Elwood Town Council Emergency Meeting April 16, 2019 The Elwood Town Council met at the Elwood Town Hall, 5235 West 8800 North, Elwood, Utah, at 7:00, April 16, 2019. The following members were present consisting of a quorum. Keenan Nelson Mayor Amy Griffin Councilmember Mike Pace Councilmember Oakley Nelson Councilmember Jon Howard Councilmember Staff present at this meeting Gina Marble Town Clerk Steve Woerner Public Works Director Amy Hugie Elwood Attorney Others present at this meeting Jay Stocking WELCOME ADMINISTRATION Mayor welcomed everyone to the meeting, Item#1 Elwood Acres amending a recorded final subdivision plat-Jay Stocking, Mayor asked if there was any public comment regarding the amending of the final plat, no public comment was made. Mayor Nelson stated that the council is all in agreement to the shoulder of the road. Amy Hugie reported to the council that Jay is asking to change line#8 on plat to say floor height to be same elevation as shoulder of asphalt. No Basements allowed. Amy stated that all of the Elwood plat maps states that Elwood Town is not responsible for surface flooding. Any structure shall be constructed so that the finish floor is equal or above the centerline of the adjoining road. Amy asked the council to decide how they want the plat to read either the shoulder or the center of the road. Mayor stated that the council is in agreeance to the shoulder of the road. Jay Stocking is fine with no basements. Councilmember Pace made a motion to amend Elwood Acres plat to state note #8 Elwood Town is not responsible for surface flooding. Any structure shall be constructed so that the main floor elevation to be at above or equal to the shoulder of the asphalt of the adjoining road 4800 North for lots 2,3,5,6,8,9 &10 and Any structure shall be constructed so that the main floor elevation to be at above or equal to the center of the asphalt of the adjoining road 9370 North for lots 4&7. Councilmember Nelson seconded the motion and the remaining council agreed. Councilmember Pace made a motion to amend Elwood Acres plat to state note #10 no basements to be allowed to be built on lots 2-10 in the subdivision. Councilmember Nelson seconded the motion and the remaining council agreed. Councilmember Pace made a motion to amend Elwood Acres plat to state note #11 lot #1 was built out of compliance with note #8 Sierra Homes will be responsible for drainage and is liable for a drainage plan that is acceptable to Elwood Town engineer and Sierra Homes will be responsible to implement the set plan. Councilmember Nelson seconded the motion and the remaining council agreed Councilmember Nelson made a motion to adjourn, Councilmember Griffin seconded the motion and the remaining council agreed.
