he would get the full 4 weeks off per year. The Mayor asked the Council and the public if anyone had any majors concerns or talking points. Amy Nielson asked if the Policy covers paid holidays and what if the employee worked on a holiday, would there be extra pay? The Policy stated the full-time employee would be paid double time if working on a holiday. The Mayor stated that Nathan has been paid a salary in the past but this Policy would require payment by the hour, with the employee clocking in. This would facilitate the ability for Nathan to clock in and indicate what department he was working for which would make it easier to track which department would be billed for his work. This will add more work for DeAnn Steele, Town Treasurer, but would help keep track of the department budgets. Will need to make sure DeAnn is comfortable with all her new duties. Hopefully her software will be able to keep track of much of it. Traci Callister asked about what will happen in the summer when Nathan works so many hours. The Mayor responded that he would get overtime for hours over 40 hours per week. Even the hours for part-time employees, over and above 40, would be paid overtime pay if the hours were preapproved. One thing the Mayor has been impressed with is that Nathan has worked for the Town about 10 years and he has never been hurt. However, in the future, the Mayor asked Nathan to start taking some of the on line safety and training courses, maybe one a month. Dailene Anderson asked if the Policy lists specific responsibilities or jobs for each employee. The Mayor said it did not. He explained that it would be very difficult to do so. Job priorities will just be decided between the employee and the Mayor. The Mayor pointed out that Nathan is the current Animal Control Officer, because he volunteered to do this. However, with Nathan having so many other responsibilities, it might be best to hire someone for this. However, the position only pays $50 a month. Sara Ray suggested the Town set up a fee per animal caught and give the fee to the Animal Control Officer. The Council liked this idea. Will be looking at who could replace Nathan. Sarah Ray asked if Nathan would lose wages if the Town implements the new Policy. The Mayor said he would not. In fact, he should make more in wages. The Mayor stated that he would like to see Nathan spending most of his time on water department issues. Such as, fixing the many water meters which are not working. Amy mentioned that she had created a time sheet which Nathan could use to report his hours and what he was working on at the time. The Mayor thanked her for this but felt it would be too time consuming and not necessary. Will have DeAnn just keep track of his time off and which department Nathan reports that he is working for. The Mayor will go through the Document once again, make his changes along with those that have been suggested, and then redo the Document and get it to the Council members to review through the month. The Policy will then be placed on the agenda for discussion and possible adoption at the December Town Board Meeting. Once the Policy is adopted, the Mayor thought it should be reviewed annually. Sarah Ray asked what happens when an animal is picked up by animal control? The Mayor stated that the animal is taken to John Anderson, the Vet, and he boards it for three days. If the animal isn't claimed, he takes care of it. If the animal is claimed, the party has to pay a $60 fee and have the animal vaccinated if it isn't already. If the Sherriff is called, he will contact the Mayor to sign a complaint. After two complaints on the same animal, the animal is taken to the Vet. Dailene asked if the Town has an Animal Ordinance. The Mayor said yes, and that the Ordinance was even posted at the Bulletin Board for a while. The Ordinance is hard to enforce, however. G. Public Comments. Karen said that Paula Prince had contacted her about her concerns on the condition of the Town Bulletin Board at the Post Office. It is in bad shape. Traci Callister mentioned that she had seen a bulletin board in a community that had a pitched roof and two closed sides. She thought this design would work for Oak City. The Mayor will look into this. He will talk to the owner of the Post Office building to get permission to put something new in. The youth could help with this. H. Financial Report. The Financial Report was Read and Approved by Board Action. Amy Nielson pointed out that the Town currently charges a $50 fee to use the Hall Conference Room. She wondered if this should be set a little lower. Monica Niles pointed out that there has been a lot of hard work put in to fixing up the Hall and it is costly to update it. She felt the fee ought to remain. The Council agreed. I. Departmental Reports. Monica Niles. The Mayor has talked to a guy who will sell the Town 25 tables, 8 ft. by 8 ft. rounds, at up to 15% off which will make them pretty inexpensive. The Council authorized the Mayor to purchase the tables. Will need some chairs carts also. Monica would like metal carts as the lifetime ones do not hold up very well. The Mayor stated that Tom Nielson is willing to bring back the metal carts he was given, from the Town, when the Town thought they wanted to dispose of them. Need some flat-table carts also. Monica will check on prices. Nathan reported that he has sold several of the old wooden tables from the Hall. The Hall stage has been painted. Will be getting new lights and a curtain. Asked Nathan, who schedules the Town Hall, to block out January and February use so she can get things worked on in the Hall. The Santa and the Christmas Eve Program are both lined up. Dave Steele. Ciaran Lovell is building a house and Dave is working on the Power for it. Stacy Stewart has problems with the power going to her shed. Will be having the service updated. Updated the Town's website by posting the Financial Disclosures, from the election, on the site and the election results. Flowell Electric repaired some street lights. Talked to the Mayor about obtaining a transformer replacement for the Town's substation. Dave has been in contact with Dixie Escalante Power on this and found it would be around $52 to $54 thousand for a rebuilt one. However; a new one would be cheaper. Dave will start looking on this. If the current transformer goes out, it would take the Town about 17 weeks to get the power up again. Have been getting comments from people about the proposed Premium Energy Project and the effects it might have on Oak City Town and its water shed and the Canyon. Dave believes there is a public comment period going on right now on this Project. The Town ought to make a comment on this. The Mayor pointed out that the Town doesn't even have to be informed of anything to do with the Project due to the Towns small size. Every year the American Public Power Association completes a survey on the average rate per KW hour. Oak City Town is lower than most. The Christmas candy has been ordered. The U.S. Department of Agriculture is proposing land use and vegetation rules. This will affect the Town. Warren Rogers. Got a copy of a Plot Certificate, from Jeff Lyman, for Craig Nielson Craig Dutson. Will be installing the driver-feedback signs soon. H. Miscellaneous. Karen reported that she and Marva Jean Anderson have decided they would still like to be over the Oak City Days Dinner as long as they don't have to do the clean up after. They will inform the Oak City Days Committee Chairs that they will be in charge of setting up a cleanup committee. Mayor Christensen. Got a quote, of $14,000 from Kody Smith of Desert Rock Products, for the work of putting in a rock wall at the Hendersons. Will continue to look into this. The County nominated Oak City Town to receive a Town Beautification Award where the Town has been working on tree removal, replacement, and are getting new benches put in.
