Consideration of Residential Housing Code Violations at: 556 South 500 East
(Case No. HAZ2019-01917; Represented by Roger Condie) Council District 4 - Ana Valdemoros
Appeal deficiency: Emergency egress and/or rescue openings in bedroom of basement apartments.
The net-openable area of the windows for the required emergency egress and/or rescue in the bedrooms of the basement units. The openings of the window wells for the bedrooms on the north side are protected by steel grates that are too heavy to remove. There is a total of four (4) apartments on the basement level. Findings: The building was constructed within the last ten (10) years or so. The openable section of the bedroom windows in the basement units are smaller than the minimum requirements for providing at least one opening for emergency egress and/or rescue in rooms used for sleeping. The windows are all double pane glass sliders and the unobstructed net-openable area from edge to edge is seventeen inches (17') by twenty nine inches (29'). The steel grates that protect the openings of the window wells are not hinged to swing away from the building and they are too heavy to remove in the event of an emergency. Standard required: Every room used for sleeping located below the fourth (4th ) floor requires at least one (1) opening to the exterior for emergency egress and/or rescue. The clear unobstructed openable area of the required opening can be no less than twenty inches (20') by twenty four inches (24') with a sill height of no greater than forty eight inches (48'). For windows that are below grade, a window well shall run parallel to the width of the window and extend at least eighteen inches (18') out from the exterior face of the building. When the distance from the top of the window well to its bottom exceeds forty eight inches (48'), it shall be equipped with an approved permanently affixed ladder or stairs that are accessible with the window in the fully open position. Grates are permitted over window wells when hinged away from the structure and not weighing over fifteen (15) pounds per section of the grate. Bars, grills, grates or similar devices may be installed on emergency escapes or rescue windows or doors, provided such devices are equipped with approved release mechanisms which are operable from the inside of the grate without the use of a key or special knowledge or effort.

Consideration of Residential Housing Code Violations at: 836 South 500 East
(Case No. HAZ2019-01573; Bonnie Kier - Herrick) Council District 4 - Ana Valdemoros
Appeal deficiency: The net openable area of the windows for the required emergency egress and/or rescue in the bedrooms of all the basement units. Findings: The building was renovated in 2015 and all of the windows were replaced. The openable section of the bedroom windows in all of the basement units are smaller than the minimum requirements for providing at least one opening for emergency egress and/or rescue in rooms used for sleeping. The replacement windows are all single hung and the unobstructed net-openable area from edge to edge is thirty seven inches (37') by fifteen and one half inches (15 1/2'). All of the window sills for the same windows have a permanent step the same width of the window attached to the wall to meet the minimum requirements for sill height. Standard required: Every room used for sleeping located below the fourth (4th ) floor requires at least one (1) opening to the exterior for emergency egress and/or rescue. The clear unobstructed openable area of the required opening can be no less than twenty inches (20') by twenty four inches (24') with a sill height of no greater than forty eight inches (48')

Consideration of Residential Housing Code Violations at: 841 South 500 East
(Case No. HAZ2019-01806; Represented by Jon Neviaser) Council District 4 - Ana Valdemoros
Appealed deficiency: The total square footage required to be considered an efficiency dwelling unit.
Findings: The floor area of the kitchen is sixteen (16) square feet. The floor area of the main living room is one hundred thirty (130) square feet. The bathroom is not considered to be living space and can't be included in the total square footage to meet the minimum requirements. Standard required: An efficiency dwelling unit shall: a. Have a living room of at least one hundred ninety (190) square feet of floor area. An additional one hundred (100) square feet of floor area shall be provided for each occupant in excess of two (2); b. Have a closet; c. Have a kitchen sink and cooking and refrigeration facilities, each having a clear working space of at least thirty inches (30') in front of the fixture or appliance; d. Have a bathroom containing a toilet, sink and bathtub or shower.

Consideration of Residential Housing Code Violations at: 224 1/2 North Canyon Side Road
(Case No. HAZ2019-01632; Porter Criddle) Council District 3 - Chris Wharton
Appealed deficiency: The emergency egress and/or rescue openings in bedroom of basement apartments. Unit #224 1/2 does not maintain the minimum standards for an unobstructed means of egress from the rooms used for living space. Findings: There is one (1) primary entry that leads to the apartment unit. The headroom height of the awning over the stairs leading to the primary entrance varies from five feet two inches (5'2') to five feet eleven inches (5'11'). Standard required: Every dwelling unit shall have a safe, continuous and unobstructed means of egress of a minimum height of six feet four inches (6'4') and a minimum width as per this code. The exit way shall be kept in a proper state of repair and maintained free of hazardous conditions and obstructions. A minimum ceiling height of six feet four inches (6'4') shall be required in corridors. The minimum width of corridors shall be thirty six inches (36'). In dwelling units constructed prior to 1983, a minimum corridor width of thirty inches (30') shall be permitted. Appealed deficiency: Unit #224 1/2 bedroom windows do not meet the minimum standards for providing at least one opening that leads directly to the outside for emergency egress and/or rescue. Findings: There are two (2) windows that are painted and cannot be opened. The net-openable area measured from edge to edge is twenty inches by twenty and one half inches (21 1/2'). There is a third (3rd) window that is a casement style and the net-openable area of that window measured from edge to edge is twenty inches (20') by nineteen inches (19') with a sill height of sixty one inches (61'). The window wells for the same windows extend out from the wall eleven inches (11'). Standard required: Every room used for sleeping located below the fourth (4th ) floor requires at least one (1) opening to the exterior for emergency egress and/or rescue. The clear unobstructed openable area of the required opening can be no less than twenty inches (20') by twenty four inches (24') with a sill height of no greater than forty eight inches (48'). Findings: The bedroom window is an awning style that swings in with no mechanism for holding the window in the open position. The net-openable area of the window opening from edge to edge is thirty three and one half inches (33 1/2') by fifteen inches (15'). The window sill height measured from the floor is sixty one and one half inches (61 1/2'). Standard required: Every room used for sleeping located below the fourth (4th ) floor requires at least one (1) opening to the exterior for emergency egress and/or rescue. The clear unobstructed openable area of the required opening can be no less than twenty inches (20') by twenty four inches (24') with a sill height of no greater than forty eight inches (48').

The doorway opening leading to the kitchen area is five feet ten inches (5' 10') and the doorway opening leading to the bedroom is six feet (6') by twenty seven inches (27'). Anywhere that the ceiling height is less than seven feet six inches (7'6') but no less than six feet (6') can be approved administratively. Standard required: Every dwelling unit shall have a safe, continuous and unobstructed means of egress of a minimum height of six feet four inches (6'4') and a minimum width as per this code. The exit way shall be kept in a proper state of repair and maintained free of hazardous conditions and obstructions. A minimum ceiling height of six feet four inches (6'4') shall be required in corridors. The minimum width of corridors shall be thirty six inches (36'). (Case No. HAZ2019-01573; Jeffery Turner) Council District 3 - Chris Wharton
Appealed deficiency: The emergency egress and/or rescue opening in bedroom of basement apartment. The net openable area of the window for the required emergency egress and/or rescue in the bedroom is deficient in size in the basement unit. Findings: The original window has been replaced with a fully openable casement style, constructed of a vinyl frame and double pane insulated glass. From inside to inside the opening of the window frame is twenty inches (20') by twenty three inches (23'). When the window is open, the edge of the window panel encroaches into the required net openable area, reducing the width from twenty three inches (23') to sixteen inches (16'). Standard required for both A and B: Every room used for sleeping located below the fourth (4th ) floor requires at least one (1) opening to the exterior for emergency egress and/or rescue. The clear unobstructed openable area of the required opening can be no less than twenty inches (20') by twenty four (24') with a sill height of no greater than forty eight inches (48').
