3. New Business
A. North Bench Farms parking enforcement
Jeff Ross stated that there were new signs about parking in North Bench Farms and questioned when the 'No Parking' signs were erected. Mr. Ross stated concern for residents such as when they have guests. He stated that there is no provided parking lot, and it would be a long walk for residents and guests who had to park far away from their home. He questioned who has the authority to tow vehicles. Amy Rydalch, City Planner, stated that she contacted the City Attorney, David Church, who informed her the only authority to enforce no parking would be the city. To do so would require a city ordinance to be passed. North Bench Farms HOA can enforce the rule by other means, but they cannot enforce by ticketing or towing. Mayor Woolstenhulme stated that everyone shares the main concern of safety. Ms. Rydalch that there are signs about parking in North Bench Farms, but it is unknown when they were placed. She also stated that the city does have an ordinance that regulates parking seasonally during the winter to enable snow removal, but not year-round.
Tim Jones, the HOA manager, came to represent the Board of Directors. He stated that the Board of Directors had been acting with the understanding that there was a year-long ordinance. He stated that over the last year they have tried to work with the city to address their problems. He stated that they have wanted to make signs to reflect a year-round ban with the backing of the city. Mayor Woolstenhulme stated that the city apparently does not have those ordinances in place at this time. Mr. Jones stated that they are trying to come up with some parking alternatives. Ms. Rydalch stated that if it is the towing or ticketing of a vehicle, it cannot be delegated to any other entity but the City.
Councilmember Wilmoth stated that the HOA acted with the belief that they had the full backing of the city, but the city officials did not realize the lack of ordinances. The HOA stated that they will gather and discuss alternative options. Mr. Ross stated that he is willing to have an offline conversation to discuss the issues. He agrees that there are safety issues. Mayor Woolstenhulme stated that the council has talked about the complications of enforcement and that the city must act in accordance with Summit County, and that the city itself does not have the resources to enforce full time.
Councilmember Smart stated that he believed that there were some city policies regulating parking of trucks long term. Ms. Rydalch affirmed that there are some instances of unlawful parking, but none that meet the criteria that was discussed in this meeting. She stated that there are no rules to stop people from parking on the side of the road.
B. Speed Limit Concerns on North Bench Road
Mr. Bates stated that the road has become a safety concern due to the speed of drivers. He has two suggestions:
1) No thru traffic signs that could divert traffic to the county roads instead of the city road. As you come up Weber Canyon.
2) Installing blinking speed lights. Mr. Bates stated that if cost is a prohibitive issue, he would even be willing to help raise money for it.
Councilmember Rydalch talked about the problem of Google Maps routing people down North Bench Road instead of Weber Canyon Road. Mayor Woolstenhulme stated that it is clear that action needs to be taking. Mayor Woolstenhulme asked Abigail Morrison, City Recorder, to look into the B&C Road money and see if some of it can be used for signs.
Councilmember Rydalch stated that he has some resources to do with road safety and would be willing to meet with Mr. Bates. Councilmember Frazier suggested he could contact the county for a short-term solution for a speed wagon. Mr. Bates daughter, Zada, stated that she feels unsafe as well.
Councilmember Smart stated that since it is a city street, they should be able to put up a no thru traffic signs and then communicate it to Googlemaps.
C. Branca property - Fire Hydrants
Ms. Rydalch stated that the Brancas and Mr. Leavitt had a very productive meeting and have produced an alternative solution. Ms. Rydalch stated there is a property owner on Franson Lane that will likely be amenable to a utility easement and the water line could be brought from Franson Lane to the Branca property. Ms. Rydalch referred to a document depicting two possibilities. One possibility is lateral that would run to the Branca property and the 'T' off to the respective fire hydrant or two lateral lines to each of the individual fire hydrants. Kent Leavitt, Fire Marshal, informed the Brancas and Ms. Rydalch that the fire hydrant does not have to be closer than 500 feet to the Don Branca property which sits farther away from the street. Mr. Leavitt acknowledged to Ms. Rydalch that he did initially agree with the Brancas that they did not have to have the fire hydrants.
This alternative is less expensive because it does not include engineering fees and the water would not need to be run down Weber Canyon. Ms. Rydalch felt that it would be reasonable to waive the impact fees for the Brancas. Councilmember Rydalch stated that he feels that the fire department and county should also contribute to fees, not just the city. He stated interest in having Mr. Leavitt to share the responsibility. There was discussion that the city does not have control or responsibility over the issue. Mr. Branca stated that they are willing to do what they need to do. Councilmember Hoggan stated that all things considered, this could be a good solution and it would be a lengthy process to involve the fire department and county. Mayor Woolstenhulme stated that he was satisfied with this option and happy to find a good middle ground.
Councilmember Frazier made a motion to waive the impact fees for the two water connections to the Branca property. Councilmember Hoggan seconded. Motion passed (5:0).
Councilmember Rydalch made a motion to accept the proposal presented to the council. Councilmember Smart seconded. Motion passed (5:0).
D. Franson Estates
Ms. Rydalch informed the Council that Josh McCreeby, an Oakley Resident, called the city and requested two new speed limit signs with one of the signs stating that children are at play. He has stated willingness to pay for the signs. There was discussion around the speed limits all over Oakley. Ms. Rydalch stated that she believes that the city is the deciding body on all speed limit signs in Oakley. Councilmember Rydalch stated that there is a need for them in multiple places.
E. 4th of July Ticketing
There was discussion about the ticketing system. Ms. Morrison stated there is an issue with people calling the office to avoid the online $3 surcharge per ticket. This costs the city time and the city takes on the burden of a 3% merchant fee. Ms. Morrison recommended that the city sell tickets in person if someone comes to the office but to discontinue the practice in other cases. She suggested that if the order was less than 20 tickets, to inform people that they must purchase their tickets online and not over the phone. The Council instructed city staff to begin directing customers online and discontinue taking orders over the phone for orders of less than 20 tickets.
The Council discussed raising the ticket price. Mr. Bates raised the possibility of creating a VIP experience for a small group of people. Councilmember Wilmoth stated that the city does not have the time to do that at this time, but could discuss in the future. Mr. Bates stated that the Oakley Rodeo is an incredible rodeo and it could make more money if they wanted it to be.
Councilmember Wilmoth made a motion to raise the price from $15 to $20 for the 2020 Rodeo. Councilmember Hoggan seconded. Motion passed (5:0).
F. Town Appreciation Dinner
The Council discussed logistical details for the Town Appreciation Dinner at 6:00 PM at the Red Barn.
Mr. Kenneth Woolstenhulme stated that they may need to make a new contract with Bar T Rodeo. Mayor Woolstenhulme stated that legally they should open up the bidding process to two others.
G. Recorder Items
a. Online Utility Payments - Xpress Bill Pay
Ms. Morrison presented information to the council concerning online utility payment. She met with a representative from Xpress Billpay, the same company used by other communities in Kamas Valley, and felt that it could be very beneficial to the town. She presented the cost of the program and timeline. The council asked questions about timeline and details. Ms. Morrison stated residents will have the option, but they will still be able to come to the office and pay if they want to.
Ms. Morrison presented options for an online reservation system to use for anything that Oakley rents. She stated this included the campground, stalls, fields, any venue space, and the arenas. The council asked if the city would be able to block out dates and control who can rent. Ms. Morrison said they would be able to. Ms. Rydalch also said it will be a useful tool for the parks and recreation employees. An online reservation would eliminate double bookings and provide clarity.
Councilmember Rydalch made a motion to go to move to an online reservation system and Xpress Bill Pay. Councilmember Frazier seconded. Motion passed (5:0).
Councilmember Wilmoth made a motion to pay the bills. Councilmember Rydalch seconded. Motion passed (5:0).
