1. Call to Order/Pledge of Allegiance.
Meeting called to order at 7:00 PM and the Pledge of Allegiance was recited.
2. Discussion/action on minutes.
Motion by Chair Syme, seconded by Mr. Neal, to approve the minutes from February 15, 2019. All voted in favor.
3. Discussion/action on Brookside Acres Subdivision 2424 West 200 South.
This property is zoned A-1 and the developer proposes a subdivision of 20 new lots on 28 acres.
Mr. Morris has reviewed and edited the CC&Rs. Staff recommends preliminary approval with the following items:
- The sewer connection has changed in that the sewer line north of Mill Creek will now connect into the existing trunk line located north of the subdivision, and everything south of Mill Creek will connect to the sewer on 200 South.
- Letter from the Fire Marshall granting approval needs to be submitted.
- The perimeter fence must consist of non-combustible material.
- 2400 West will be the assigned street number entering the subdivision per City Engineer requirements.
- Language designating the conservation easement adjacent to the Slaterville Park is needed on the Plat.
- An area must be designated for postal boxes with approval from the Postal Service.
- Lots 19 and 20 will be located near the trail that will provide access to the open space west of the Slaterville Park. The Site Plan needs to show a 15 foot easement on both sides of the trail leading to the open space. The cost of a chain link fence to be put in escrow for the homeowner to draw upon or upgrade to a higher quality or material.
Mr. Hunsaker expressed concern about the public drain ditch located on the east side of 200 South and 2400 West. He feels there is a public safety risk due to the road eroding and that it will slump over time unless this drain is piped. It was determined that this drain will be piped for the portion parallel to the new 2400 West, until that same new road curves west away from the drain.
Staff reviewed the checklist of the requirements for preliminary approval in the Municipal Code and noted the ones that are still being resolved, such as the landscaping plan and other preliminary issues. It was determined that the developer is able to met the preliminary approval requirements. Prior to the motion Mr. Hunsaker recused himself due to a possible conflict of interest.
Motion by Vice-chair Meyerhoffer to grant preliminary approval subject to compliance with the following:
- Compliance with staff and agency requirements.
- Compliance with City Engineer recommendations.
- Commitment to serve letters from all affected entities.
- Fire District approval.
- Bona Vista approval.
- Central Weber Sewer District approval.
- Secondary water dedicated to the City.
- Compliance with Municipal Code.
- Compliance with required landscaping plan.
- Official intersection address is to be 2400 West 200 South.
- The storm drain system to be piped along 2400 West past the curve.
- Escrow the cost for a chain link fence adjacent to the trail of Lots 19 and 20 which may be upgraded by the lot owners.
Motion seconded by Mr. Schofield. Vote called with all in favor, none opposed.
4. Commission and staff follow-up.
Chair Syme asked how the pressurized irrigation system from the Spencer Farms pond irrigates Upland Ranches. Trent explained the process. Chair Syme stated that one of the lots in Spencer Farms has a 6 foot fence that extends to 250 North, which is in violation of Municipal Code. This was referred to Mrs. Panter for code enforcement.
Mr. Morris informed the Planning Commission of the potential impact of a large piece of property which has been purchased by Joseph Adair from the Stanger family. The property is zoned A-1 and Mr. Adair has plans for a large estate which will include a home, horse stalls, and riding arena. Chair Syme asked if the riding arena was allowed and was told that it is allowed in an A-1 zone under our code. The estate will be residential and non-commercial.
Mr. Schofield asked about the transient ordinance. Mr. Morris has prepared a draft which will then be sent to the City Council in April. Action by the Planning Commission is not required.
Mr. Hunsaker asked if we have an ordinance regarding mother-in-law apartments. Mr. Morris said the City does not allow two dwellings on the same lot in single-family zones.
West Weber plans to initiate the process to incorporate. However, the City will proceed with the Annexation Policy Plan in case that process fails.
5. Adjourn.
Being no further business, the meeting was adjourned at 7:56 pm.
