AUGUST 8, 2019
7:00 PM
PRESENT: Mayor Jesse Campbell, Doug Nowell, Jared Campbell, Troy Campbell, Steve Healey, Ed Payette, Terry Balch, Jerry & Charlene Howell, Mike Naiser, Jessica & Travis Daniels
PRAYER: Carried from previous Truth in Taxation hearing.
PLEDGE OF ALLEGIANCE: Carried from previous Truth in Taxation hearing.
MINUTES: The minutes from the June 27, 2019 meeting were read. Jared motioned to accept the minutes as read. Doug seconded the motion. All were in favor.
Doug wondered about a total on the 4th of July. It was successful and did not lose money.
PLANNING COMMISSION: Doug read the Agenda from the Planning Commission meeting as an update. Discussed was continued update of the General Plan and Joseph Maps are needed. Zach Leavitt is helping. A Planning Commission meeting is set August 27th for public comment on the General Plan.
There have been some concerns about the Old Church Rental. Doug said the first that should be done is to contact the owner and let him know and do his own policing. Doug checked the website for the rental and could not find any rules and that the town may have to make some for him. A big concern has been camp trailers parked on the side of the road. Doug said we can't enforce it because we don't have ordinances for that right now.
Jerry agreed that it started off good, but has changed as time went on. Jerry believes there are some ordinances that need to be addressed for businesses, not residential, on tents and trailers. He also wondered what we needed to define camping as. Without ordinances, right now there is nothing stopping him from charging people to camp on his property other than a nuisance ordinance. Generally, the people are respectful, there have been some that are nuisances.
Ed wondered about people using the park without renting it. The mayor explained that you can reserve it, but it is a public park. Ed's concern is large groups using it without reserving it. Jerry added that others from the Old Church Rental have used it and wondered about having a paper saying if the park is reserved. Steve said there is a sign that tells if the park is reserved. Jared mentioned that if they reserve the park, it would monopolize the park from any of us being able to use it, instead of just letting everyone use the park.
Jerry was also concerned about the smoke from the firepit. Doug said people need to know that at 10 PM to 7 AM, it's quiet, and the business owners should let renters know.
Jared wondered if anyone has talked to the owners, Jerry or Ed had not. Doug mentioned comparing other town's ordinances on camping and Air B&Bs.
The mayor asked Doug if he knew of any ordinances on trailers. Doug said the one he found was Camping and Camp Trailers. Ed added that Air B&Bs only deal with the house, not bringing tents or trailers. Jerry recommends ordinances that are black and white. The mayor agreed that there should be an ordinance on parking RVs on the side of the road for businesses. The mayor didn't see an issue with tents being used at the Church Rental property. Jerry said he does because it gets out of hand and turns into a block party. He's afraid that it could change the category and turning it into a campsite.. He also added that he can't go to an Air B&B and have tents. Jared told him that Air B&Bs don't allow tents and the only place that would allow that is the Old Church. Jerry agreed and said tents shouldn't be allowed there. Jared said that the best way would be with the curfew. Charlene said they do what they want anyway. Jerry asked if it needs to be on the neighbors every time that there is an issue. Jared said no, and that we should call the business owner and have him take care of it. Jerry is concerned about the town changing and turning into a campsite.
Ed is concerned about the tiny house. Jared wondered how we enforce the ordinances when we already have people abusing it. Doug found in the ordinances that travel trailers and motorhomes should only be used in an RV park. Any resident may provide off street parking for no more than 14 days. He wondered if the tiny house had been there for 14 days, and if they could leave and come back for 14 more days. Ed said it has not moved. Jared said that the issues comes when it turns into a permanent residence.
Jerry wondered what the enforcement process was. The mayor said we don't have one. Jared said that we go to their house and talk to them. Doug said that in the past it has been the duty of the mayor and that he has the right to delegate it to others. The town can use the Sheriff's Dept., but it can't be enforced because the county attorney doesn't have a copy of the ordinances. Doug mentioned writing a letter to the business owner of the Old Church Rental to let him know of concerns. The mayor asked them to work together with Ed and the planning commission and help come up with ordinances. Doug and the Mayor agreed that we need to let the owners know and have them help. Jerry wondered if the council concurred with his statements. Jared said they agree to the point that it needs to be on paper and better understood. He is concerned about limiting the businesses too much.
Doug motioned to draft a letter and send it to the owner to let him know of the concerns. The mayor asked if they would be willing to write up their concerns. Jared said we need to make sure it doesn't overlap current ordinances. Jerry wondered if the owner brought up tents and trailers when he first brought his business to the council. The council wasn't aware. Jared seconded Doug's motion to draft a letter. All were in favor.
WATER: A question was raised to about putting in a waterline to the property East of Lynn Avis's house. Doug mentioned it needed to be an 8' line and depending on the length they may need to put in a fire hydrant. The waterline and the road would be on the property owner to extend it.
The mayor talked about the meeting with the auditor and the town is about $10,000 short on covering itself. The auditor suggested raising the water bill $5 a month to bring the town to where it needs to be. How to go about the raise needs to be decided by the council. Ed mentioned talking about it at the Public Hearing for the planning commission to get input from the town on their ideas of raising it. Jared said that the auditor suggested raising it one time and then raising a certain percentage each year to avoid large raises.
ROADS: Terry is concerned about the rocks coming to the shoulder of the road in front of Dwayne Jones' house. Doug said that he was given approval for gravel and they brought in cobblestones. The mayor was not aware of the situation. Jared wondered about a solution, Terry said to take it out immediately. Mike said they are raising the shoulders of the road and they will move them if they are in the way. Terry asked the mayor to look and it and he agreed he would. Terry also was concerned about the culvert being replaced and wondered what had been done about it. Mike explained that the culvert is not owned by the city, but the canal company. The mayor said he had talked to Scott about it and Scott said would clean out the culvert. Terry also wondered who owned the culvert in front of the JCC. It's the town's property with an easement to the canal company. Doug said any changes to the culvert under the sidewalk would be on the town because the town adjusted it.
Jessica is concerned about her property on 200 west because the driveway is steep because of the new road construction. Mike said that he would let Hales know about the issue and have them repair it. Travis wondered about the mailbox because they received a letter from USPS saying the would no longer deliver mail because of the dropoff. Doug mentioned they may have to temporarily move the mailbox until the road is finished. Jessica is also concerned about water running into the yard. The mayor explained that this is one of the issues they are fixing with the new road and putting in drainages.
Terry is also concerned about a leak on the town's end of the line in front of the A-frame house. The mayor said he had talked to Steve about it and was not aware that it had not been fixed. He will follow up with Steve. Terry was also concerned about the town putting rotomill in. Jared clarified Terry has an issue where the town dug up asphalt, put in a waterline and put rotomill back over the line. Terry is upset because there a pothole there. Jared told Mike to put in on the list of repairs for the roadwork and to get it fixed.
Terry also has an issue with the sidewalks. The mayor said should it not fall on the homeowner to maintain in front of their house. Terry said no, it's on city property. The mayor explained that the financial aspect of the town has been his main concern before anything else, but is glad there are town members to inform him of their concerns so they can be taken care of.
Doug commented that he had been on the council for a while and had never seen a time when the town was in bad financial shape, other than the finances were taken care of by two people, but that the audits were all good. The mayor disagreed and explained that a lot has changed and that he has been invited to meetings explaining what has been going on. Doug said the town, over the last 13 years, has never defaulted, though. The mayor explained that Pelorus had not been being used to keep track of finances correctly and the numbers have been inaccurate. Jared explained that when Earl Utley was mayor there was $300,000 in savings, and when Ray was mayor Brenda explained that the money from that savings was gone and the budget had been over spent. Jared said the budget had not been tracked in detail seeing where expenses were going, but now he can look at the budget and see the exact numbers and where finances are going. Doug agreed that it made sense and that we had never had to have a tax increase then. Troy said it's because of the excess from Earl. Doug said he knows that water funds had been spent other places, but it had all been used for the town. He does remember Brenda saying that we needed to find more funds. Jared told him that current numbers are current and he can look at a budget paper any time, and everything is categorized correctly and we are not upside down in funds.
Terry is concerned about the milage Steve puts on the truck. Steve said they are part runs and taking water samples in. Doug and Terry asked about using the vehicle for personal use. Steve said he had used it for a short time for personal use and they mayor was aware of it. The mayor said he knew and that he told Steve he needed to get his own vehicle. Steve did get his own vehicle and no longer uses it for personal use. He has had his with him, but it was to help with work because there are some things that he can't do alone.
CEMETERY: Doug said the ground penetrating radar was up there and found that most of the burials are by the headstones with only a few issues. The town cemetery is online now. Ed suggested putting it up on the town website. Doug said Bill Keech may be back. Doug also wondered about the Summer Youth hiring program.
Steve said he tried to contact the person over the program, but never heard back. The mayor wondered about the Sheriff's work crew helping, they are coming August 24th and September 4th.
BUILDING: The mayor said to get an estimate for the carpet cleaning of the community center.
The mayor said KMECO will get a figure put together to fix the security cameras and to take care of them and the security system at the same time to save money on multiple trips.
The mayor asked Steve about the leak in front of the A-frame home and if it was repaired. Steve said the issue is when the trash truck drives over the pipe and smashes, causing it to leak. He put rock over it to support the pipe so it would not smash and is not leaking now. Doug said he dug it up recently and the ground is wet. Steve said he will check it. It was suggested to put a sleeve or a half pipe over it to protect the pipe.
Update from Mike on road, 200 E has been built and chipped. Hales will not be back for another two weeks. The road signs will be put back up, but if it doesn't happen soon to let him. He will check on Laurie Daniel's driveway. A drainage ditch needs to be cut along there. If there are other issues, let Mike know. Hales and Ensign have their next pay requests.
Water right proof was filed. The town could not proof up on the whole amount because it would never be used. A right was segregated to another proof that is still owned by the town. On the segregated right, an extension will need to be filed every five years to maintain that right.
The road work is expected to be done by early October. Jared brought up a concern about cars on the shoulder of the road on 100 West. Mike suggest sending them another not, but if not Hales will move them if the owner doesn't.
Jared motioned to adjourn. Troy seconded the motion. All were in favor.
